The indictment records the offense committed on or about Sept. 24th, 2010

and the "kidnap" was called in how many days later? 

2 weeks.
Dad surely had some gross negligence in the whole matter.

That in itself should be criminal. What if she had been gravely hurt or ill and he willfully ignores his parental obligation to, at the very least see to his child's well being? I don't understand, I would think a parent should be accountable for a minor. It's acceptable for a parent to be completely oblivious to a child's presence (or non presence)  for 2 weeks?

HICKORY, N.C. The stepmother of a 10-year-old disabled girl was indicted Monday on charges she killed the freckle-faced child and then desecrated her remains to cover up the slaying, according to court documents.

A grand jury in Catawba County charged Elisa Baker with second-degree murder in the death of Zahra Baker. Authorities planned to discuss the case at a news conference later in the day...... ::snipping2::

Ill be watching the presser but Im very upset that this is 2nd degree, whether she can still get life or not is irrelevant to me morally after what this monster did

And what's with the 2nd degree charge?
I'm glad she's finally been charged, but I am shocked that it's not 1st degree. The sick,twisted, insane brutality of this case screams 1st degree to me.

From what I have looked up. First degree murder would have to be premeditated. And there was a tweet from Rad Berkley that death penalty not an option

Capp if they made a deal with her(2nd degree) to get Zahra's remains would that be part of the public record ?

For the inhuman way zahra was treated in life and after death I'm disappointed at the charges of 2nd degree. I might understand the non premeditated criteria but still seems too light.  As for AB, in my mind, he deserves to be charged also. Sometimes it's just too much....very disappointed

Would think with the original 911 call from Adam, the attempted cover-up reporting it as a kidnapping, that he'd talked to Z on Tuesday, checked in on her on Thursday night etc.  Even if they can't pin the actual murder, desecration and disposal, charges of some kind against Adam should put him away for a few years?

The following information is excerpted from the North Carolina Revised General ... Murder in the First and Second Degree (14-17)

Crimes Against Persons
Murder in the First and Second Degree (14-17)
A murder which shall be perpetrated by ... poison, lying in wait, imprisonment, starving, torture, or by any other kind of willful, deliberate and premeditated killing or which shall be committed in the perpetration or attempted perpetration of any arson, rape or sex offense, robbery, kidnapping, burglary, or other felony committed or attempted with the use of a deadly weapon, shall be ... murder in the first degree ... and shall be punished by death or life imprisonment ... except that any person ... under 17 years of age at the time of the murder shall be punished with imprisonment ... for life.

All other kinds of murder, including that which shall be proximately caused by the unlawful distribution of opium or any synthetic or natural salt, compound, derivative, or the preparation of opium ... cause the death of the user, shall be ... murder in the second degree and ... shall be punished as a Class C felony.

Classification: First Degree - Class A Felony (death or life imprisonment); Second Degree - Class B2 Felony (50 years, life imprisonment, fine, or both).
