Court bends over objections lawyers

ORANGE CITY - In recent days, Joran van der Sloot interrogated by Aruban and Dutch specialists in the correction Institute Aruba (KIA). There he is deprived of news, TV and internet is banned and there should be no family to visit.

Only certain reading, as the Bible, would be allowed. His lawyer, Ariean de Bie, which may be present at the interrogations, has lodged an objection to these restrictions. This will be announced later in the day a decision is expected by the Common Court of Justice of the Netherlands Antilles and Aruba.

It also expects a ruling on the request of the lawyer David Kock & Wix both Deepak and Satish Kalpoe leave to defend, as was the case two years ago. The prosecution, the accused as much as possible from each other to exchange information to prevent.

For this reason, their counsel not of the same law firm may be. The lawyers of different clients may not discuss with each other and their suspects are kept isolated. All three suspects have the same formal status and is not a prime suspect.

Friday is also the most important decision on the extension of the custody of the Kalpoe brothers with a period of eight days. This is determined by the judge. About fellow suspect Joran van der Sloot was already announced earlier this week that his detention was extended. Friday next week considering he is sixty days longer be held.

Parents Holloway hour long conversation with OM Aruba

Satish Kalpoe leaves the police station in Shaba

ORANGE CITY - The parents of the missing American Natalee Holloway, Beth Reynolds (Twitty) and Dave Holloway, Saturday hours have been met with both justice and police.

The content of the conversations are not being disclosed. Same day were the two brothers Deepak (24) and Satish (21) Kalpoe home again.

The two co-defendants of Joran van der Sloot (20) - all three, they are still suspected of the murder of Natalee Holloway - were dismissed one by one from their custody. Satish was half past three to the doors of the police station in Shaba (North) and one hour later, Deepak from that of North.

Deepak Kalpoe gets in the car after he was released from custody.

The Public Prosecution Service has now announced to appeal against the decision to release the two again. The examining magistrate had Friday expressed his reservations about extending the remand.

Against all three suspects - including Van der Sloot is - remain serious suspicions, but not enough to maintain the detention of the two Kalpoe brothers.

The lawyer of Joran van der Sloot, Ariean de Bie, thinks his client based on the record as also released. Suspected that there is not really more material than the 12.5 pages of evidence last week was given to lawyers.

"I marvel at the incredible self-confidence of the investigators in Aruba have evidence that they have in the Holloway case," said De Bie, after it became known that the Kalpoe home-scions were. For the lawyer will not be difficult to defend the case for the court. "Well a lot of effort, because the file is big."

De Bie counsel believes that the OM is still not in the research is successful. Especially the American side of things, he said, totally neglected. "Natalee Holloway has a very active mother and stepfather as an arms dealer who apparently has contacts in the White House. The FBI questioned a bit in America but not dug deep enough. There are many questions about it. "(Daily Herald)

Joran van der Sloot again Fri

ORANGE CITY-Joran van der Sloot was this afternoon - after the close of this edition - released from the correction Institute Aruba (KIA) where he was stuck again on November 24 on suspicion of manslaughter in 2005 in the U.S. school student Natalee Holloway.

The examining magistrate today rejected a request from the prosecution for an extension of his remand off.

Like the brothers Deepak and Satish Kalpoe, who all were released last Saturday, the magistrate had his reservations on the basis of the current criminal file. The "new evidence" from which it justified the extension and making the 20-year-old Joran at least 60 days longer in prison should have stayed, proved not enough.

In 2005, the Joran van Sloot at liberty long after he had spent in custody. He was then greeted outside by his parents Paul and Anita van der Sloot. What was going on that afternoon, after closing of this newspaper was not yet known.

The Public Prosecutor (OM), the decision "somewhat expected" this week when the brothers Deepak and Satish Kalpoe were allowed to go home.

"The dossier for Joran was the same as for two other suspects," commented Hans Mos, chief prosecutor. "The decision provides food for thought on a final decision." Soon, at least for December 31, he takes a decision or he terminates the case or proceed to prosecute the suspects.

Occupation pointless

By deciding this week to the Common Court of Justice - rejected the appeal against the release of the Kalpoe brothers - the OM is an appeal against the opinion of the magistrate 'useless'.

So far there is no direct evidence that Holloway was killed by violence. Justice admits that there is no body was found, but does not consider this an obstacle to achieving a conviction. According to lawyer Ariean De Bie, Joran's parents are relieved and happy about the release of their son.

Embarrassment

The news about the release of Joran, who returned two weeks from his home in the Netherlands was transmitted via Curacao to Aruba, was immediately seen and heard everywhere. Generally, the idea that a "descent" for the Aruban Public Prosecutor's Office, headed by Deputy Attorney General Nico Jrg and Prosecutor Mos.

It is the second time that Joran is at liberty made. Also in 2005, when Natalee Holloway disappeared late May, he sat a long time in custody. After his release two years ago, he picked up the thread of his life and went to study in the Netherlands.

Joran and the Kalpoe brothers were arrested Nov. 21 because of "new evidence" that a research team of Dutch and Aruban investigators surfaced this year would have met. Joran was this in the Dutch city of Arnhem, held in September 2005 where he was studying, just for the first time after he was freed in Holloway case.

He sits down when almost three months as main accused, inter alia, rape and murder of American teenager. After over one year of reasonable anonymity, the arrest last month came as a big, unpleasant surprise for Joran. Similarly for the Kalpoe brothers. The lawyers however, immediately put their doubts to the 'new facts' on which it is the arrest of the trio had demanded.

It soon became apparent that this 'new' evidence submitted was based on revision of the old file. Indicators that just after the beginning of the disappearance were insufficient or not chosen, such as telephone taps, were reexamined. Attorneys for the Kalpoe brothers were soon known that the new evidence is nevertheless no more than 12 pages that included also 90 percent-95 age would be evidence. "

The prosecution now trying at all costs to keep apart the suspects to prevent them again would make up a coherent story, as with their first arrest happened two years ago. Since their arrest, they were also directly questioned intensively and face particularly contradictory statements they had previously made.

It is not known whether these have any interrogations have been performed successfully. For the magistrate was "indirect" proof it's not enough so that after 17 days the last suspect in the Holloway case is set again at liberty. (Daily Herald)

Search by Holloway put

A team of experts, the search for the missing teen Natalee Holloway in Aruba put through despite the decision of Justice to the case against the suspects to close for lack of evidence.
Around the island Wednesday a special American research ship began scanning the seafloor. The arrival of the boat Persistence is confirmed by Tim Miller of Texas Equuesearch (TES), an organization that tracks down missing Americans that if the authorities give up.

The ship has already announced one month ago by Dave Holloway, Natalee's father, but was delayed by last week including Tropical Storm Olga in the Caribbean.

Detectors

The Persistence can search up to three kilometers deep, unlike the previous one hundred meters from the sea in search for Holloway. The experts have made that 'the best detectors on the planet "on board. The cost per day for the study would amount to one hundred thousand dollars and are covered by donations.

The Public Ministry has distanced itself from the private search. This dissatisfaction to the lawyer of Joran van der Sloot, Ariean de Bie, who fears that without control might have to be fabricated evidence. "They would be able to impose such a handbag." (Reuters)

Since Kyle Kingman's own words were revealed on a public forum two years ago ... words regarding his concerns encompassing the trap which was discovered in Aruban waters during the 2007 Persistence endeavor ... I have been and continue to be on a mission not to allow this aspect of the Natalee Holloway to become a faded memory ... a non-issue.  My focus is unwavering.

Kyle shared what he perceived as a furthering of the Aruban cover up agenda by John Silvetti when what may have been Natalee's remains was afforded unchallenged to the Aruban enemy ... the Aruban enemy that has prevented justice from prevailing since May 30, 2005.  I consider this revelation by one of the project leads on Persistence huge when I consider the family.

It is my firm belief that justice for Natalee will never be forthcoming out of Aruba ... the implications are too far reaching.  The exposure of those who participated on the morning of May 30, 2005 in the events encompassing the demise of an American citizen and ... the exposure of those within the corrupt Aruban investigation who were one with the cover up agenda ... would bring down the Aruban house of cards.  Therefore ... the family must be afforded the opportunity to bring Natalee home to rest on American soil.  A measure of closure could then be embraced.

Pressure was brought on the FBI to investigate an alleged injustice against an American citizen in Aruban waters.  Considering an outcome of an investigation has not been forthcoming ... could it be that jurisdictional and/or political issues imply that Natalee Holloway does not and will not have an advocate within the American administration.

I contend that other avenues of exposure must be explored.

Janet

BETH HOLLOWAY TWITTY, NATALEE HOLLOWAY'S MOTHER: Well, the facts still remain that those are the last suspects known to be seen with Natalee alive. And everybody knows of their repeated lies that they told the authorities, even their father, Paulus Van Der Sloot. That`s why he was arrested. There was a reason that he was arrested in Natalee`s disappearance. It was not unwarranted whatsoever.

And you know -- and being dismissed in New York, it was on a procedure ruling.  Here again, jurisdiction.  We have faced that issue since May 30 of 2005.  Jurisdiction and extradition hve hit us in the face every time.

Watching the movie about Natalee on LMN...this the first time I'm seeing it and I'm a mess! My stomach hurts so bad.

pb

Still standing with the girl

I recorded the Natalee movie last night so that I can watch it this weekend.  I'll make sure I have a nice quiet time to watch it.

I recorded the Natalee Holloway movie and watched it today. Sad  So sad... and breaks your heart.  It followed Beth's story/talk that I went to a week or so ago.  Her talk had more details but seeing the movie really added such an emotional piece.  I can't even imagine how Beth has found the strength all these years.

Just wanted to say God Bless to BillB, Lifesong, Hotping, BlueMoon, Jen3560, Kermit, and Rob. Hope all is well in your respective worlds! A journey such as justice is never an easy one, but one that needs to be taken in light of the injustices that occur around the world every day, to people that are unsuspecting of the dangers that changed the course of their lives as well as their mothers, fathers, brothers, sisters, grandmothers, grandfathers, cousins, and friends that were closest to them. Justice may not be coming in the time, or the fashion that I'd like, I trust that the ultimate arbiter of justice, has it all under control. I'll KeepTheFaith, as it's never steered me wrong! A BIG Thank you to Scared Monkeys, Klaasend, 2nj, San, Muffy, and all other silent contributors to keeping hope and faith alive for all those without voices. I stand with the girl, Natalee Holloway.

THE PERSISTENCE

The Recovery Dive

Kyle Kingman - In His Own Words

Kyle Kingman:
For Jan 7th, Eduardo wasn't on the boat, neither were any media, Tim Miller, or Tim Trahan.

Kyle Kingman: The Persistence had no divers on the 7th. Tim Trahan was our diver on the 30th-Dec, but he was out of the country at the time. The Aruban divers were on the police boat, dove from their boat, and returned to their boat.

Kyle Kingman:  Jan 7th we sampled the contents and in my opinion we found the skirt under the sand along with the other items The blue fabric was found right where the skirt is pictured. If it isn't her, it will forever haunt me as a major cosmic WTF

Kyle Kingman: In my opinion, the blue fabric is quite possibly Natalee's skirt. The divers found the denim where I suggested a week earlier (Dec 29th) to Tim Miller that there was likely Natalee's denim skirt under the sand. Also in my opinion, the deni-like fabric is a match in terms of color, quantity, and structure to Natalee's skirt.

Kyle Kingman: The fabric(s?) are not visible on either the Dec 29th or 30th dives. There is about an inch of sand over the fabrics. The fabrics are completely covered. The diver sampled the sand and found the fabric underneath the sand. He then bagged the blue fabric. If the other bag contains fabric, it was also in the sand.

Kyle Kingman:  The bags were removed just after the ROV got out of the way when the divers took the samples to their boat.... and took off.

Kyle Kingman: They were immediately whisked away by the Aruban police and not seen of again by us on the 7th.

Kyle Kingman: I get done in the survey room backing up the ROV dive and head to the back deck to talk to the Polis divers and see what they sampled and see the Polis boat way in the distance heading away fast. John doesn't seem concerned at all, but I am very dissapointed, concerned, and burning inside because I have a feeling that I/we will never know what they took from the trap. That evening I talked to John asking when we plan on recovering the trap. Previously this was part of the talks and plan, but this time he doesn't seem concerned about ever looking into the trap further. After John verbally BASHED me about the trap for what I said to Tim Miller about the sand body-form and that I believed her skirt was under the sand, John pretty much committed himself to the belief the trap wasn't what we were after. This shocked me because it was exactly what we were looking for- a fish trap lost at sea with human remains.

Evidence for the Arubans to Destroy

If I understood Kyle correctly, and that would be that the Arubans retrieved and possessed all finds, not sharing anything with the crew, then that effort was a waste of time and effort. The only thing it could have accomplished was to locate additional evidence for the Arubans to destroy. I am not sure if that was the protocol out of Aruba's waters though. The effort was superb, but the game was fixed.

Parable of the Lamp

Mark 4:21-23

Then Jesus asked them, Would anyone light a lamp and then put it under a basket or under a bed? Of course not! A lamp is placed on a stand, where its light will shine.  For everything that is hidden will eventually be brought into the open, and every secret will be brought to light.  Anyone with ears to hear should listen and understand.

I do believe, if one of those Dutch cheek smackers ever tried to give me a kissy...

I would call in an elbow strike somewhere in from Alabama all the way down to Miami. (it would be a non-stop flight, of course.)

I would smash that chit cross wise, temple to nose, for maximum impact.

Then hand him a gift wrapped box that he could keep his detached nose in.

The tissue in the wrapped box comes in handy! ...if he should ever need to find

it and want to blow it, again.

The journey continues.....................TICK_TOCK

Keep it goin', KeepTheFaith. The journey continues and we will all be here until the last day to get the mission accomplished. You can take that to the BANK.

(Just don't let Joran know which bank or what the account number is)
