New Casey Anthony judge sets tone for lawyers

Judge Belvin Perry set an April 30 date for a status hearing, and he serves notice in his order that he expects an orderly, professional case.

By Alan Schmadtke, Orlando Sentinel

1:40 p.m. EDT, April 22, 2010

True to his reputation, new Casey Anthony judge Belvin Perry wasted little time laying out his expectations for attorneys on both sides of the murder case.

Perry today signed an order calling for an April 30 status hearing on the capital case, and the order spelled out what Perry has in mind for the direction of a case now in its second year.

In the first sentence in the order, Perry reminded prosecutors and defense attorneys that the Florida Rules of Judicial Administration say that: "Judges and lawyers have a professional obligation to conclude litigation as soon as possible . . ."

Perry also put attorneys on notice about how their behavior in court: He asked that they "familiarize themselves with the Ninth Judicial Circuit Courtroom Decorum Policy" and follow it "at all times."

Perry assumed control of the case Monday when judge Stan Strickland withdrew from it after defense attorneys said he was friendly with a local blogger.

Perry, the chief judge, decided to take the case.

In his order, Perry asked attorneys from both sides to come prepared to:

Discuss discovery and scheduling deadlines.

•Discuss future motion deadlines.

•Discuss motions that are still pending.

•And discuss pre-trial and trial dates.

The order reflects Perry's reputation for efficiency. He also asked attorneys to provide him a list of motions that will require evidentiary hearings and those based on pleadings and to give courtesy copies to the court of future motions.

The motion that defense attorneys filed asking that Strickland be removed from the case was not provided to the court ahead of time, court administrators said.

Meanwhile, the State Attorney's office will release another batch of discovery on Friday morning in the capital murder case against Casey Anthony.

Some of the new evidence could involve information gleaned from an FBI handwriting expert, according to a report by WFTV.com.

Anthony's defense team has requested records about analyst Lorie Gottesman, the station reported.

The state recently released copies of letters exchanged between Anthony and another Orange County Jail inmate, Robyn Adams. Anthony remains at the jail; Adams is in federal prison.

Anthony's family recently handed over a journal of hers to investigators, the station reported.

ORLANDO, Fla. --
The new judge who will preside over the Casey Anthony case made his first move on Thursday.

Chief Judge Belvin Perry wants to meet with attorneys in the case on April 30 for a status hearing.

Meanwhile, more evidence is expected to be released by the State Attorney's Office as early as Friday.

Members of Orlando's legal community said they're surprised at the defense team's successful quest to have Judge Stan Strickland remove himself from the case.

WESH-Channel 2 reported the news briefly at noon. “The new judge in the case against Casey Anthony had made made his first move,” anchor Jason Guy said. “Judge Belvin Perry wants to meet attorneys in the case a week from tomorrow.”

The WESH Web site described it as a status hearing. Judge Stan Strickland stepped down from the case on Monday, and Perry took over.

More evidence in the case is expected to be released Friday morning. Casey Anthony is charged with first-degree murder in the death of her daughter, Caylee.

And as far as I can tell.....these have not been filed with the clerk.........so Lyons is purposely leaking these to the media.....WHY?  Or did she leak them thinking JS would not recuse himself and when he did and JP took over she said OH CHIT!!!!!

Ruh-Roh--George and Cindy better watch out.  Their very existence will be the mitigating circumstances.

Since this is not filed with the clerk of the court (In TN it's clerk and master, don't know about FL) nor is it signed by all parties and undated, I don't think it's even a legal document.  I think the SA will have a lot of fun responding to this if it's ever filed.

The research done about George's innamorata or whatever she was, shows that suicide attempt was likely a hoax, and IMO George's purported suicide attempt was a non-event, I think they need to talk someone into actually committing suicide.    Of course, Cindy said she "Thought" about it, but I don't think that counts.

The Anthonys have attracted an entourage of fruits and nuts, IMO.

Does anyone believe the Anthonys are finally turning on their daughter to save their own sorry behinds?  Interesting them turning over the journal.  Maybe we will finally hear what Cindy really thinks of her precious "bad seed."  The truth will set you free, and then maybe you will all end up where you belong.  In prison.

The new judge in the Casey Anthony case is wasting no time showing why he's known for his no-nonsense approach.

Chief Judge Belvin Perry Jr. set a case management hearing for Friday April 22, demanding both sides be ready to discuss deadlines for releasing evidence, questioning expert witnesses and filing future motions.

Judge Perry also wants to discuss the trial date - now set for May 2011 - legal experts say he could move it forward.

Attached to the notice is Perry's list of rules for courtroom decorum, including attorneys only identifying each other by last name, avoiding personal attacks and cutting back on gestures, facial expressions and audible comments during witness testimony.

Judge Perry Orders Hearing In Casey Case
Thursday, April 22, 2010 2:45:59 PM
ORLANDO -- Chief Judge Belvin Perry has ordered a case management hearing for April 30 after Judge Stan Strickland recused himself from the case earlier this week.

In a written order, Perry said both judges and lawyers have "a professional obligation to conclude litigation as soon as possible."

He also said it's his responsibility to monitor and control the pace of the process.

Perry said the prosecution and defense should be prepared to discuss discovery deadlines, including the deposition of all witnesses as well as deadlines for future motions, and pre-trial and trial dates.

That hearing will begin at 9:30 a.m. at the Orange County Courthouse.

Judge In Casey Case Orders Management Hearing
Posted: 2:23 pm EDT April 22, 2010Updated: 3:04 pm EDT April 22, 2010
ORLANDO, Fla. -- The new judge assigned to the Casey Anthony case has ordered a management hearing for April 30 at 9:30am, according to a document (read order) released Thursday.

Chief Judge Belvin Perry has taken over after Judge Stan Strickland recused himself from the case Monday. Council for the state and the defense will discuss pretrial and trial dates, motion deadlines, scheduling and completion of depositions, along with other topics.
Judge's orders  http://www.wftv.com/pdf/23234284/detail.html
Chief Judge Belvin Perry also sent out an administrative order (read)  on courtroom behavior and decorum. The order specifies how anyone in the court must act while Judge Perry is presiding.
Chief Perry is the go-to judge for problematic criminal cases in Orange and Osceola counties and Casey's case has become one.

Judge Perry has an extraordinary record; almost always, what he says goes. He has been chief judge for almost 13 years. Over the last ten years, in the many criminal cases he's heard, some of which have been death penalty cases, only one of his rulings was partially overturned by a higher court.

Judge Perry has been on the bench in Central Florida for 21 years

I heart Judge Perry too!

Since these were always the rules that were in effect in the 9th Judicial Courtroom..I think that Stan let them get way with so much...maybe to give them enough rope so people could see how rediculous the whole defense team and the A's really are.

I hope we see Cindy and George get admonished by the Judge..I just no they can't control their behavior or facial expressions any better then their daughter.

No gum, no water bottles, phones off or on vibrate, no facial expressions, no outbursts of any kind.  Hey Lyons, Baez and Mason your going to have to keep your little snide comments to yourself.

I am so loving this.

Well, no wonder I did not understand it..................The link I went to previously only had the first two pages and certificate of service with no pages on the support of the motion. LOL

Thanks for posting the link and the explanations.

Turbo, on your original question I knew something didnt sound right, I now see that you did not have the complete document in front of you.   Now, that you have had the chance to read it in its entirety do you and everyone else agree it is riddled with references not relevant to the motion but more meant to influence as well as further the defense attempt at habitually referring to Casey as a victim a thousand ways to Sunday?

What I am finding interesting right now is they are arguing that the penalty phase proceeding is unconstitutional in one motion and in the same breathe intending to file this motion which on its face gives validity to the penalty phase by their very concerns in protecting what they would anticipate presenting on behalf of Casey Anthony as mitigating factors.   The appearance that they are all consumed with arguing against the DP being sought seems to indicate that this is more about saving her life rather than proving Casey & their claims of her innocence despite what they say otherwise.   I think its rather comical at this point that this defense team is yet again claiming that the prosecution has not established that this is a qualified death penalty case, yes they have - move on.   While it is their job to defend their client zealously & exhaust all options, this defense team takes that to mean to play dirty & waste the court's time shamelessly (this practice is not exclusive to them by a long shot but they are trying to make history with it).

As I see it, let them keep their mitigating argument & penalty phase witnesses secret as the law would permit nor will it prevent the prosecution from being prepared.   If she is convicted of felony murder she is either getting life or the DP - either way she never sees the light of day again & awaits her true judgment day.   I do agree that they will throw everyone and everything under the bus, but that was already expected.  It appears to me that Casey herself was writing things to establish just that.   Yes, it is my belief that she knew exactly what she was doing & this is why they did not object to her jail letters being released.
