Culpable homicide (also known as negligent homicide)http://en.wikipedia.org/wiki/Culpable_homicide

Not even a term used in the US, is the defense already setting up for negligent homicide against somebody?

If Tommy is "not culpable" per Werter somebody is "culpable".

What Werter said;  http://transcripts.cnn.com/TRANSCRIPTS/1004/27/ng.01.html

Mr. Werter, is it true that you have stated that your client can ID the killer, the person that took Haleigh?

WERTER: OK. That`s incorrect. What I stated was that he`s, first of all, not culpable but he does know what happened that night. I had been repeatedly saying that I cannot discuss the facts of the case because it`s an ongoing investigation and I`d like to see it come to a successful conclusion.

You being former in a way law enforcement by being a prosecutor, me being former law enforcement and a prosecutor, I`d like to see a successful end to this. And I think Tommy will come out very well with this.

GRACE: OK. Wait. Now you`re saying that your client knows what happened that night?

WERTER: Yes.

GRACE: What happened?

WERTER: I told you. I just told you. I cannot discuss the facts of the case because of the ongoing investigation. When I am dying for an arrest to be made in this case and I could be more forthcoming. But right now I have a good working relationship with law enforcement. I`m going to keep it that way.

It appears that Tommy Croslin was the weakest link.

It is only a matter of time before justice will prevail for Hayleigh Cummings.

So, in other words he is a willing participant to his client & the rest putting this all on Joe - even if that turns out to be a partial or total lie to save their own hides?

IDK I am confused about his use of the words "not culpable".  Seems to me sometimes these lawyers just use words in a different way to suit their needs for the crime.  JMO.

All I can find is Canadian law which is either Culpable(intentional) or Not Culpable(Unintentional).

I'm still looking at the same 3 characters.  But who knows?  Maybe Joe is in there somewhere but w/out evidence he's not?  who knows?  Confused.

The online law dictionary defines culpable this way:
Blameworthy; involving the commission of a fault or the breach of a duty imposed by law.

What I get out of this is that the lawyer is saying that Tommy is not guilty of doing anything to Haleigh but that Tommy knows who did what.  That's a lawyer's spin to make his client look less guilty.

If Tommy does know who did what, then Tommy is still guilty by way of accessory after the fact.  By not coming forward and telling police, Tommy made himself guilty even if he didn't do anything to Haleigh.

IMO I believe Tommy IS involved in some way...maybe he didn't kill Haleigh, but he's either involved in the disposal (which seems likely) or at the very least in aiding and abetting whoever did by keeping the information to himself and not telling police.

Either way, Tommy's guilty and in for a lot of jail time.  His only saving point would be IF he spilled all the beans and then took a polly about what he spilled and passed the polly 100%.

So I guess we wait for Tommy to tell what happened that night? Or did he tell what happened that night, hence the search of the river?

I don't see any TRIAL date set for Tommy so far.  If he is gonna squeal on those involved in HaLeigh's case, then most likely working out a deal.  But Ron and Misty are due in court on May 13th.

No trial date for Tommy?  That's odd...considering Hope has had her trial and Ron's and Misty's trials are only a couple of weeks away.

Not sure about culpable homicide, but FL has culpable negligence and it can tie into homicide, conspiracy, manslaughter etc.

I have not seen anything about that, but I would guess they would have.

I'm still trying to figure out how Hope is to pay 250,000 dollars? How is that going to happen? I'm not even sure why she was fined that amount of money

That would have to happen I guess, seriously the court must know that fine isn't going to be paid, I wouldn't think her mother would have to

Hope's words to her mother do concern me.

Playing the devil's advocate ... could Hope have been set up as an example to motivate a plea deal from Ron, Misty and Tommy in regards to the Haleigh Cummings case?

Why was Ron Cummings present in that court room?

It does not make sense to me.

Croslin`s Drug Co-Defendant Sentenced to 15 Years
Aired April 27, 2010 - 20:00:00   ET

(BEGIN VIDEO CLIP)

KATRINA BELCHER, HOPE`S MOTHER: I just wanted to make sure you understood what was going on, and that ain`t good because you pled no contest, and you don`t know what you`re pleading to. Now, from what I understood, I thought the one charge got dismissed if you took the trafficking charge.

HOPE SYKES, RONALD CUMMINGS` COUSIN: No, Mom. I have two charges still.

BELCHER: That`s not the way she explained it to me, but I`ll ask her again.

SYKES: What are you talking about? Like, I sat there and said no contest? I didn`t plead no contest. She pled no contest.

I wonder if Hopes fines are so high because they were near a school zone?

Hardly think that Katrina would even be able to afford a 1/2 share in a free lunch.  Remember Mr. Dotson that posted here...how much Katrina owed him and others and good luck trying to get paid back...were his words.

Oh,... Tommy IMO is involved.   Definately jail time.   His attorney can say all he wants.   Just look at Baez in the Anthiny case.   "She is innocent"  Gee...

I think this attorney for Tommy is doing the same thing.   He is hired by Tommy to prtect his rights and speak on his behalf.  Truth or Lie.  Attorneys can lie with choice of words.
