Mother of Girl Who Died Is Charged With Murder
November 10, 2010

The mother of a drugged and malnourished 4-year-old girl who weighed 18 pounds when she died in September has been indicted on murder charges, Brooklyn prosecutors said Tuesday.

The mother, Carlotta Brett-Pierce, 30, has been in jail since Sept. 2, when she called 911 to report that her daughter, Marchella Pierce, was unconscious and unresponsive. A grand jury in October charged her with second-degree assault and unlawful imprisonment, among other charges.

The new charges of two counts of murder in the second degree and one count of manslaughter in the first degree followed a ruling last week by New York’s chief medical examiner that the girl’s death was a homicide. The cause of death was child abuse syndrome with acute drug poisoning, blunt impact injuries, malnutrition and dehydration, the medical examiner’s office said.

The grand jury indictment charged that starting on at least July 12, Ms. Brett-Pierce strapped Marchella to her bed, beat her with household items and deprived her of food and water. Ms. Brett-Pierce also force-fed her daughter over-the-counter antihistamines, the grand jury said.

The grand jury is also looking into other aspects of the girl’s care, including the actions of the city’s Administration for Children’s Services, which had a case file open on the girl but by its own admission might have gone months without checking on her well-being.

Marchella was born with underdeveloped lungs and had spent most of her life in hospitals. She needed the help of a breathing tube when she was sent home in February.

Ms. Brett-Pierce, who according to Administration for Children’s Services officials had a history of drug problems, faces up to 25 years to life in prison if convicted. The girl’s father did not live with the family.

Ms. Brett-Pierce’s next scheduled court appearance is on Nov. 16. It was unclear on Tuesday if she had a lawyer.
