i wonder if this ditch is an area where teenagers hangout, or maybe someone who picks cans/bottles? In the area I live in ditches are where people hangout and drink, maybe even draw graffitti...just wondering maybe this was not a sex offender. Or if it was a sex offender I wonder how much he/she is willing to turn him/herself in.

GREELEY, Colo. -- The search for Kayleah Wilson's killer or killers revved up Friday as police arrested her former boyfriend for sexual assault on a child.

Robert Laurencio Montoya, 18, was arrested on Wednesday but his arrest wasn't announced until Friday afternoon.

"This arrest culminated an investigation that developed from information that probable cause existed to believe the suspect was involved in a sexual relationship with Kayleah Wilson," said Greeley Police spokesman Sgt. Joe Tymkowych. "This arrest is separate and distinct from the Kayleah Wilson homicide case that is currently being investigated."

Montoya was formally charged with sexual assault on a child and sexual assault on a child as a pattern of abuse -- both felonies. He is being held on a $100,000 bond.

Kayleah went missing on March 28, shortly after leaving her family's apartment in the 2800 block of 28th Street at about 4 p.m. She was walking a short distance to a birthday party at a friend's house on the south side of the nearby Greeley Mall.

Kayleah failed to meet another friend who was going to walk to the party with her and never arrived at the party. A blurry surveillance video shows someone resembling Kayleah walking through the mall parking lot but police said it is not certain that the person in the video is Kayleah.

The birthday party was supposed to end at 7 p.m. and Kayleah was due back home by 8 p.m. When she failed to return home, her mother found out Kayleah never made it to the party. That's when she called police.

Police asked the Colorado Bureau of Investigation for an Amber alert on Kayleah but it wasn't issued because there was no proof she was in immediate danger of serious bodily harm or death. -- a safeguard put in place to prevent multiple Amber Alerts going out on a daily basis, thus desensitizing the public to them.

Police had been stymied for nearly two months because there was no way to determine if Kayleah had run away or met with foul play. There were no reports of a possible abduction or struggle in the area. With no clues to lead them either way, police had very little to go on in the search for the Greeley 12-year-old.

When Kayleah's body was discovered on Wednesday, it gave police a starting point for the investigation. When the autopsy confirmed Kayleah was killed, the manner of death provided additional information to homicide investigators.

Police said they wouldn't publicly reveal how Kayleah was killed in order to protect the investigation.

Now, working with the FBI and Colorado Bureau of Investigation, Greeley police likely have a better forensic profile of Kayleah's killer or killers, given the approximate time and manner of death and the method of disposal of the body.

The profile might help police determine if the crime was committed by someone who knew Kayleah or if it was a crime of opportunity, carried out by a stranger, or strangers, acting on impulse.

Investigators will likely look at the time of death to determine how long Kayleah was alive after her abduction. This information could help the FBI develop a detailed psychological profile of the killer -- whether he took his time before killing her or acted quickly after her abduction. However, the fact that the body had been in cold weather and water for two months might prevent pathologists from accurately determining an approximate date of death.

Cooler temperatures might also help investigators in their search for evidence, according to a local professor of diagnostic and biological services.

"It's cold weather so there is a chance (evidence) could be preserved for a longer period of time than it would be in hot weather," said Dr. John D. McDowell at the University of Colorado, Denver.

He said the ditch water also contaminated the body, making the job of sifting through forensic evidence much harder.

It means the forensic examination of the body will take longer than usual.

"It is very difficult but they want justice for Kayleah. If that means the police have to hold onto the body a while longer, the family is okay with that," Wilson family spokesman Kristopher Poskey told 7NEWS on Friday.

Also added to the profile, how Kayleah was killed. Police will also check see if the modus operandi -- commonly called the perpetrator's "M.O." or "method of operation -- in the Kayleah case matches any similar unsolved crimes in other jurisdictions.

Investigators will also try to determine where the body was dropped in the canal and if the body was clothed or nude at the time. This information would also aid investigators in developing a profile of the killer and possibly reveal if the killer was familiar with the area.

"We've got a lot of work to do now," Police Chief Jerry Garner said at a Thursday briefing.

Behavioral Changes

About a week after Kayleah disappeared, the FBI announced a $20,000 reward for information that would help solve the case.

FBI Agent-In-Charge James Davis released a list of behavioral changes in a person that might point to someone involved in Kayleah's disappearance.

Among those possible changes that might re-manifest themselves now that the body has been found:

# Coming up with an excuse to leave the area unexpectedly for what may sound like a good reason. (work-related, visiting relatives)

# Missing work, calling in sick, asking to change shifts, particularly on days close to the night Kayleah disappeared or after the body was discovered.

# An unexpected or sudden interest in the status of this investigation. Paying close attention to the media, or avoiding participation in any conversations or activities related to this case.

# Minimizing or denying a known acquaintance with Kayleah.

# A recent display of nervousness or irritability.

# A recent increase or decrease in expressing religious beliefs.

# Changes in routine sleep patterns.

# Changes in their ‘usual’ consumption of alcohol, drugs or cigarettes.

# Shaving off facial or head hair, or growing a mustache or beard.

# No longer driving, or changing the appearance of his personal or work vehicle for no obvious reason. Leaving it parked in a shed or garage. Covering it, painting it, selling it or reporting it stolen. Giving it away.

Davis said that if an individual exhibits some of these changes, it doesn’t necessarily mean that they’re involved in some kind of crime, but he wants the public to be aware of the possibility.

Police have also talked to all registered sex offenders in the area but will likely look at previous crimes by sex offenders that may fit the Kayleah Wilson abduction profile -- a younger girl grabbed while walking through a public area.

A tipline is in operation for the public to call police: 970-350-9600.

"We need information, even if seems like something we already know," Garner said. "We encourage people to keep calling us with information and we need everything we can get."

Garner said no one has been ruled out but investigators have nothing that points them to family members.

April Wilson has gone into seclusion as she attempts to cope with the loss of her daughter. A family spokesman said in a statement Friday that April Wilson is grateful for everything from law enforcement to volunteer searchers to the outpouring of community support expressed during the two-month ordeal.

"We all know that Kayleah is in a better place; she will not be forgotten," the statement said.

OMG!

So he had already turned 18, and she was a 12 year old sixth grader. Shame on him!

I find curious that he was arrested on Wednesday, and NOW today (Friday) it is being reported. It seems that LE in Greeley are keeping things well under control.

Now, if she wanted to break it up... was he stalking and harassing her since the breakup, or did he move on?

How does the police know he had sex with her at least twice... was she pregnant? Did he admit it?

I misunderstood I thought he was arrested for that as well.

I haven't seen anything yet that indicates he was arrested for Kayleah's murder.

Kayleah Wilson's Boyfriend Arrested For Sex Abuse
May 21, 2010



Greeley Police have arrested the boyfriend of murdered girl Kayleah Wilson for sexual assault on a child. Robert Laurencio Montoya, 18, is accused of sexually abusing Wilson.

The 12-year-old disappeared March 28. Her body was found at 6 a.m. Wednesday. Montoya was arrested 14 hours after Kayleah's body was found.


Montoya is being held in the Weld County Jail on a $100,000 bond for Sexual Assault on a Child and Sexual Assault on a Child as a Pattern of Abuse.

Greeley Police said this is a separate investigation from the murder investigation of Kayleah.

CBS4 has learned Montoya has been arrested before. He faced sexual assault charges in January and October 2009.


Greeley Police Chief Jerry Garner spoke at a news conference Thursday afternoon and said investigators are still asking for public support with information into Kayleah's murder.

"Her death occurred sometime ago, it didn't occur within a day or two of the body being found," said Garner.

He also said there are a wide range of people of interest that police will be following up on, but said there is nothing to indicate there is a family member as a suspect in the case.

Friends of the family said the news is difficult to hear.

"It's just devastating to the family, to us, to the community," said Wilson family friend Cheryl Fendrick.

Garner confirmed dental records were used to identify the body. The autopsy was completed late Wednesday. How she died has not been released.

Kayleah's body was found early Wednesday morning. There was immediate speculation that it could be that of Wilson, who who was last seen March 28 while walking to a friend's house for a birthday party.

Garner met with Kayleah's mother, and said she is acting as any mom would in that situation, she is upset. He tried to reassure her that police would continue to make this case a priority.

"We don't give up on cases like this, we don't give up," said Garner.

In her memory, classmates at Brentwood Middle School dotted the middle school playground, where Kayleah was a student, with pink ribbons on Wednesday. That's when the principal told them about the grim discovery.

"He kept the sixth grade after school and he told us that they found a body. And this one girl started breaking out and crying. It's been two months, I'm really scared for her. I hope she's okay," said Kayleah's classmate Christian Shackley.

A crisis team was at the school again Thursday.

Investigators don't know how long the body had been in that ditch. It runs underground for about a mile, and crews had flushed the ditch with water on Tuesday, the day before the body showed up. Investigators believe it's possible someone was trying to hide the body in the ditch.

A candlelight vigil was held Wednesday night near the ditch. Attendees prayed for the family of Kayleah.

The FBI continues to offer a $20,000 reward for the arrest and conviction in Kayleah's murder.

People with information in the case are asked to call the Greeley Police Dept. at 970.350.9600.

Yikes did you see his pic? He does not look like a nice guy. I would post the pic but still cant do that. What on earth was he doing with a 12 year old other then something with horrible intentions. What a creep. He was arrested the same day she was found so maybe they found something of his near or on her?

An 18-year-old man who authorities allege had a sexual relationship with Kayleah Wilson has been charged with sexual assault on a child, Greeley police said this afternoon.

However, Greeley police said that the arrest of Robert Laurencio Montoya is "separate and distinct" from the Kayleah Wilson homicide case currently being investigated.

Sgt. Joe Tymkowych said that the arrest of Montoya culminated an investigation in which probable cause was developed to believe Montoya was involved in a sexual relationship with Wilson, who was 12.

Her body was discovered in an irrigation ditch on Wednesday morning, about a half mile from her home.
The Weld County District Attorney's office said that Montoya has been

charged with two counts of sexual assault on a child.

One is sexual assault on a child, a class four felony. The second count is sexual assault on a child, pattern of abuse, a class three felony.

Montoya was arrested on Wednesday and appeared in Weld County District Court this morning, said Jennifer Finch, spokeswoman for District Attorney Ken Buck. Montoya's bond was set at $100,000, which he has not made.


Wilson's body was discovered in an irrigation ditch by a ditch rider at about 6 a.m. Wednesday in a pool about 10-feet wide and 3-feet deep, just below an irrigation gate.

The area where the body was found had been searched extensively at least twice by people looking for the 12-year-old.

Greeley Police Chief Jerry Garner said that heavy rains both Tuesday night and several days ago may have "moved the body from a culvert or hiding place" to a position in the ditch where it could be seen.


About 10 a.m., Wednesday the body was removed from the ditch and taken to McKee Medical Center for identification.

On Thursday, Garner announced that the body was that of Kayleah Wilson.

"We've got a lot of work to do now," said Garner when he announced the identification and said
Kayleah had been murdered.

"We'll be talking to lots of people," he said.

The coroner determined that Kayleah's death was a homicide - but Garner would not say exactly how she died.

He also would not say how long she might have been in the ditch, which is half a mile from her home but not on the route to her friend's house, where she was going to attend a birthday party.

Kayleah was last seen March 28, shortly after leaving her family's apartment in the 2800 block of 28th Street.

DENVER — An 18-year-old Colorado man has been arrested for allegedly having sex with a 12-year-old girl whose decomposed body was recovered this week in an irrigation ditch, police said.

Greeley police Sgt. Joe Tymkowych said the arrest of Robert Laurencio Montoya, a former boyfriend of sixth-grader Kayleah Wilson, is unrelated to the homicide investigation involving her death. Authorities said they know how the girl died, but aren't releasing details.

"This arrest is separate and distinct from the Kayleah Wilson homicide case that is currently being investigated," Tymkowych said in a statement.

Kayleah had been missing since March when her body was found Wednesday in an industrial area about a half-mile from her house. Montoya was arrested that same day, police said.

He faces felony charges of sexual assault on a child, pattern of abuse. He appeared in court Friday where bail was set at $100,000.

His next court hearing is May 25.


Tymkowych said Montoya had previously been interviewed and cooperated with their missing person investigation.

It was unclear whether Montoya had hired an attorney. A home number could not be immediately found.

On Friday, police said they were examining a "mountain of evidence" and developing a list of people to re-interview about the disappearance and death of the 12-year-old.

Tymkowych said they still had no suspects in the slaying but are looking at a range of individuals who had the time and opportunity to kill Kayleah and don't have good alibis.

"We're reviewing every detail that we developed when this was a missing person investigation, deciding which lead could be more fruitful, then prioritizing which people to talk to first," Tymkowych said.

Evidence gathered along the irrigation ditch earlier this week was also being processed for testing. Tymkowych would not disclose what investigators found.

Two eyewitnesses previously told police they saw Kayleah at the Greeley Mall March 28, about a half-hour after her mother said she left to attend a friend's birthday party. Tymkowych said police also have surveillance video from near the mall showing a grainy figure that could be Kayleah.

Kayleah's last known whereabouts are crucial in determining how her body ended up about a mile away from the mall, where a worker checking the ditch after a heavy rain found the body Wednesday.

Meanwhile Greeley, an agricultural community of about 93,000 people 65 miles north of Denver, grieved the death of Kayleah. A steady stream of parents and children, some in tears, visited the spillway in the ditch where Kayleah's body was found. A makeshift memorial of teddy bears, candles, flowers and crucifixes grew on the grassy banks.

"It's an open wound because whoever did this is still out there," Melissa Lujan, whose daughter knew Kayleah said Thursday. "You know it's bringing us together to where we watch our children more often, we tell them we love them, we kiss them goodnight, kiss them before they leave but just knowing that somebody could do this."

Cheryl Frendrich, whose grandson was friends with Kayleah, described her as a "happy little girl, full of life."

The decomposing body had been in the irrigation ditch "for some time" in an area that had been searched twice, Police Chief Jerry Garner said. Greeley is about 60 miles northeast of Denver.

Wilson's March 28 disappearance spawned repeated searches by police, Greeley residents and the FBI. Authorities said they pursued more than 300 leads and knocked on the doors of about 1,000 homes.

No one has been ruled out as a suspect, but investigators have nothing that points to family members, Garner said.

In April, as leads from the public dwindled, authorities increased the reward for information about Wilson to $20,000. Investigators also described behavior that might point to a possible abductor. They urged people to watch for someone who had missed work, had unexplained injuries or shown an unexpected or sudden interest in the case.

Police met with Kayleah's mother, April Wilson, before the public announcement. A victim's advocate said Wilson did not want to speak with the media.

Wilson describes her daughter as "loving" and "trusting," and said that she's always been well-behaved, except for a recent incident involving an older boyfriend.

According to Wilson, Kayleah had been seriously involved with a 17-year-old who was friends with her older brother, but the couple had broken up a few months ago.

Other than that, Wilson said her daughter is a typical preteen who has a crush on one of the singers from the folk band Celtic Thunder.

On the morning of the day she disappeared, Wilson said her daughter had gone to church with her and had been happy during a lunch at a local restaurant with her grandmother.

"I just want everyone to help find her. I don't care if you're in this state or in another country, just help," said Wilson.
