Casey Anthony defense budget challenged by state agency

The state agency funding Casey Anthony's criminal defense is challenging many of the recent requests the defense team has made for certain costs in the case.

Casey Anthony attorneys, Jose Baez and Ann E. Finnell, filed a motion to set a "reasonable budget" for the "penalty phase" of the case.

They've requested costs for: a private investigator not to exceed $5,000; a psychiatrist or psychologist at a "reasonable hourly rate" not to exceed $7,500; costs for copying medical and school records not to exceed $1,000 and an additional 100 hours for a mitigation specialist at a "previously approved rate."

They've also requested travel expenses and lodging for Finnell, not to exceed $4,000; travel expenses for an investigator or mitigation specialist to go to Ohio with lodging and expenses not to exceed $1,500; and travel expenses and lodging for Finnell from Jacksonville to Orlando at approved rates if the case goes to trial.

The Justice Administrative Commission is authorized to pay "due process" costs in the case. The JAC recently filed a 9-page response, challenging
many of the defense team's specific requests.
It argues at length, for example, that Casey Anthony's lead counsel, Baez, should pay for Finnell's travel and lodging expenses.

Casey Anthony, 24, is charged with first-degree murder in the death of her 2-year-old daughter Caylee Marie. Her trial is expected to start in May. She faces the death penalty if convicted. Mitigation is a big part of the defense preparation in such capital cases.

Here's a breakdown of the JAC challenges for the requested costs:

•As for the $5,000 in investigative services, the JAC argues the defense "has the burden to show how the requested investigator is necessary to the defense of the case and how the failure to provide such service would prejudice the defense."

The JAC response also says the rates for investigators cannot exceed $40 per hour.

•As for the up to $7,500 for a psychiatrist or psychologist, the JAC response states "counsel needs to file a separate motion delineating the particularized need for the expert." The JAC objects to any out-of-state psychiatrist or psychologist and wants to be heard before the court authorizes any experts.

It also objects to any rate for experts outside established rates. For instance, psychological evaluations have a flat per-exam maximum rate of $350.

•The JAC does not object to paying "reasonable costs" for copying medical and school records, according to the response. But the defense will need to provide proof of payment of those costs before JAC will reimburse them.

•As for the additional 100 hours for the mitigation specialist, the JAC notes the court previously approved a "cap" of 384 hours for mitigation specialist Jeanene Barrett.

It is unclear whether that cap has been reached at this time," states the response from JAC Assistant General Counsel Bradley Bischoff.

The rate for such work is $40 per hour and the response states the court "must determine that the additional hours sought are reasonable and necessary for the defense of the case."

•As for Finnell's travel expenses and lodging, the response says, "JAC objects to reimbursement of travel expenses for any attorney in this case inasmuch as lead counsel is privately retained. Such travel expenses are overhead expenses that should be paid for through counsel's fee."

It goes on to say "the state should not bear the responsibility to cover travel expenses for a privately retained attorney who chooses to use the services of yet another attorney"

The response adds that although Finnell may not be charging Casey Anthony for her services "this is not a pro bono case; it is an indigent for costs case, where lead counsel has received a fee of $89,454.3."

Under JAC policies and procedures, the JAC would pay for attorney travel if the defendant was represented by one "pro bono attorney," but JAC "objects to paying for attorney travel where the defendant has retained privately paid counsel."

Later in the response, the JAC attorney argues, "Here the lead counsel has received compensation from a source other than JAC. Those funds should be used to cover the overhead expenses, including any attorney travel."

If travel is reimbursable, the JAC argues the defense "has the burden to show that any travel is necessary for the defense of the case."

As for the Ohio lodging and expenses for the investigator or mitigation specialist, the JAC argues the defense "has the burden to show how the requested travel is necessary to the defense of the case and how the failure to provide such travel would prejudice the defense."

The response cites the court's May 12 order, which says "out-of-state interviews and depositions shall be done through the use of video conferencing equipment available at the Orange County Courthouse."

It also objects to Finnell's travel and lodging expenses between Jacksonville and Orlando.

The response asks the court to set a hearing on the various expenses requested by the defense.

WONDERFUL!!!  I hope JP denies everything based on JAC's response!!!  It's time to stop the money madness on BOZO's part.  I wonder how many other indigent defendant's gets this kind of treatment even if it is a death case???  My bet would be few to NONE!!

Casey Anthony's Driver's License Suspended
Suspension Comes From Outstanding Court Fees, Fines

ORANGE COUNTY, Fla. -- Casey Anthony’s driver’s license has officially been suspended for non-payment fines.

According to court records, Anthony owes $381 as a result of her guilty plea in January to theft charges. A court sent the amount this week again to a collection agency.

The county often suspends driver’s licenses of those who don’t pay court costs and fines.

For the past two years, Anthony has been jailed without bond on charges of murdering her daughter, Caylee Anthony.

It looks like Casey runs the show.  Her history shows she likes to be in control.  She has Baez because she can control him.  I can't see it any other way.

In the more than two years that Anthony has remained incarcerated, Florida public records laws have meant open access to information such as her jail account balance, what she orders from the Orange County Jail commissary and who has visited her. Recordings of phone calls and video of visits have also been available.
Anthony’s defense has filed a motion asking for Judge Belvin Perry to reconsider its defense to seal that information because of a new ruling.

A judge in south Florida ruled that the information is not necessarily public record.

Orlando defense attorney Richard Hornsby, who is not affiliated with the Anthony case, said the ruling could set key precedent for Anthony’s team.

“The law is clear -- the jail cannot just release this information to the public. It's going to have to be filtered through the state attorney's office or the court,” Hornsby said.

The ruling also raises questions as to whether Anthony’s parents, George and Cindy Anthony, can now visit their daughter in jail without a record of their conversation being released soon after.

A corrections spokesman said on Monday that his office had been informed of the south Florida decision and will follow existing statutes and case decisions.

If the people are paying for her defense, the people should be allowed to see what is going on, maybe not her underwear, but definitely her visitors, records, and conversations.  If a specialist is supposed to see Casey and then does not, or hardly visits at all, how will the people footing the bill know if they are getting their money's worth?

The people of Florida should not have to write a blank check, they should know what they are paying for.

Am I infering right?? did the jail say more or less that they have to follow rules so no to bozo and mason???

Thank you for posting this.  We have not looked at Casey's Cupid.com profile in a long time.  I think she created this profile in Mid-May... right?  About one month prior to Caylee's death.  Interesting how the profile focuses so much on proclaiming love for Caylee and the joys of motherhood.  This could actually go to premeditation.  Maybe?  Setting up this record ahead of time to refute the truth, which was that she needed to get rid of the child who was cramping her style and causing her trouble with her mom?  Knowing what we've learned about Casey since July 2008, the effort to project a certain image on this profile almost seems like a "protesteth too much" kinda thing, IMO.

No it isn't.  The duhfense is trying to use a recent ruling in a case that is not similar to Casey's, and the Sunshine Law seems to hold sway in most cases.  They are attempting to use the recent decision as a precedent.  The law is NOT clear.  That is the whole point, IMO.  We'll have to wait and see what happens.

Des~ that's the first thought that came into my mind also. But ya know even if she was a model mom(which she wasn't) it doesn't change the fact that in a deliberate moment she chose to rid herself of the burden Caylee had become in regards to her single, free wheelin lifestyle and most importantly, her pipe dream about TonyL. She had by then reinvented herself as a student,career womansetting her cap on snagging a guy that wasn't ready for a family.
Think Susan Smith, she had been a fairly good single mom but the desire to be single without kids to appeal to her love interest, she heinously killed her boys.

Bearly, I don't think Baez even knows what the show is going to be. Casey may think she's in control but how can she even be aware of the whole new direction JB seems to be taking? Casey has been in the klink before the latest smear campaign against Kronk, the TES fiasco, the Macalusco brag that he could prove she couldn't have done it, Baez is going in circles but I'm sure you're right that casey still thinks she'
s the prom queen and "her team" (whoever that is at any given moment) follows her orders. I really can't wait for her to have to stand up next to JB and listen to a guilty verdict. Let's see how in control she feels then.

I've been on the fence about R. Hornsby.  On the one hand, he appears to be knowledgeable and savvy on the law.  On the other hand, his spiteful and childish attacks on Kathi B. and Bill Sheaffer are really over the top.  What makes me go "hmmmm" is his disdain for Baez and Co.  Wouldn't it be a laugh riot if he floated this case, (wasn't his article on this ruling a couple of weeks ago?) just to see if Baez went for the bait?  I believe the recent decision spoke only of minors being tried as adults, in addition, Casey is indigent.  These are two factors that I think would be major differences.  I can just see Baez hopping all over this one, "Hey, look, Big C, we can get Judge Perry to deny his own ruling AND I'm using Case Law for the first time." (Proudly beaming at himself, waiting for his gold star on his color coded paper.)
Hornsby's contempt for the defense team is apparent, and sometimes I think he feels that he has to show that he could do a better job.  (His springboard to fame and fortune, if you will.)I'm just not sure I trust Hornsby's motives, and I sure as heck don't trust the defense.

Hi Monka.....I have always been suspicious of RH's motives and at times, I think he protests too much about Baez.....I often think he is helping the duhfense and only proclaims his disdain for BOZO as a screen
