Orange-Osceola Chief Judge Belvin Perry just released an order that will allow state prisoner inmate phone calls made to Casey Anthony attorney Jose Baez in May to become part of the public record.

Baez had wanted a protective order placed on the conversation he had with state inmate Robin Lunceford, arguing that it amounted to an illegal recording because he said he was unaware their conversation was being recorded. He also argued that the conversations in the two phone calls amounted to work product – and therefore should not be public.

Lunceford had contacted Baez to talk about a conspiracy to make up lies about his client, according to Baez.

In Perry's order, he noted that the conversations are not considered work product because "it is inarguable that he did not 'produce' the recordings of the calls at issue; the prison did
"Since the recordings were made by the prison in accordance with its procedures, they constitute public records," Perry wrote in his order.

The order also states that the calls do not reveal Baez's impressions or opinions.

"To the contrary, the calls consist solely of Robin Lunceford's factual allegations regarding her contact with fellow inmate Maya Derkovic…the contents of the recordings do not contain any protected opinion work product of counsel exempt from discovery," the order states.

Baez filed his motion to have the calls sealed after learning that the prosecution would release the contents of the calls as part of discovery.

One call went into Baez's law office and was handled by a staffer. The second call was forwarded from his office on to his cell phone, and that's when he learned of the plot involving his client.

"It has been consistently held by Florida courts that there is no reasonable expectation of privacy in a telephone communication from jail where the inmate is warned that all calls are monitored or recorded," Perry's order states."This principle is equally applicable to counsel's claim. At the beginning of the call, counsel is warned by an automated message that the call was being placed from a correctional institution and was subject to monitoring and recording."

Perry also noted that Baez had to accept the prison call by pressing "1" on the phone. This action, Perry said, "demonstrated his consent."

Beyond that, Perry wrote, Lunceford warned Baez that the call was subject to recording.

"The court finds that there is simply no reasonable expectation of privacy where counsel is warned by both the automated messaging system and the witness that the calls are monitored and recorded," Perry said in concluding his denial of the protective order request.

Danielle Tavernier, spokeswoman for the Orange-Osceola State Attorney's Office, said the calls will not be released immediately.

"It will not be today," Tavernier said in an e-mail response. "As in the past records become public based on chronological order. At current, the next release of documents will be from supplemental discovery given to the defense on about [July 21]."

ORLANDO, Fla. -- Judge Belvin Perry signed an order Monday morning allowing a recorded phone call between Casey Anthony's defense attorney Jose Baez and an inmate to be made public.

Anthony's defense had asked the judge to grant a motion to keep the call private.

According to Baez, Robin Lunceford admitted she and two other inmates conspired to frame Anthony and tried to be transferred to other prisons in exchange for information about Anthony.

Baez said he did not want the call released because he did not know Lunceford was in prison and the call was being recorded.

Perry reviewed the call last week and denied the motion Monday.

Anthony, who's jailed on first-degree murder charges in the death of her daughter, Caylee, has pleaded not guilty and said a baby sitter kidnapped Caylee. The toddler's remains were found about six months after Anthony said she last saw her daughter alive.

What's great about the dial of the motion to me is not so much that it's going to impact this case at all, but just because Baez was soooo peturbed about it. Petty of me I know but...  Monkey Devil!

The interview is with the Orange County investigators on July 31, 2008.
It is unclear why the interview, now two years old, is being made available at this time.

After a deposition on Friday, the former meter reader who discovered the remains of Caylee Anthony said on Friday he has no regrets, even though he’s being portrayed as a potential murder suspect by the defense team.

Recently, attorney Jose Baez insisted the foreclosure on his Kissimmee home will not affect his defense of Casey Anthony.
