FYI - I know a couple of you have sent me emails and I'm trying to answer/get to them but hotmail is giving me problems again this morning.  Ever since they made an upgrade it's been acting up for me.  I'll answer ASAP.
Klaas, the email I sent you was in regard to the Caylee thread... the thread title has a typo.  "Caylee" is spelled "Carylee."  Sorry for o/t and sorry if it has already been reported....

Back to Kyron.

Thanks Des - I fixed the title for the Caylee thread.  It would be a bunch of work to fix for each post but from now on it will be correct.  Thanks for letting us know about the typo.

Maybe your tech guys can whip out a little find and replace program for ya'.

I could try banning the word Carylee and replacing with Caylee and see if it changes in the subject lines

There is a function when merging threads for changing  each of the titles, but didn't want to try it with this thread.  (Maybe try it later with test thread) Anyway, I've gone back and edited the titles in each post.  MB

Sorry for the O/T but I just have to say........ WOW!!! Klaas? That's why you look like the "thinker monkey" behind those bars!  That's creative, Klaas!!

Muffy? You've been a busy bee making all those corrections! I think most posters understand typos, but that was nice of you to do it!

Can I not email you, but write in here that I did?

That way people would think we have a special relationship, a certain connection, so that they think that if they ever give me a hard time I can seek you on to them?

Very Happy

hahahahahahahaha

No special relationships.  Anyone can email me.  Sometimes I don't even answer  Monkey Devil!  smklaas@hotmail.com

Monkey Devil! AAA HAHAHAHAHA!! Moosee, you're crackin' me up!
Just got up a bit ago(day off, slept in 'til 7!) and catching up...

Your next post...about all Terri's "stuff" she did(lies, sexting, cell phones, etc) by themselves, easily explainable. Put together...they speak volumes and we, in our human nature add it and ,oops, it DON'T(add up)
It brings to mind my sister who (to my knowledge) has never committed a crime, but is very controlling, a pathological liar...more...I love her to death, she would give you the shirt off my back, but can't trust her anymore...it took some therapy and distance(cut off contact for about a year) before I was able to see how much I had been "suckered by her.

I guess my point is that I can see how her "friends" so totally defend her and would do things for her that to most of us would be "what the ???".  Even if you subconscious is trying to send a red flag, the conscious part has been "groomed" to blindly believe and not question  queen"the Queen". I believed all she told me, it wasn't until later I was able to look back and say hey!  wait a second..

IMO, this does not excuse her/their behavior...just a different perspective on motive. I would hope I am not as gullible and naive as I used to be....hard lesson to learn

Come on home Kyron...

Terri Horman makes Portland court appearance
Story Published: Aug 25, 2010 at 3:34 PM PDT
Story Updated: Aug 25, 2010 at 11:54 PM PDT

PORTLAND, Ore. - Terri Horman was back in Portland for a court appearance related to her divorce from Kaine Horman, the father of missing Skyline student Kyron Horman.

Sheriff's deputies gathered at the back door of the courthouse Wednesday afternoon, waiting for the arrival of Kyron's stepmother Terri. She was flanked by her two attorneys - including high-powered defense attorney Stephen Houze - and was escorted into the Multnomah County Courthouse by deputies.

Kaine Horman was not at the courthouse Wednesday. However, his attorney, Laura Rackner, was.

Rackner told KATU they were there for "a scheduling hearing." The hearing concluded around 3:30 p.m. Wednesday.

Terri Horman had no comment for reporters as she entered and left the courthouse but she was still wearing what appeared to be a wedding ring.

In court the two sides talked about three different things:

First, Kaine wants Terri to show where she supposedly got $350,000 to hire Houze.

Second, Terri wants all the legal issues Kaine has filed against her in their divorce postponed for up to two years. Legal experts say her side is trying to keep her out of any situation that would get her under oath.

Third, they talked about the contempt of court case Kaine filed against Terri, claiming she broke a court order by showing the then sealed restraining order to friend Mike Cook.

Each side also laid out their arguments in court documents:

Terri’s divorce attorney, Peter Bunch, claims the divorce can’t go on right now because she’s a “de facto suspect” in the disappearance of her stepson, Kyron.

But Kaine’s side countered, saying Terri is stalling to “avoid possible self-incrimination.”

Kaine’s attorney, Rackner, questioned why Terri’s attorney was asking for two separate hearings: one for the divorce delay and the other to explain where Terri got the money to pay for her defense attorney, Houze.

Kaine would “incur extra fees and costs … miss additional work days” and that money “needed by him to support his family,” Rackner wrote.

But Bunch said Kaine is the one with the “significant income” and “substantial savings” and seems to want to “interfere” with her choice.

In the end the only thing that was decided is the judge will hear arguments on the money and postponement in early October, and the contempt case will be in mid-September.

<snipped>

Investigators have not named Terri Horman a suspect or person of interest in this case, and they have not made any arrests.

Kyron’s biological parents, Desiree Young and Kaine Horman, will hold a news conference Friday at 11 a.m., they said in an e-mail sent to media outlets Wednesday night.

Young and Horman said the topics will include updates on the case, Kyron’s birthday and a fundraiser set for next Wednesday, September 1.

KATU News reporter Anita Kissée contributed to this report.

The question remains as to why Terri Horman came to the hearing. She certainly had the right to do so but said nothing in court, nothing to the media, and her presence, legally, wasn’t necessary

Hi Janet!! My thoughts are that her atty stratigically advised it. He probably thought it was good for her image to show interest by her presence but opening her mouth wasn't such a good thing.

Look at the expressions on everyones face in this picture.  I don't see a happy face in this group and Bunch is giving her a very telling look.  Just not sure what he is thinking.

Hi Ladydog1 and Goodmorning Monkey's,

They do not look confident.

I think they're trying to ignore on-lookers and the one attorney is staring at one of the on-lookers.

Puzzler

The ogle-eyed attorney looks miffed.

Compare the shoulders, is his look is aimed at her or her attorney?

This photo is taken leaving the courtroom?  Surprised This isn't going to their plans, the Judge side with Kaines attorney.

Thats what I'm seeing also but it looks to me like he is looking at Terri at that moment and not very happy.  Is it possible he got drug into this by Houze and didn't realize what the truth was.   Maybe he likes small children.

Lazydog1,

Houze lost the case(yesterday) for the divorce attorney, is how view this picture.  You are observant.

The ogle-eyed, Attorney, is miffed, since, Houze lost "his" case for the day.

Houze isn't doing too good for all the dough SM spent a retainer.   ::MonkeyNoNo::These are my opinions.

In the slideshow here, http://photos.oregonlive.com/oregonian/2010/08/terri_horman_shows_for_divorce_4.html

--  you can see that Terri is wearing what appears to be a gold? platinum? wedding set on her left ring finger.  This is different from the matching black bands she and Kaine usually wore, based on the FB pics we have seen.  Wonder what the appearance of the different ring/rings signify, and why she made this choice for divorce court, no doubt knowing that she would be photographed like crazy at this hearing?

She looks very troubled, IMO.

Also, re: the comment about the use of the word "defense" in the news coverage of this divorce hearing -- Kaine filed for the divorce.  That makes him the plaintiff in the case.  Terri is the defendant in the divorce action.
http://www.theattorneysforum.com/divorce-seperation-annulment/3013-defendants-answer-divorce.html

Praying for Kyron to come home.

Wonder if that's from a previous marriage, worn for Kaine's benefit. Maybe from her first marriage, since James is now living with Tarver and his wife.
Morning everyone.  Scatty, I'd previously noticed the difference in rings too.  It appears Terri had 2 and I could only find pics with Kaine having the black one. (At least it looks black to me).  I believe she wears the gold one when she's dressing up.  IMO anyway.

PORTLAND – Kaine Horman and his estranged wife, Terri Moulton Horman were granted an October 7 divorce hearing Wednesday.

Terri, the last person to see seven-year-old Kyron Horman before he vanished on June 4, had wanted the divorce delayed until after the criminal investigation into his disappearance is completed.

At issue were financial questions and an abatement proposal by Terri's lawyers to speed up the case. But a judge ruled the issues would all be addressed at one joint hearing on October 7. Kaine Horman wants Terri's financial information disclosed on how she was able to pay for a reported $350,000 in attorney fees.

On September 21, a judge will issue a ruling on whether or not Terri was in contempt of court over accusations she unsealed a restraining order earlier in the summer.

I still cannot wrap my head around the fact that Terri is not requesting at least supervised visitation with Kiara! I cannot imagine her Attorneys thinking on this. It makes her look very cold and uncaring. The only thing that I can figure is that it will be part of the slander lawsuit later. "Because of all of the slander, this poor woman was kept from seeing her daughter for months", blah blah blah! NOTHING would keep me from my daughter!

I think it is the same ring she is wearing in this Halloween picture. She wasn't married at the time:

It appears to me that the source of the $350,000 retainer fee issue should be dealt with by the court IMMEDIATELY.  There is a possibility that the money trail could reveal that there is a direct connection to the disappearing of Kyron Horman.

Legal expert,     Bruce McCain, said, "The real victor is the investigators and the prosecutor" referring to yesterdays case

He said nothing happened yesterday, meaning the divorce is still alive.  The video is to the right-side of the link.

Tomorrow's new conference with Desiree & Kaine should be interesting, does anyone know the time?  Thank-you.

I hear you sebastian. I don't think she can request visitation unless she is willing to address the allegations in the FAPA. Not contesting the FAPA is one of the most telling aspects of the case for me. I cannot imagine giving up contact with my dughter without a huge tussle.

Good morning Nicubird!
I guess both Kaine and Terri's lawyers are pretty savie in this case. Now it is making sense why Kaine filed the divorce in the middle of this huge mess. He gets everything that he wants until Terri is ready to talk. If she is guilty, her silence and lack of concern for her daughter and Kyron is so very telling. Yet, there is still an itsy bitsy part of me that thinks she may be innocent. Looking at it from this stand point, I still think her actions make her look guilty as all get out. When you try to incorporate your own thinking into something like this, it really makes no sense at all. Kiara is so young and impressionable. The thought of my being away from my daughter for more than a day at that young age is not something that I could have been a part of. NO WAY NO HOW!

If Terri appeals/contests the terms of the restraining order that denies her contact with her daughter ... the implication may be that in her defence she would incriminate herself in the MFH plot as well as the disappearing of Kyron.

Terri is between a rock and a hard place.  Challenging the restraining order will not result in a reunion between mother and daughter.

Family law attorney Laura Graser, who’s also familiar with criminal appeals, says Kaine has every right as a spouse in a divorce proceeding to legally inquire about Terri’s ability to pay that fee. Legally, they’re still married and by law, their marital assets should be frozen, precluding someone from going out and spending an excessive amount of money on anything, let alone criminal defense.

“It sounds like these folks are sort of regular middle class people that have middle class income, and if in the middle of a divorce proceeding one middle class spouse arrives in a $350,000 or $100,000 expensive , fancy car, the other spouse has the right to inquire because it’s probably a marital asset until the divorce is final,” said Graser. “I don’t mean to suggest that Mr. Houze is like a fancy car. He’s a very fine lawyer and murder investigations are very time consuming to defend. That’s a very large retainer but I don’t find it outside the realm of possible.”

She says what is also at stake are the competing interests of Kaine and Terri, given that he wants a divorce from the woman he believes tried to have him killed and she’s been the focus of investigators looking into Kyron’s disappearance.

“He has a right to proceed with the divorce, and he has a right to get divorced if he wants to be divorced in a relatively expeditious manner,” she said.  “She has a right to not incriminate herself. So there’s a tension there that some judge is going to have to resolve.”

Kaine Horman asks judge to make Terri Moulton Horman move out of his house
Published: Thursday, July 08, 2010, 12:06 PM
Updated: Thursday, July 08, 2010, 6:43 PM

Multnomah County judge today unsealed the petition for the restraining order which Kaine Horman obtained on June 28, two days after investigators informed him that his wife had offered to pay a landscaper to kill him months before his son's disappearance.

"I believe respondent is involved in the disappearance of my son Kyron who has been missing since June 4, 2010. I also recently learned that respondent attempted to hire someone to murder me,'' Kaine Horman wrote in his petition. "The police have provided me with probable cause to believe the above two statements to be true."
