Casey Anthony case: Death-penalty issues will be argued today
Orange-Osceola Chief Judge Belvin Perry is expected to hear defense arguments against the death penalty and other issues during today's hearing. Check back for live video at 2 p.m.

Casey Anthony's defense team will return to court this afternoon to argue several motions, including another battle about death-penalty issues.

The State Attorney's Office wants to execute Anthony if she is found guilty of killing her daughter.

Orange-Osceola Chief Judge Belvin Perry is also expected to hear other defense arguments, including her legal team's request to seal records showing who visits Anthony at the Orange County Jail.

Her team also wants more information about forensic evidence obtained so far.

The 24-year-old is charged with first-degree murder in the death of her daughter, Caylee Marie.

The toddler's remains were found in December 2008 — six months after her mother claims she last saw her alive.

A meter reader found the 2-year-old's remains in woods less than a mile from the Anthony family home.

Perry also will hear arguments on other issues, including access to grand-jury testimony by Anthony's father, George Anthony. The hearing starts at 2 p.m.

Am looking forward to court tomorrow and the the no nonsense approach that this judge has taken.  I will be happy to be one step closer to Justice For Caylee.  Hope there will be a full cage in the am.  We need to see this case move forward  and give peace to our Caylee!

Good Morning Monks!!  akmom, I too am looking forward to the hearing....but I fear JP is going to rule in the duhfence's favor and cut off release of kc's visitation and commissary accounts. I hope some of the media attorneys will be able to sway him to rule against them.....got my fingers crossed, but don't hold a lot of hope

Judge To Reconsider Death Penalty In Anthony Case
Casey Anthony Charged With Murder In Death Of Daughter

ORLANDO, Fla. -- Casey Anthony's defense will have several motions reconsidered by Judge Belvin Perry, including whether or not the death penalty is appropriate in this case.

Judge Belvin Perry will reconsider four different motions Tuesday afternoon, including a request made by Anthony's defense team to throw out the death penalty.

Anthony, 24, is jailed on first-degree murder charges in the death of her daughter, Caylee, whose remains were found in a wooded lot in December 2008. Caylee was 2 years old when she was reported missing in July 2008.

Last month, the prosecution revealed the reasons they say Anthony should be put to death if she's convicted, including that the murder was committed during another crime -- aggravated child abuse. The state will also argue Caylee's murder was especially heinous or cruel.

Meanwhile, Anthony's defense team wanted the state to turn over forensic documents, including results on tests performed on evidence, but the state told the judge they didn't have the results. Other motions that will be addressed Tuesday include the use of certain forensic evidence.
Court officials told Local 6 the defense team is also asking the court to seal jail visitation logs.

Anthony has pleaded not guilty, claiming that she left Caylee with a baby sitter and the two were gone when she returned to pick up her daughter.

Tuesday's hearing is scheduled to start at 2 p.m. at the Orange County Courthouse and it will be streamed live on ClickOrlando.com.

Casey Anthony is set to return to court Tuesday afternoon.
The accused child killer's attorneys are trying again to get the death penalty off the table.

This time they say the state hasn't done a good enough job of explaining why they're seeking the death penalty. Jose Baez maintains that these death penalty motions aren't being filed just to help their case in the event of an appeal.

"Obviously, it protects the record, and that's an aspect of things," he said. "But every motion is done because we feel that it's a legitimate motion and an legitimate issue."

At the last hearing, Casey's lawyers asked for the state to tell them why they were seeking the death penalty.

"We should be told what we're charged with, and what we're facing, and what exactly the aggravating factors are and how they plan to prove it," said Andrea Lyon.

Judge Belvin Perry granted their request, and the state gave them a list of reasons for going after capital punishment. But now the defense says that list wasn't specific enough, so Baez and the rest of Casey's legal team are going before Perry again to ask that the death penalty be thrown out.

"Obviously, the death penalty in our position doesn't work," said Baez.

Casey's attorneys are also asking Perry to reconsider four rulings made by the previous judge on the case. He will also hear a defense motion on forensic evidence and their request that Casey's jail visitation log be made private.
