Didn't Dub's claim a deal was made? So, now- if there's any truth to it, isn't the state back pedaling? How would that reflect on future criminals offered a plea deal in the future? Bad situation all the way around.

I really hoped initial reports of a deal were incorrect- and we know about the reported public outrage- and rightly so.

No, under normal conditions the former school shouldn't have had to contact the incoming new school. Most transfers go without any issues as most parents are responsible and want their chilren to have an education.

As far as a mental explanation for EB and AB commiting this crime, I don't think that's the case. They can't pinpoint an exact date of death. The remains may give them an approximation, but not a definete date. They are going to have to prove they were mental at the commision of the crime- not drug or alcohol induced- which is likely. Dysfunctional- yes, mental- no. They knew the difference between right and wrong otherwise they wouldn't have spaced out the remains to 'hide' them, they would have called 911 or made a trip to the ER. Zahra's death- for whatever reason, was covered up.

from what i understand, the made a deal of sorts that she wouldnt get dp or lwop IF what she is saying is true and she is not lying, and she is saying she is innocent, well if they find out she is not innocent and had a hand in the killing and dismembering of Z then there is NO DEAL b/c she lied

Would someone mind answering a quick question? Did Zahra attend school and then she was moved but was never signed up for that new school?
SM told the school that Zahra was being home schooled.

Should Schools Have Raised Red Flag In Zahra Baker Case

CALDWELL COUNTY., N.C. -- On Thursday, Channel 9 investigated why someone hadn’t notice Zahra Baker was missing sooner.

A lot of times, the schools are the first ones to pick up on these things, but in this case no education officials at any level, in any county, knew where Baker was.

Channel 9 learned that Baker finished last school year in Caldwell County, but then she didn't show up for the first few days of school this year.

Channel 9 spoke with a school spokesperson, Libby Brown, on Thursday. She said a school counselor called Baker's parents and that Baker's parents said they moved to Hickory and were probably going to home-school Baker.

Brown said, "There was no more contact with the family. They refused to speak to the school."

If the Bakers were home-schooling, they would have had to file papers with the state. Channel 9 talked to a state school official, Jill Lucas, Thursday. She handles home-schooling and private schools. She said the state doesn't have any records of either parent setting up a home school or any home school at Baker's address.

Someone else could have been teaching Baker, but the state couldn't say for sure because the state doesn't track the students.

North Carolina has a law requiring school attendance, so Channel investigated who enforces that, who was making sure Baker was attending some school. Perhaps that person would have seen a change.

It sounds like, in a case like Baker's, no one knew to check.

Thank you to those who answered the question. It is what I feared because I have read it all to many times before sadly.
This is the crack that so many children fall into. There needs to be a federal law requiring the last school a child attends to confirm that child is enrolled in the next school. Sadly I don't think there is. A parent should not be able to say, well I think we are just going to home school the child and then it is never looked at again.
This is a flaw, a big one, that puts children at risk.

The Catawba County district attorney's office filed a motion Wednesday to move a hearing to discuss at least 20 sealed search warrants in the Zahra Baker investigation. The new date is Jan. 3, 2011.

Prosecutor Sean McGinnis initially filed a motion on Nov. 29 to extend current sealing orders on all search warrants relating to the case. The warrants were initially sealed for 30 days. In the motion McGinnis filed on Nov. 29, it stated a hearing was set for Dec. 13 to discuss the sealing orders on the search warrants.

District Attorney Jay Gaither said he had no comment about why his office asked the hearing be moved three weeks later than his office initially requested, and five weeks from when his office asked for a hearing on the matter.

On Nov. 30, Superior Court Judge Nathaniel Poovey unsealed 13 warrants in the Zahra Baker investigation. According to Poovey’s order unsealing order, the district attorney’s office did not file a motion to extend the seal until after media outlets asked for copies of the warrants.

When media again asked for copies of the warrants, “The court offered to hear (the state’s motion) on Monday, Nov. 29, but the state declined and indicated they would not be prepared to have it heard until the week of Dec. 13,” according to Poovey’s unsealing order.

Information obtained from warrants that were unsealed Nov. 29 revealed that Zahra may have been raped. One search warrant also stateed Zahra Baker’s stepmother, Elisa Baker, told police where evidence could be found. The evidence including Zahra’s mattress and box spring, her prosthesis, and a bed comforter and car cover used to transport the body.

The warrants that remain sealed contain information on Department of Social Services’ investigation of Elisa three children, Brittany Proctor (Starbuck), Amber Fairchild and Douglas Proctor in Alexander, Cleveland, Lincoln, Gaston, Burke, Catawba and Caldwell counties.

The search warrants also contain information on the Baker house at 21 Avenue, NW, in Hickory, cell phone records, information from IMVU, the social networking site where Elisa met Adam, and medical records for Elisa.

Zahra, 10, lost part of her left leg and some of her hearing to cancer. She was first reported missing by her father, Adam, on Oct. 9. On Oct. 12, the case was changed to a homicide investigation. Her stepmother, Elisa, 42, is currently in jail for writing a false ransom note in which she demanded $1 million. Because of that, Elisa has been indicted on one count of felony obstruction of justice. She has also been arrested on several other charges unrelated to Zahra’s disappearance. Adam was arrested as well, for several charges unrelated to the case. He has since bonded out of jail.

Prosecutors filed a motion Wednesday to seal six search warrants in the Zahra Baker investigation, according to the Hickory Daily Record. A hearing on the motion has been scheduled for Jan. 3.

The motion, filed by the Catawba County District Attorney's Office, would seal warrants that include medical information about Zahra's stepmother, Elisa Baker. They also contain information about a website where Elisa Baker met Zahra's father, Adam Baker.

The10-year-old was reported missing Oct. 9 and her body has since been found dismembered and scattered across several rural areas.

The Hickory Daily Record also reported that an additional 15 sealed warrants were filed this week. The warrants include cell phone records, information on the Bakers' Hickory home and information about Department of Social Services investigations concerning Elisa Baker's three other children.

A superior court judge unsealed several warrants in late November that revealed Elisa Baker directed investigators to locations where they found key evidence, such as Zahra's prosthetic leg
Another hearing is scheduled for next week to discuss whether two search warrants should be unsealed.

Is adam NEVER ever gonna be arrested??? I keep waiting and waiting just like all of you guys. Ughhh I just want 2 ride on over 2 where he is and beat the ever loven sh*t out of him omg this case is bringing the worse out in me. Rant over sorry. I just want him In jail so bad!!!!

I've been in the office when the school called another to verify if a child was enrolled at the new one after they left there.
Then they call the parents to find out why, then they report it to the state.
 All schools are different, but I do feel there should have been follow up on the schools part.

He and his mommy can pretend all they want but zahra didn't die and get dismembered without him knowing about it or having a part. I hope he sweats bullets each and every minute of the day.  One day that police escort will take him to jail for a long time. Can't wait!
