Ex-attorney negotiated Elisa Baker's cooperation

The agreement included Elisa Baker’s cooperation in locating Zahra’s remains, Dubs said.

IT SEEMS beyond belief. Adam Baker’s 10-year-old daughter, Zahra, was a cancer sufferer in need of constant care. How could she just go missing from her father’s notice for 15 days?

Police believe Adam’s wife, Elisa Baker, murdered Zahra on September 25 last year and scattered her remains in bins and woodlands outside of the town of Hickory, North Carolina.

Yet it was not until October 9 that Adam Baker noticed that Zahra was no longer in his life. He decided to call the police.

Elisa Baker, 44, has been charged with second degree murder and faces up to 30 years in prison. The manner in which Zahra died has not been revealed.

Adam Baker, 33, told a local television station yesterday that he had been working long hours at his mulching job and was leaving for work and coming home when Zahra was in bed.

Mr Baker’s mother, Karen, 53, of Newcastle, has been in North Carolina with her son since her granddaughter’s partial remains were discovered in October. Yesterday, she backed up Adam’s story.

“Adam was working long hours,” she told News Ltd from the apartment where she is staying with Adam, just out of Hickory.

“He would go into Zahra’s room and she (Elisa) had made up the bed to make it look like she was in bed asleep.”

She agreed it sounded hard to believe.  “Honestly, I don’t have all the answers,” she said. “He doesn’t either. I know it’s very hard to understand. A lot of it is still not to be talked about, because we have a trial coming up and there’s nothing we will do to damage that.”

Newton, NC (WBTV) - Elisa Baker was arraigned Tuesday on an indictment for second degree murder in the death of her stepdaughter Zahra.

Baker was scheduled to be in court for the matter on Friday but officials in the Clerk of Courts Office moved up the matter for procedural reasons.

Meanwhile, Adam Baker, who has not been charged in the Zahra case, left town overnight. Sources told WBTV news Adam and his mother have gone out of state temporarily because they were being harassed.

A number of people have expressed feelings that they thought Adam should have been charged along with Elisa in the death of 10-year-old Zahra Baker.

District Attorney James C. Gaither announced Monday that there was "no credible evidence" to charge anyone other than Elisa Baker. Police were informed of Adam Baker's travel plans.

But Lisa Dubs, who was one of murder suspect Elisa Baker’s attorneys until this week, said she did nothing wrong. The defense attorney said she’s allowed to collect evidence that helps her client and that she was prohibited by law from then turning it over to police without her client’s permission. The defense investigator says the evidence helped convince Dubs and him that Baker was being truthful.

Legal experts say that gathering evidence — taking photographs at a crime scene, for example — is common for defense teams, but that removing potential evidence falls into a murkier area that many attorneys avoid.

“It was only in our possession long enough to negotiate an agreement with law enforcement and then we turned it over immediately,” the Hickory lawyer told The Associated Press.

Thank You Brandi for this.  I know this happens a lot. But for some reason this just makes me very angry. So in other words this lawyer got away with Elisa not having to really pay for what she did to Zahra. IMO this is WRONG. Elisa needs to pay with her life. And to take evidence and use it as a bargaining tool to get this evil human being off just makes me  as all get out.

You know, in my neck of the woods where the good ol boy system still lives, that lawyer would not get away with holding evidence over the DA's head.  It may be slightly legal but I'm not so sure how the electeds that are involved in Zahra's case are gonna be percieved by the public now!  Damn shame a child killer had something to bargain with.  I'm so sorry little Zahra didn't!  Ms. Dubbs, I don't usually go around spouting how I hope you end up being tortured by the demons of this story but I really hope you loose more than a few nights over the fact you helped a baby butcherer spare her own life!  Poor Zahra!

oh trust me...the good ol boy system is alive and well here. that would be the reason that Gaither is even in office.

Even Lisa Dubs doesnt understand why adam hasnt been charged as well.

I  think Dubbs should run for DA, we need her on our side prosecuting these people. Not setting them free, she is much more effective in her job that Gaither is in his.

ADAM Baker was a lonely guy, staying up late at night to roam the virtual world while his daughter, Zahra, was in hospital in Brisbane recovering from a serious cancer operation.

Adam had connected with Elisa Fairchild - a woman in her early 40s who had a long history of passing worthless cheques, giving false names, fraud, making violent threats, investigations for beating her own children and, as would later be discovered, bigamy.

Adam's former wife, Emily, had suffered post-natal depression and left Zahra with Adam when Zahra was not quite two years old.

At five, Zahra developed bone cancer and required an above-knee amputation of her left leg.

In 2007, Zahra underwent a lung cancer operation in Brisbane, and her recovery was slow.

For Zahra, her dad's decision to leave Australia, where Zahra's medical treatment was free, for North Carolina, where it's not, was stupid and selfish. Elisa had no medical insurance and family members advised Adam not to go.

He had little money and his needy daughter was denied the regular medical care she needed.

Instead, Zahra was placed in the trailer-home world of a vicious woman who began to beat and torment this small girl.

Adam would not talk to the Herald Sun this week, except to say that his first wife, Emily, who was expressing her grief for Zahra back in Australia, had "never been a mother to Zahra".

But for Adam Baker, 33, there are questions he cannot escape, even if he only ever asks them of himself.

He did not create the creature that is Lisa Baker. But many times during his two years in North Carolina he turned a blind eye to the wicked treatment she dealt out to Zahra.

It was Adam who became involved with the wicked witch.
It was Adam who married the wicked witch.
It was Adam who chose to move Zahra and himself to another country.
It was Adam who allowed false information to be used to allow his child to leave Australia and enter another country.
It was Adam who ceased contact with his own mother.
It was Adam who chose to allow the wicked witch to rule his life.
It was Adam who presumably chose to allow his lifestyle to be degraded to the level of the wicked witch.
It was Adam who continued with his normal life even after learning that the witch's "brother" was indeed her husband.

It was Adam who chose to ignore signs of abuse inflicted on his daughter.

Adam never appears to be
the sharpest pin in the cushion.
He appears to be a very dependant,
whooped guy.

His Mother helped him a great deal with Zahra over the years.
I bet she was a huge influence to suggest not to allow
Emily into Z's life after Emily recovered from her depression.

BTW: Has anyone heard HOW Emily is, and
where is she moving through this terrible grieving ?
She posted at Valhall/Hinky Meter in the beginning of this mess.
