Remains May Be Those of 12-Year Old Kayleah Wilson

Kayleah Wilson left her home in Greeley, Colorado on March 28, 2010 to go to a birthday party. The 12-year old was never seen again. Police announced the discovery of a decomposing body today about a mile away from where Kayleah Wilson was last seen alive.

According to Greeley Police, the decomposing body was found in a ditch at about 6:00 this morning, by a worker who was inspecting water levels in the region. In an advanced stage of decomposition, police were unable to tell if the body was that of a male or a female. Dental records and/or DNA would be needed to determine if the body was that of Kayleah Wilson.

Kayleah's mother, April, was notified that a body had been found, and an advocate had been sent to her home. A family friend made the following statement to Fox31 News in Denver.

"Hopefully this isn't her, (but) if it is, let's lay her to rest and may she rest in peace," said Cyndi Rogers, a family friend. "If not - Kayleah, we're not giving up on you."

There have been no suspects or leads in the Kayleah Wilson case. It breaks my heart and shakes me to the core to think of little girls, just 12 years old, going missing. Children aren't supposed to disappear walking to a friend's birthday party. We have to be vigilant and look out for one another's children. After all, it does take a village.......

GREELEY, Colo. — Police retrieved a decomposed body from an irrigation ditch in northern Colorado on Wednesday, about a half-mile from the home of a missing sixth-grader.

There was no immediate indication of whether it was the body of 12-year-old Kayleah Wilson, who was last seen walking March 28 to a friend's house for a birthday party.

"We are unable to make an identification at this time," Sgt. Joe Tymkowych said. "The decomposition is to the point where it's difficult to say whether it's a male or a female."

Tymkowych said investigators couldn't rule out that the body was the brown-haired, blue-eyed Wilson, described as about 5-foot-1 and 145 pounds. "Given the size of the person and its state of decomposition, it's a possibility," he said.

A worker checking the ditch for problems after heavy rain Tuesday found the body in about 3 feet of water early Wednesday, Tymkowych said.

Tymkowych wouldn't comment on how long officers believe the body was at that spot. Searchers had checked the ditch at least twice before while looking for Kayleah, he said. Investigators planned to use dental records and possibly DNA and hair fibers to identify the body.

Identifying the body through dental records could take days, but it could take weeks if investigators must use DNA, FBI spokesman Dave Joly said.

A few of Kayleah's friends and residents gathered at the ditch as officers walked along it searching for evidence on Wednesday afternoon. Investigators found what appeared to be a scrap of clothing in the ditch.

"Whether that particular piece of evidence at the scene is related to the case, we still don't know," Tymkowych said, adding that investigators also found a coffee cup and other items he would not disclose. "Anything that's not a weed or a rock or piece of dirt, we picked it up."

Kayleah's friend Shelly Culver, 18, described Kayleah as outgoing and said she loved to draw. "Kayleah would not be the kind of person to run away."

Melissa Lynch, 31, whose daughter goes to school at nearby Frontier Academy, said, "To a lot of us that live here that have kids, it's more than just 'that Greeley girl.'"

A victim's advocate at the home of Kayleah's mother, April Wilson, said Wilson declined to comment Wednesday.

GREELEY, Colo. -- A badly decomposed body discovered early Wednesday morning in a Greeley ditch by an irrigation worker is believed to be that of Kayleah Wilson, the 12-year-old Greeley girl who has been missing for nearly two months.

The girl, who vanished March 28 while walking to a friend's birthday party, has been the subject of widespread searches.

A well-placed, high-ranking law enforcement source told CALL7 Investigators that based on current information the FBI believes it is the body of Kayleah Wilson but cannot definitively confirm until it compares dental records.

The FBI is declining any comment until it has confirmed an identity. DNA and hair fibers may also be used to identify the body, police said.

Kayleah was last seen on a surveillance video walking alone outside the Greely Mall, the FBI said. She was apparently en route to a birthday party, just south of the mall in the 1900 block of 30th Street.

She never arrived at the party. The ditch where the body was found is about 1½ miles west of the mall and birthday party site. The canal is close to her home but in the opposite direction from where she was headed.

The worker who made the grisly discovery in the Greeley-Loveland Irrigation Canal said the body was naked, bloated and white, according to a 7NEWS source.

The worker didn't recognize what it was at first, but quickly realized it was a body. A law enforcement source told 7NEWS that it is the same size, sex and age as the missing sixth-grader from Brentwood Middle School.

Kayleah has brown hair, blue eyes, is about 5 feet 1 inch tall and 145 pounds.

Did Heavy Rain Dislodge Body?

Greeley police Sgt. Joe Tymkowych said the discovery was made at about 6 a.m. near 35th Avenue and 29th Street by a worker who was inspecting an irrigation ditch, as he does daily.

When the worker opened a water-control gate near 29th Street, he spotted the body partially submerged in 3 feet of water and called 911, Tymkowych said.

Tymkowych said that area has been searched at least twice for Kayleah, who lives about a half-mile away from the ditch. However, the searches may have occurred when the water was low, or when the ditch was relatively dry, he said. The irrigation ditch also runs underground from 47th to 35th avenues.

Heavy rains and hail deluged Greeley Tuesday night, and the strong water currents may have dislodged the body from its initial location.

"It may have been part and parcel in exposing this body... we just don't know yet," Tymkowych said.

The body could have been buried and now it's surfaced, or it could have been dropped off, or any other number of scenarios, former FBI agent Bob Pence said.

"It's just impossible right now to determine when the body was deposited," Tymkowych said. What it is clear is that the body was not at the irrigation site on Tuesday, because it was inspected on Tuesday.

The body was pulled out at 10 a.m. by Union Colony Rescue Authority Dive team. They wore protective suits to avoid coming in contact with any pathogens from the decomposing body.

The Weld County Coroner's Office responded to the site and took the body to McKee Medical Center in Loveland for an autopsy.

Investigators conducted an intensive search in and along the ditch. Police officers with probing poles waded in the water to search the ditch and its banks for additional clues. The ditch was drained so investigators could get a closer look at the bottom of the canal.

Investigators recovered evidence near the body, but Tymkowych declined to say what was found, saying police need to protect the ongoing investigation. Greeley police also collected evidence from a culvert across from Kayleah's home.

The water in the ditch runs northeast -- or toward Kayleah's home.

"The first determination is who is this body? It's going to be very sad for someone," Pence said, detailing the possible next steps in the investigation. "If there's any type of clothing or artifacts found with her that would be one thing that could help determine what happened ... and how she died."

"Water is only going to deteriorate the condition of the body," Pence said.

He said if they determined there was a violent cause to her death, investigators would need to secure the scene.

"They need to know when the body was deposited there and how," he said.

Kayleah's Friends, Family React To News

Kayleah's mother, April Wilson, was informed that a body has been found. A victim's advocate answered Wilson's door and asked the media to respect her privacy.

7NEWS reporter Lance Hernandez asked family friend, Cheryl Fendrick, if the canal area was a place Kayleah would have gone on her own.

"She would have no reason to be (here)," Fendrick said. "If it's Kayleah, (she) had to have been brought here."

Fendrick, who has participated in several searches for the girl, said that family and friends plan to hold a candlelight vigil at 7 p.m. at the site where the body was found.

"She used to call me Grandma," said Fendrick, adding that the nearly two months of wondering and worrying has been an ordeal for family and friends.

It's been "very hurtful, very painful. (I'm) very scared for her," the woman said. She has been "praying that we find her alive, praying that somebody that had her would let her go and let her come home."

Michelle Thompson, who has led volunteer searches for the girl, said they will continue with the scheduled search this weekend, until it is confirmed that it is Kayleah.

"We have to keep on the faith," Thompson said, he voice breaking.

Some friends expressed hope that the body does belong to Kayleah, because even if it is bad news, at least they can lay the girl to rest and provide the family closure.

April Wilson has said her daughter was a good girl, who was never into drugs or gangs.

The cause of the girl's disappearance remains a mystery. Police do not know if it's the result of foul play, an accident, or if she ran away.

"Kayleah would not be the kind of person to run away," said Kayleah's friend Shelly Culver, 18. She said Kayleah was outgoing and loved to draw.

Culver said she's hoping it's someone else.

"I'm scared because that was my best friend," Culver said.

"I'm scared that it was her. She was only 12."

The body was found in a drainage ditch less than a mile from Wilson's home. The 6th grader has been missing since March 28 when she disappeared while walking to a friend's birthday party near the Greeley Mall.

Police said the body was too decomposed to determine if it was male or female. The remains were sent to McKee Medical Center in nearby Loveland, Colo., Greeley Police said.

Dozens of mourners, including friends of Kayleah's family attended a candlelight vigil Wednesday evening along the ditch where the body was located.

Kayleah has been missing for nearly two months.

There was a mixture of emotions Wednesday night
in Greeley as friends and family held a tearful
candlelight vigil, waiting anxiously to learn if the
body could be lead to the outcome they've feared for
months.

9NEWS spoke to Michelle Thompson, a friend of the
family who says April Wilson, Kayleah's mother, is
heartbroken to learn of Wednesday's discovery.

"She's at a loss, along with the rest of us,"
Thompson said.

A reporter asked one of Kayleah's friend if the missing girl would've gotten into the ditch by herself.

Looking at the map one can tell that the ditch is out of the way from the mall she was last seen around, her home, and the house she was supposed to have visited.

I personally would not have allowed my daughter to walk that far by herself in those busy roads. I don't want to condemn or judge the mother, but these days one has to be extra careful with the children. Too many wackos out there waiting for the opportune moment to make their move.

Members of the Union Colony Fire/Rescue Authority and Weld County coroner's investigator George Roosevelt remove a body behind a tarp held up by firefighters. The body was found Wednesday morning in a drainage ditch along 35th Avenue and 29th Street. The body, which has not been identified, was found within a half-mile of the home of Kayleah Wilson, 12, who has been missing since March.

In a ditch where a body was found Wednesday in southwest Greeley, the water was just turned on Tuesday to clear the irrigation ditch. That means the body may have been tucked into an underground portion of the ditch for as long as two months — if the body is identified as that of a missing Greeley girl.

About 6 a.m. Wednesday morning, a ditch rider found the badly decomposed body near a water gate on the ditch. Police and the Weld County Coroner's Office had yet to identify the body Wednesday night.

Greeley-Loveland Ditch Co. officials said they delayed running water to clear the ditch because of recent rainfall, but the water was released Tuesday. Also, rainstorms in the area Tuesday night meant the water in the ditch was running high.

The ditch goes underground for about a mile from 47th Avenue to 35th Avenue, and there are access grates and manhole covers along the trail that follows above the ditch. The body was found about a quarter-mile from the underground exit of the ditch.

After the body was found, Greeley police called the FBI, which sent agents from Denver to the site just a half-mile from the home of missing 12-year-old Kayleah Wilson.

Ron Brinkman of the ditch company said the rider had been working for 10 years on the ditch, “and never found anything like this.”

An autopsy was performed on the body Wednesday afternoon, but police still weren't saying whether the body was that of Wilson. Because of decomposition, police weren't immediately able to determine whether the body was that of a male or a female.

Kayleah disappeared March 28 after she left her home in south Greeley to meet a friend for a birthday party. It spawned the most intense investigation in Greeley history, with more than 50 FBI agents, dozens of Greeley police and Weld County sheriff's deputies searching for the girl and for evidence in the case.

Greeley police spokesman Sgt. Joe Tymkowych said the area where the body was found had been searched at least twice since Kayleah went missing. Police have a surveillance tape from the Greeley Mall that shows her in the parking lot on the day she disappeared. The mall is about a mile east of the spot where the body was found.

Yes, terrible.  I was just wondering, if this is Kayleah, and couldn't the time spent in that water, and flow of water, have removed her clothes? Or is that just plain naive on my part? I would imagine, some clothes could have came off, but not all of them

The individual under discussion at the town hall meeting, Johnny Carlos Cardoza, is the only person in the county listed as a sexually violent predator. Because of his designation, state law stipulates a town hall meeting informing the community of his residency should be held. Cardoza is currently residing on North 13th Street in Lamar.  Should he move to another address, even while remaining in the same community, another meeting informing the public must be held.  Cardoza was convicted of attempted sexual assault on a 14 year old female eight years ago when he was 20.  He served three years in prison and will be registered as a SVP for the rest of his life.

Chief Phillips said that because he has served his term, Cardoza is free to move about the community and does not have to check in with probation officers or the police, but must keep authorities up to date on any residency changes.  Phillips said the community still needs to keep a watchful eye on any activity that may seem amiss.  He added that the number of phone calls the police department has received from two years ago is up 237%.  The chief said this type of community involvement, for any type of illegal activity, is what has helped the department in it’s campaign against drugs in Lamar.  Probation officer Hall said that Cardoza should not be harassed or confronted and community members should not feel they have a right to act as a vigilante in this matter.  Hall said studies have shown that if anything, this type of well-meaning action is actually counter-productive to Cardoza or other sex offenders maintaining a balance in their lives.

A brief question and answer period followed with Chief Phillips responding to written questions from the audience.   He said Cardoza has family in Lamar and selected the community in part for his desire to get away from a metro area and because of a family base here.  Even though he is residing three blocks from Lincoln Elementary school and from Escondido Park, the police do not have the authority to tell him where he can and cannot live, nor can any offender be forced to be physically altered through an operation to help control violent urges.  Phillips added the best way to keep our community safe was to be watchful and to always communicate any questions or observations to the local police or sheriff’s offices.  Other panel members who contributed information included Doris Hughes, director of Domestic Safety Resource Center and Cathy Rodriguez, State Criminal Justice Division.

I don't know if this guy is involved, but he would be near the top of the list. I imagine he was questioned when Kayleah disappeared.

Body found: A closer look at the ditch

The ditch where a body was found Wednesday is a long-standing irrigation ditch that meanders from the mountains into the center of Greeley.

The Greeley-Loveland Irrigation Canal was built in 1890, according to Ron Brinkman, the secretary of the ditch company. It was one of the ditch company's riders who found the body about 6 a.m. Wednesday.

The ditch rider did not want to talk about the discovery.

Brinkman said the water for the ditch is usually turned on in early May, but was delayed until Tuesday because of precipitation in the area.

The ditch begins at Boyd Lake north of Loveland, and carries water through the Johnstown-Milliken area, through St. Michaels Center to 47th Avenue, where it goes underground for about a mile.

Along that underground tube, manholes and gratings have been built to allow access to the underground ditch for repairs. It comes to the surface again at 35th Avenue, about a quarter-mile from where the body was found.

After the open ditch flows behind Trinity Lutheran School and the Sunset Memorial Gardens cemetery,

it goes back underground until it ends at two locations: Glenmere Park and the small pond beside the University of Northern Colorado's Nottingham Field.

When A ditch goes underground.. That means there is a large pipe..Normal for Concrete or Steel but could also be very large PVC
The pipe has to be large because of dirt build up in the bottom from the rest of the creek which is open dirt ditch.
 So the question would be this.. Did she try to cross the creek and drown ? Was her body stuck in the underground pipe ? Did the perp "if there is a perp" put her body into the underground flow of water ? or bury her in wet dirt along the bank of the creek ?
Before we can go after a perp we have to rule out a possible accident. I have jumped creeks before and not made it across and ended up in the water when I was young and farmers had peculation ponds with creeks all over the place to feed there orchards and fields. We did have one young fellow who ended up drowning in one of those creeks when I was young and they found up up against a grate in the creek used to catch limbs and other stuff flowing down the creek.

That is what I've been wondering, it appears to be like a piece of wood that you could walk on to get across, what if she fell in? My question would be, with the flow of water, could your clothes come off? I would think, yes, some would, but don't know.
