Judge orders Capone remain in custody
Rob Kauder | Internet Content Manager, KXLY.com
Posted: 5:02 pm PDT May 10, 2010

COEUR D'ALENE -- A Monday afternoon court hearing for Charles Capone on a weapons charge painted a very disturbing picture of a man who has been prone to violent threats against women in the past.

Capone was arrested recently on an ATF charge for being a felon in possession of a firearm. At the same time his estranged wife, Rachael Anderson, has been missing for several weeks. The couple separated in early January after an incident where Anderson said that Capone strangled her.

During Monday’s court hearing it was revealed that Capone has had a history of violence against women. In 1997 he reportedly threatened a Moscow, Idaho doctor, telling her that he would break into her home, rape her and her daughter and then kill himself. Capone also has an ex-wife in Florida and in 2006 he reportedly stood over her with a screwdriver and threatened to kill her.

Members of Anderson’s family, who were in court Monday for the detention hearing, say they’re relieved that Capone is being kept in jail and were not surprised by the revelations of his history of violence and threats of violence against women.

Rachael Anderson had told family members – and the Clarkston Police Department – in the days and weeks prior to her disappearance that she feared for her life. She said that she was being stalked, her tires on her vehicle were slashed and she had been receiving prank calls, all incidents she reported to the police.

Not long after family members reported her missing investigators found her cellphone and vehicle. She was last seen in Moscow on April 16th.

It was also revealed that Capone, a three-time convicted felon, has an outstanding warrant for unpaid child support out of Arizona.

A federal judge ordered during Monday’s detention hearing that Capone be kept in custody on the firearms charge.

Updates In Case Of Missing Mom, Estranged Husband Arrested
May 14, 2010

Washington (ChattahBox) – Police are looking into new leads in the case of Rachel Anderson, a forty-year-old mother of three who went missing in April.

Rachel has been missing since April 16, and she had been reporting strange messages and texts that said she was being watched. She went to police several times, fearing for her safety.

Now, police have arrested her former husband, Charles Capone, for unrelated charges as they investigate his possible involvement in her disappearance.

According to authorities, Capone is a violent man and former convict who has a long rap sheet of violent offenses.

It is believed that he was abusive to Rachel in the past, and that before the end of their marriage recently, he attempted to isolate her from her family and threatened her.

Her daughter believes Capone may have been somehow involved in the text messages, and she fears that he was behind the apparent abduction of her mother.

He has not been named an official suspect yet, but he is being held for illegal possessing firearms, and several other minor charges related to parole violations.

Because he has two fugitive warrants, failure to appear in court, and a connection to a missing victim, they are seeking to hold him without bail as a flight risk.

He is being called a ‘person of interest’, and court documents show that during the January divorce filing, Rachel claims Capone beat and strangled her, along other abuses.

They were married just three months.

Missing woman's husband served time for assault

The husband of a woman missing since April threatened a different woman more than a decade ago and served time in prison for that incident, according to court records
May 12, 2010

LEWISTON, Idaho —

The husband of a woman missing since April threatened a different woman more than a decade ago and served time in prison for that incident, according to court records.

Charles A. Capone, 48, has been in federal custody in Bonner County, awaiting hearings on charges of being a felon in possession of a firearm. The Moscow resident was ordered held without bail Monday after a hearing in U.S. District Court in Coeur d'Alene.

His estranged wife, Rachael Anderson, has been missing since April 16. Anderson, a Clarkston, Wash., resident, petitioned for divorce in January after alleging Capone strangled and shoved her.

Capone served time in an Idaho prison after a felony burglary and aggravated assault conviction stemming from a 1997 incident where a woman accused him of threatening her with a knife.

In the 1997 incident in Latah County, court records show Capone broke into the woman's bedroom, the Lewiston Tribune reported.

She said she awoke to find Capone standing over her with either a knife or screwdriver in his hand, according to an affidavit of probable cause.

The woman attempted to dial 911 before he told her, "Do not touch the phone, don't move," according to the documents.

He eventually left the home, but the affidavit says Capone later told an employee of a motel where he was staying in Moscow that he "blew it."

"I should have just gotten over with it and killed her with all the trouble she has caused," Capone told the motel employee, according to the affidavit.

The Tribune reports he was discharged from probation in 2007 by the Department of Correction.

According to state court files, Capone's criminal record includes the 1997 assault, in which he was sentenced to serve at least three years in prison, a $271 fine and six days in jail in 2004 for unlawful possession of wildlife, a drunken driving conviction in 1993, and failure to pay child support.

During Monday's federal court hearing, prosecutors also detailed Capone's convictions for bank larceny, aggravated assault, criminal mischief, vehicle burglary, trespassing, theft and possession of a controlled substance.

Capone enters plea on firearms charge

Posted: 4:57 pm PDT May 27, 2010

COEUR D'ALENE -- Charles Capone, the estranged husband of a missing Clarkston woman, was arraigned in federal court Thursday afternoon in Coeur d'Alene.

Detectives arrested Capone when they found firearms in his possession while searching for the convicted felon’s missing wife Rachael Anderson.

He pled not guilty to two counts of felony firearms possession. The Moscow, Idaho business owner was arrested on May 6th after detectives found that Capone had a handgun in his possession, a violation of his probation.

Capone was the last person to see his estranged wife Rachael Anderson alive when the Clarkston woman disappeared on April 16th. No one has seen her since.

Investigators have been searching for his wife and this week said they have several persons of interest in Anderson's case but declined to elaborate.

Capone will remain in jail until his jury trial which is scheduled for July 6th.

Capone arraigned on federal gun charges, trial set for July
May 28, 2010

Charles Capone.

COEUR D'ALENE - Charles Capone, 48, of Moscow, who was indicted last week by a federal grand jury sitting in Coeur d’Alene on two counts of unlawful possession of a firearm, was arraigned Thursday and a jury trial was set for July 6 in Coeur d’Alene before U.S. District Judge Edward J. Lodge.

The U.S. Attorney's Office says Capone will remain in custody until trial.

Capone is accused of possessing a Glock .40 pistol, a Remington .270 rifle and a Mossberg 12 gauge shotgun, after being convicted of crimes punishable by imprisonment exceeding one year; specifically, aggravated assault and burglary in 1998 in Latah County and bank larceny in 1997.

The case was investigated by the Bureau of Alcohol, Tobacco, Firearms and Explosives, and is prosecuted as part of Idaho’s Project Safe Neighborhoods Program, which seeks to reduce gun violence in Idaho.

An indictment is a means of charging a person with criminal activity.

Capone is named in federal court documents as a person of interest in the disappearance of Rachael Anderson, a Clarkston woman missing since April 16. Investigators say Capone is the last person who reported seeing Anderson.

Investigators: video shows Rachael Anderson apparently did not get on bus

Story Updated: Jun 9, 2010 at 8:31 AM PDT
By Stephanie Smith  Watch the video

CLARKSTON - Lewiston Police say they have reviewed over 24 hours of surveillance video from the bus stop in North Lewiston where they discovered the SUV missing Clarkston woman Rachael Anderson was last seen driving.

Asotin County Sheriff's Office Captain Dan Hally, an investigator working with the task force dedicated to the case, said that to their knowledge, Anderson did not get on a bus.

The GMC Yukon Anderson was last known to be driving was found on April 21st. She has been missing since April 16th.

Hally said the task force is actively working on the case and following up on tips. He said a tip last week led them to search the Clearwater River with the help of the Nez Perce County Sheriff's Office Dive team after a boater spotted something on his fish finder.

It turned out to be wood debris.

Hally said he hopes the public continues to keep the case in mind and call 509-758-2331 if you've seen something suspicious or have any information.

What Happened to Rachael Anderson?
Posted: Jun 23, 2010 12:48 PM EDT
Updated: Jun 23, 2010 5:40 PM EDT

LEWISTON, Idaho (AP) - Detectives say the pace of tips about the whereabouts of a missing woman last seen in April has slowed.

Meanwhile, Rachael Anderson's estranged husband  the last known person to see her  remains in an Idaho jail awaiting separate federal weapons charges.

Anderson has been missing since April 16. Early this year, the Clarkston, Wash., resident petitioned for divorce after alleging her husband, Charles A. Capone, strangled and shoved her.

The tips are still coming in, but "it's obviously a lot slower than it was to begin with," says Clarkston Police Detective Dan Combs.

Amber Griswold, Anderson's oldest daughter, says waiting for word of her mother has been difficult for the family. Anderson's birthday earlier this month was especially tough.

Missing Clarkston Woman's Estranged Husband Pleads Guilty

Charles Capone Pleads Guilty
1:29

COEUR D'ALENE, Idaho - Charles Capone, the estranged husband of missing Clarkston, WA woman Rachael Anderson, has changed his plea to guilty for Unlawful Possession of a Firearm.  Sentencing is set for September 27th.

Capone initially faced two federal firearms charges and pleaded innocent, but that changed Tuesday in U.S. District Court when Capone pleaded guilty to one of the charges as part of an agreement with prosecutors.

Authorities say Capone told a friend he carried a gun while following his wife in February to determine whether she was seeing someone else. He was arrested on the gun charges in May. Capone is the last known person to see his wife, 41-year-old Rachael Anderson, in April before she disappeared. He has not been charged in his wife's disappearance, nor named a suspect.

Detective is leaving no stone unturned: Jackie Nichols says search for Clarkston woman, missing since April 16, won't end until case is resolved
July 31, 2010

Source: Lewiston Morning Tribune, Idaho)By Kerri Sandaine, The Lewiston Morning Tribune, Idaho
July 31--Asotin County Sheriff's Detective Jackie Nichols is determined to find Rachael Anderson.

She scours wheat fields, wells and abandoned buildings on the Palouse, looking for clues that will lead her to the missing Clarkston woman who vanished more than three months ago.

"I'm going to keep looking and looking," Nichols said Friday as she searched an old homestead in rural Whitman County. "If I was a family member, I'd want someone to keep looking. More than anything, I want to resolve this for the family."

Anderson's four kids are in limbo, wondering what happened to their 41-year-old mother. Until she's found, there will be no closure.

That's why this case is never far from Nichols' mind. She and other law enforcement officers have spent countless hours piecing together what happened on April 16, the last time Anderson was seen.

The petite, dark-haired woman headed to Moscow on that rainy Friday night, driving a borrowed white GMC Yukon that was later found in North Lewiston. The last person who reportedly saw her was Charles Capone, a Moscow mechanic she was in the process of divorcing.

Police have named Capone as a person of interest in the case, but no charges have been filed in connection with Anderson's disappearance. Capone is in jail in Bonner County awaiting sentencing on a federal weapons violation charge. Officials said he hasn't been talking to the Rachael Anderson Missing Person Task Force since his attorneys got involved.

Several members of the task force gathered in Colton Friday morning to begin the latest search for the missing woman. Nichols divided the group into four teams and handed out notebooks with color-coded maps and a list of questions to ask residents in the area, along with photos of Anderson and vehicle descriptions.

After a briefing, the teams headed toward Johnson, a small farming community best known for its annual Fourth of July parade.

"The reason we're searching here is we had a witness who saw a white SUV come out of this area about 4 a.m. on April 17 and turn on to Highway 195," Nichols said. "The witness was going to work and noticed the white vehicle because it didn't stop at a stop sign."

Nichols knocked on the doors of farmhouses, and asked occupants if they saw anything suspicious or unusual around the time of Anderson's disappearance. She asked if they noticed any fresh digging, tire tracks or burn marks. She inquired about abandoned silos, root cellars, ponds or old garbage dumps in the area.

"We're looking for any evidence or information we can find," Nichols said.
"We're looking for places a body could be concealed."
The caravan of unmarked vehicles left a trail of dust on this hot, July morning. In addition to Nichols, who works for the Asotin County Sheriff's Office, participants included four special agents from the Bureau of Alcohol, Tobacco, Firearms and Explosives, Detective James Fry of the Moscow Police Department, Detective Tim Besst of the Latah County Sheriff's Office and two cadaver dogs and their handlers, Ronda Bowser and Doug Huffman of the Clearwater County Sheriff's Search and Rescue dog team.

Word of the search spread quickly among neighbors in the bucolic setting. "Everyone knows we're here," said Darrell Bone, an ATF special agent. "We're rolling up to houses and people are saying, 'I was wondering when you'd get here.' "

After receiving a command, the cadaver dogs jumped out of a pickup truck and headed to a well at the first stop. Pandora and Kanobi didn't show any indication there was a body in the area, which turned out to be a time-saver for the searchers. Lifting the heavy lid off the well would've required pry bars and lots of manpower. A nearby pond also came up empty.

But the ATF agents are confident Anderson will be found and the case will be solved.

"The truth always comes out," said Lance Hart, who has been involved with high-profile cases. He arrested Randy Weaver at Ruby Ridge.

Nichols is also optimistic about finding the Clarkston woman. After hiking through a field to a cistern, the energetic detective was eager to check out another tip from the property owners. There's an old well up the road that could yield some clues.

At the site, the dogs were released, but no scent was found. Phil Druffel, a 73-year-old farmer, stopped by to offer some suggestions. A lifelong resident of the area, he spoke of an old slaughterhouse, a barn and other places that may be of interest. "You're in my prayers," Druffel said as the search continued.

As the mercury climbed, Huffman and Bowser took good care of their dogs, giving them water and rewards for their hard work. Both volunteers, they are part of a larger search-and-rescue group based in the Orofino area. "It is one of the best search-and-rescue groups in the state," Huffman said. "And I can say with confidence we have one of the best dog teams in the state."

The dogs are trained to search for the living and the dead. They have located several drowning victims in the region, along with lost hunters and children. Pandora and Bowser recently found a 12-year-old boy with Down syndrome who was missing on top of a mountain in Clearwater County. The boy was safely returned to his family.

"I train four or five days a week to keep Pandora at the level and standard I expect," said Bowser, who is a manager at Hayes Food and Ace Hardware in Orofino.

"It puts a little adventure in our lives," added Huffman, a farmer in the Cavendish area.
It's an interesting hobby."
The dogs got back to work at an algae-covered pond with easy access from a main road. "This would be a great place to conceal a body," said Nichols as she walked around the murky green water ringed with neck-high cattails.

No body or clues were found at the site, but the searchers got another tip from one of the other teams in the area. The caravan headed to the last stop of the day, an old farmhouse at the end of a dirt road filled with ruts. Surrounded by apple trees, the setting is remote and eerie, even in daylight. The cadaver dogs circled the premises, but didn't get any hits.

Nichols was not discouraged. "I really appreciate the fact Sheriff (Ken) Bancroft allows me to dedicate time to this case. I feel good about today's search. We got the information out and it will keep this case in people's minds when they're out working in these fields."

"I don't think people realize it's really hard to hide a body," added Todd Smith, an ATF agent. "They don't stay hidden forever."

Anyone who has information or tips to offer can call Nichols or Capt. Dan Hally of the Asotin County Sheriff's Office at (509) 758-2331.

Sandaine may be contacted at kerris@lmtribune.com or (208) 848-2264.

Authorities search for SE Washington woman
August 2, 2010

LEWISTON, Idaho -- Authorities continue to scour the Palouse region in hopes of discovering what happened to a missing southeastern Washington woman whose estranged husband was jailed on separate weapons charges.

Rachael Anderson, 41, of Clarkston, Wash., was last seen April 16 by Charles A. Capone, the Moscow, Idaho, man she was in the process of divorcing.

Late last week, members of a task force gathered near Colton, Wash., driving from farmhouse to farmhouse with search dogs. There's a report that a white SUV - similar to the one Anderson was driving - was seen driving along Colton's rural roads about the time she disappeared.

"I'm going to keep looking and looking," Asotin County sheriff's Detective Jackie Nichols told the Moscow-Pullman Daily News as she searched an old homestead in rural Whitman County.

"If I was a family member, I'd want someone to keep looking," Nichols said. "More than anything, I want to resolve this for the family."

Charles Capone, 48, has pleaded guilty in federal court to unlawful possession of a firearm. Authorities said he hasn't provided many details about his wife since his lawyers became involved.

He's considered a person of interest in her disappearance.

Anderson filed for divorce in January after she said Capone choked and shoved her; according to court documents, Capone told a friend he carried a gun while following his wife in February to determine whether she was seeing someone else.

In addition, Capone served time in an Idaho prison after a felony burglary and aggravated assault conviction stemming from a 1997 incident where a woman accused him of threatening her with a knife. In that incident in Latah County, court records say Capone broke into the woman's bedroom.

Last Friday, the caravan of unmarked vehicles that carried special agents from the Bureau of Alcohol, Tobacco, Firearms and Explosives, the Moscow Police Department, the Latah County sheriff's office and two cadaver dogs left a trail of dust as they drove southeastern Washington's back roads.

Nichols knocked on the doors of farmhouses, asking residents if they'd seen anything suspicious around the time of Anderson's disappearance. She asked if they noticed any fresh digging, tire tracks or burn marks and inquired about abandoned silos, root cellars, ponds or old garbage dumps.

"We're looking for any evidence or information we can find," she said. "We're looking for places a body could be concealed."

Late last week members of a task force gathered near Colton, Washington and drove from farmhouse to farmhouse with search dogs. There's a report that a white SUV, similar to the one Anderson was driving, was seen driving along Colton's rural roads about the time she disappeared.

Capone has pleaded guilty to unlawful possession of a firearm. Authorities say he hasn't provided many details about his wife since his lawyers became involved.

CLARKSTON - Detectives with the Rachael Anderson Task Force said they do not have evidence at this time that Anderson is deceased. And the search continues for the missing Clarkston woman.
Anderson was last seen in Moscow on April 16.

Last Friday members of the task force searched the area surrounding the town of Johnson south of Pullman.

"We have been looking at that area because there had been a witness that called in and had seen a white SUV in that area around the time that Rachael Anderson disappeared and she was last seen driving a white SUV, so it was a lead we wanted to follow up on," said Asotin County Sheriff's Detective Jackie Nichols.

The team knocked on doors asking if anyone had seen anything suspicious.

"A lot of people gave us some good information for some places to search," said Nichols. "We had a cadaver dog team with us and there are a lot of old abandoned farm houses, old wells, ponds, things like that, that the local residents told us about and we were able to go and search those and were able to cover a lot of area in a pretty timely fashion between having a lot of people there and having the search dogs with us."

Detective Jackie Nichols said the cadaver dogs did not indicate that they picked up any scents. And she said just because they were using the dogs does not mean they are assuming Anderson is no longer alive.

"We are looking for any evidence that we can find," said Nichols. "When we are out in fields and we see things like ponds and old wells we would not be looking for a live person in those things, so we utilize the cadaver dog in those areas. But we are really looking for any evidence or information that will lead us to where Rachael Anderson may be."

Nichols said they are still waiting on complete results from the crime lab for tests done on the white SUV Anderson was reportedly driving before she disappeared and that was later found in North Lewiston.

If you have a tip relating to Rachael Anderson's disappearance call police at (509) 758 -2331.

Detectives search Colton area for Rachael Anderson
Daughters fear Rachael Anderson dead
August 2, 2010
POKANE -- Acting on a tip, detectives investigating the disappearance of Clarkston resident Rachael Anderson spent several hours Friday canvassing homes and searching fields near Colton for Anderson.

Rachael Anderson's daughters fear their mother is dead.

“I didn't want her life to end so short,” Amber Griswold said.

Detectives say they don't have evidence backing up those fears but they confirmed officers went door-to-door talking to residents along Johnston Cutoff Road near Colton in Whitman County searching for information regarding the whereabouts of Anderson.

Detectives confirmed that they have some forensic evidence at the crime lab but won't confirm the nature of that evidence. Authorities are confident they are going to find Anderson based on the evidence they have recovered.

“There is some evidence and some things we haven't come forward with yet so it’s not just like she disappeared without a trace,” Detective Nichols said.

Detectives also confirmed Monday morning that Charles Capone, Anderson's estranged husband, is a person of interest in her disappearance.
