You're welcome, melisb!  Another monkey first posted it in Kyron's thread, and I am grateful, just wish I could remember who!  Did the same as you, read all that blog, and also agree with what she's posted.  Would love to hear more of her thoughts re HaLeigh, Kyron, and others whose cases seem to have gone cold.

Croslin to be sentenced Monday on multiple drug counts

If Misty Croslin has anymore secrets to tell regarding the disappearance of Haleigh Cummings, she will have one last chance Monday before she is sentenced on multiple counts of dealing prescription drugs in Putnam County.

Croslin, 19, was living with Haleigh's father, Ronald Cummings, and was in the house with the girl when she disappeared in 2009. That case has never been solved.

In the meantime, Croslin, Cummings and several others were arrested in January 2010 on multiple counts of trafficking prescription drugs.

All have been sentenced, including Croslin on one count in St. Johns County. But on Monday she faces sentencing in Putnam County on seven counts.

Putnam County investigators would talk to Croslin if she has anything more to say about the Haleigh case, said Capt. Johnny Greenwood.

"We'll meet with her if she reaches out and wants to talk about the case. We'd definitely talk to her. We'd talk to anyone," Greenwood said.

Croslin is currently in the Lowell Correctional Institution, a state women's prison in Marion County, serving the 25-year St. Johns County sentence.

Her grandmother, Flora Hollars, said she talks frequently with Croslin on the phone. Hollars said Croslin is trying to make the best of the situation.

"She's doing real good. She's going to school and making As," Hollars said. "I question her every time she calls me to see what I can get, and I haven't gotten anything to report yet."

Haleigh was reported missing from her Satsuma home at about 3:30 a.m. Feb. 10, 2009. Croslin initially said she was asleep with Haleigh, then age 5, and Ronald Cummings Jr., then age 2. Croslin awoke to find Haleigh missing.

That story changed last summer while Croslin and her brother, Hank "Tommy" Croslin Jr., were jailed on the drug charges.

Both Croslins implicated a cousin from Tennessee, Joe Overstreet, with an attack on Haleigh. Tommy Croslin contends Overstreet then disposed of her body in the St. Johns River off a boat ramp between Satsuma and Welaka.

A three-day search of the St. Johns in the vicinity of the ramp failed to find any evidence of her body. Overstreet has denied the allegations.

When Croslin was sentenced in St. Johns County in October, her attorney, Robert Fields, argued that Croslin should be sentenced as a youthful offender.

That would have landed her a six-year sentence rather than the minimum mandatory of 25 years for the amount of oxycodone involved in the charge.

Fields also called Croslin's mother, Lisa, to testify about the difficult upbringing and poor education of Croslin.

Fields did not return phone messages from The Sun last week.

Greenwood said new leads in the Haleigh case are scarce, but he added investigators follow every bit of information they get. He would not say if detectives have spoken with Croslin since last year, when she told of Overstreet's alleged involvement.

"We're still investigating the case. We get the occasional tip, but we are not getting the steady tips we did initially," Greenwood said. "We always maintain the case will get solved. We have to. When a tip or lead comes in, we follow it to the end."

Steve Brown, a private investigator who worked on the case for Tommy Croslin, said he continues to get information about the case as well.

Just talked to Flo..Misty called her this morning..She is still at Lowell..Says the officers removed her things yesterday..Thought she was leaving last night,because they picked everything..Strange she is still there!!

B. Motion to Correct Sentence

A motion to correct an illegal sentence may be filed at any time. A sentence illegally imposed must be corrected within 120 days. A sentence is illegal when the court goes beyond its authority by acting without jurisdiction or imposing a sentence in excess of the statutory maximum. A sentence illegally imposed commits procedural error and is subject to the 120 day limitation, but an abuse of discretion or unreasonable is not subject to the 120 day limitation.

An illegal sentence is a nullity, thus can be corrected at any time. The court can consider a Fed.R.Crim.P.35(a) motion based on the Defendant’s claims. Successive motions are barred by AEDPA in a section 2255 proceeding. Ineffective assistance of counsel claims can be raised in a motion to correct sentence.

C. Motion to Reduce Sentence

A motion to reduce sentence may be filed up to the 120th day after: (1) the sentence is imposed; (2) probation is revoked; (3) the court receives the mandate on appeal affirming the judgment or dismissing the appeal. The government is entitled to respond even if it agreed as part of a plea agreement not to allocute at sentencing. The court must act on the motion within a reasonable time pursuant to Fed.R.Crim.P. 35(b). Trial judges should treat pro se letters or forms that request sentence modification as Rule 35 motions providing they are timely filed.

There is no Sixth Amendment right to counsel to pursue a motion to reduce sentence in a section 2255 proceeding. Trial judges have the discretion to appoint counsel by motion, or not.

The trial court has no jurisdiction to correct or reduce a sentence during the pendency of an appeal from the “judgment of conviction”. The trial court does have jurisdiction to entertain Rule 35 motions despite the pending appeal. If the trial court indicates willingness to grant the motion, the Court of Appeals will remand the case record to grant the requested relief.

Misty Croslin, the young woman at the center of a missing-girl mystery, is scheduled to be sentenced today on drug-trafficking charges in Putnam County.

Croslin, 19, was babysitting her then-boyfriend's daughter, Haleigh Cummings, when she vanished from their double-wide trailer in the rural Putnam County community of Satsuma in February 2009.

Haleigh, who was 5 when she vanished, has never been found and no one has been charged in her disappearance.

Putnam County officials have ruled her case a homicide and have said Croslin hasn't told everything she knows.

Misty Croslin has already been sentenced to 25 years for drug trafficking charges in St. Johns County.

But on Monday, she is expected to receive more jail time on several counts of dealing prescription drugs in Putnam County.

Croslin, 19, was the last person to see her former stepdaughter, Haleigh Cummings, alive in 2009.

Haleigh was 5 when she disappeared from her Satsuma home in the middle of the night.

Croslin, who was watching her then-boyfriend's daughter at the time, initially told authorities she was asleep with Haleigh, and woke up to find her gone.

She changed her story in the summer of 2010, when she implicated a cousin from Tennessee.

That cousin was never charged or named a suspect in Haleigh's disappearance.

The drug charges against Croslin and Haleigh's father, Ron Cummings, are not related to the Haleigh's disappearance.

Ron Cummings pleaded guilty in September to drug trafficking. He was sentenced to 15 years in prison.

Haleigh has been presumed dead. No sign of the girl has ever surfaced, despite numerous searches in and around Putnam County.
