op het beroep in cassatie tegen een vonnis van het Gemeenschappelijk Hof van Justitie van de Nederlandse Antillen en Aruba van 29 april 2008, nummer P-2007/00105, in de strafzaak tegen:
[Verdachte], geboren te [geboorteplaats] op [geboortedatum] 1989, ten tijde van de betekening van de aanzegging gedetineerd in het Huis van Bewaring "Aruba" op Aruba (Nederlandse Antillen).

1. Geding in cassatie

1.1. Het beroep is ingesteld door de verdachte. Namens deze heeft mr. P.A.P.J. van der Sloot, advocaat te Oranjestad (Aruba), bij schriftuur een middel van cassatie voorgesteld. De schriftuur is aan dit arrest gehecht en maakt daarvan deel uit.
De Advocaat-Generaal Vegter heeft geconcludeerd tot verwerping van het beroep.

1.2. De raadsman heeft schriftelijk op de conclusie gereageerd.

2. Beoordeling van de schriftuur

2.1. Voor onderzoek door de cassatierechter komen alleen in aanmerking middelen van cassatie als in de wet bedoeld. Als een zodanig middel kan slechts gelden een stellige en duidelijke klacht over de schending van een bepaalde rechtsregel en/of het verzuim van een toepasselijk vormvoorschrift door de rechter die de bestreden uitspraak heeft gewezen. De schriftuur voldoet niet aan dit vereiste, zodat zij onbesproken moet blijven.

2.2. Nu de verdachte niet binnen de bij de wet gestelde termijn bij de Hoge Raad door een raadsman een schriftuur houdende middelen van cassatie heeft doen indienen, is niet in acht genomen het voorschrift van art. 437, tweede lid, Sv, zodat de verdachte in het beroep niet kan worden ontvangen.

3. Beslissing

De Hoge Raad verklaart de verdachte niet-ontvankelijk in het beroep.

Dit arrest is gewezen door de vice-president A.J.A. van Dorst als voorzitter, en de raadsheren J. de Hullu en W.F. Groos, in bijzijn van de waarnemend griffier L.J.J. Okker-Braber, en uitgesproken op 1 september 2009.

Conclusie inzake:

[Verdachte]

1. Het Gemeenschappelijk Hof van Justitie van de Nederlandse Antillen en Aruba heeft verdachte op 29 april 2008 ter zake van "poging tot doodslag, strafbaar gesteld bij artikel 300 jo. 47 van het Wetboek van Strafrecht van Aruba" veroordeeld tot een gevangenisstraf voor de duur van 2 (twee) jaren met onttrekking aan het verkeer zoals in het vonnis omschreven.

2. Verdachte heeft op 13 mei 2008 cassatie ingesteld. Mr P.A.P.J. van der Sloot, advocaat te Oranjestad (Aruba), heeft een schriftuur ingezonden.

3.1. De ingediende schriftuur geeft aanleiding tot het plaatsen van enkele kanttekeningen. Ik merk op dat voor onderzoek door de cassatierechter alleen in aanmerking komen middelen van cassatie als bedoeld in art. 437 Sv. Dat betekent dat het moet gaan om 'een stellige en duidelijke klacht over de schending van een bepaalde rechtsregel en/of het verzuim van een toepasselijk vormvoorschrift door de rechter die de bestreden uitspraak heeft gewezen'.(1)

3.2. De onderhavige schriftuur houdt allereerst in "schending van het recht en/of verzuim van vormen waarvan het niet inachtnemen nietigheid meebrengt". Vervolgens geeft de raadsman in de schriftuur de inhoud van het bestreden vonnis weer, gevolgd door een toelichting bevattende opmerkingen genummerd 1 tot en met 13. De eerste opmerking bevat weliswaar een stellige en duidelijke klacht, maar niet nader wordt aangegeven welke bepaalde rechtsregel wordt geschonden en/of toepasselijk vormvoorschrift wordt verzuimd.(2) De derde, vierde, en zesde opmerking betreffen in feite een blote herhaling van stellingen en verweren waarop het hof gemotiveerd heeft beslist, zonder dat in die opmerkingen wordt aangegeven "waarom de door het gegeven beslissing onjuist is of in welk opzicht de motivering van die beslissing onvoldoende zou zijn".(3) De tweede opmerking betreffende het niet aanhechten van de bewijsmiddelen aan het vonnis, evenals de vijfde, tiende, elfde, twaalfde en dertiende opmerking kunnen mijns inziens niet worden beschouwd als middelen van cassatie aangezien de in die opmerkingen besloten liggende klachten niet voldoen aan de "eisen van nauwkeurigheid die in een geval als het onderhavige daaraan behoren te worden gesteld".(4) De zevende, achtste en negende opmerking zijn evenmin als middelen van cassatie te beschouwen, aangezien aan de schendingen waarop die opmerkingen betrekking hebben geen eenduidige conclusie wordt verbonden. De schriftuur kan derhalve niet worden beschouwd als een schriftuur, houdende middelen van cassatie, aangezien als zodanig slechts voor onderzoek in aanmerking komen klachten, gericht tegen de bestreden uitspraak of beschikking die op de door de wet voorgeschreven wijze zijn voorgedragen, aan welke eis het geschrift niet voldoet.
Ik ben dan ook van mening dat de schriftuur geen cassatiemiddel in de zin van de wet bevat.

4.1. Naar aanleiding van de als eerste in de schriftuur weergegeven opmerking merk ik voorts nog het volgende op. Daarin wordt de vraag opgeworpen of het hof terecht heeft geoordeeld dat het bewezen verklaarde feit een strafbaar feit inhoudt.

4.2. Bewezenverklaard is dat:

"hij op of omstreeks 7 januari 2007 in Aruba ter uitvoering van het voorgenomen misdrijf om opzettelijk [slachtoffer] van het leven te beroven, opzettelijk [slachtoffer] met een mes, althans een scherp voorwerp, in zijn borst en/of buikholte, althans het lichaam, heeft gestoken, zijnde de verdere uitvoering van dat voornemen niet voltooid."

4.3. Het hof heeft dit gekwalificeerd als:

"Poging tot doodslag, strafbaar gesteld bij artikel 300 jo. 47 van het Wetboek van Strafrecht van Aruba"

4.4. Artikel 47, eerste lid, van het Wetboek van Strafrecht van Aruba luidde tot 31 augustus 2004:

"Poging tot misdrijf is strafbaar, wanneer het voornemen des daders zich door een begin van uitvoering heeft geopenbaard en de uitvoering alleen ten gevolge van omstandigheden van zijnen wil onafhankelijk niet is voltooid."

4.5. Artikel 1 van de Landsverordening van 12 augustus 2004 tot wijziging van het Wetboek van Strafrecht van Aruba (AB 2004, no. GT 51) (Strafbaarstelling terrorisme en terrorismefinanciering en daarmee samenhangende strafbare feiten) houdt onder meer in dat artikel 47, eerste lid, van bedoeld Wetboek voortaan zal luiden:

"Poging tot misdrijf is strafbaar indien het voornemen van de dader zich door een begin van uitvoering heeft geopenbaard."

4.6. Voorts houdt genoemd artikel in dat er een nieuw artikel in het Wetboek van Strafrecht van Aruba wordt ingevoegd, te weten artikel 48b, dat komt te luiden:

"Voorbereiding noch poging bestaat, indien het misdrijf niet is voltooid tengevolge van omstandigheden, van de wil van de dader afhankelijk."

4.7. Deze wijziging is volgens artikel II van de Landsverordening ingegaan op 31 augustus 2004, derhalve vóórdat het primair tenlastegelegde feit plaatsvond. Het hof heeft daarom terecht het (nieuwe) artikel 47 van het Wetboek van Strafrecht van Aruba toegepast, tengevolge waarvan - anders dan de raadsman stelt - het ontbreken van - kort gezegd - "vrijwillige terugtred" geen bestanddeel meer is van de poging.

5. Ambtshalve heb ik geen grond aangetroffen die tot vernietiging van het bestreden arrest behoort te leiden.

6. Deze conclusie strekt tot verwerping van het beroep.

1. Cassation proceedings

1.1. The appeal was lodged by the accused. On behalf of these has Mr. P.A.P.J. van der Sloot, Bar Oranjestad (Aruba), by means of writing a proposed appeal. The scripture above is attached and forms part.

1. The Common Court of Justice of the Netherlands Antilles and Aruba has accused April 29, 2008 in respect of "attempted murder, punishable by Article 300 jo. 47 of the Penal Code of Aruba" sentenced to prison for the duration of two (two) years to remove from the award as defined.

2. Suspect On May 13, 2008 cassation. Mr. P.A.P.J. van der Sloot, Bar Oranjestad (Aruba), has submitted a writing.

3.1. The submitted writing gives rise to place some comments. I note that research by the cassation court only eligible grounds for cassation as referred to in Art. 437 Sv. That means there must be "a definite and clear complaint about the violation of a particular legal rule and / or omissions of any applicable procedural requirement by the court that the contested ruling out" (1).

3.2. This writing is first in "violation of law and / or omissions of shapes whose failure to comply causes invalidity". Then the lawyer in writing the content of the contested sentence, followed by a note containing comments numbered 1 to 13. The first comment did indeed give a definite and clear complaint, but no details of any particular legal rule is violated and / or applicable procedural requirement, failure. (2) The third, fourth, and sixth note in fact concern a mere repetition of claims and defenses which the court reasoned decided without that comments indicate "the reasons why the data decision is wrong or how the reasoning of that decision would not be sufficient." (3) The second comment on the non-attachment of the evidence the verdict and the fifth, tenth, eleventh, the twelfth and thirteenth note my opinion, can not be regarded as grounds for cassation as the inherent problems in these observations do not meet the requirements of accuracy in a case such as this it ought to be. "(4) The seventh, eighth and ninth remarks are not to be regarded as grounds for cassation, since the violations to which these comments relate to no single conclusion is connected. The scripture can not be seen as a scripture, laying grounds for cassation, since as such only for research qualify complaints directed against the contested decision or order which by law prescribed manner proposed, which require the writing inadequate.
I therefore believe that the scripture no cassation plea within the meaning of the Act contains.

4.4. Article 47, first paragraph of the Penal Code of Aruba was until August 31, 2004:

"Trying to crime is punishable if the intention of the perpetrators by an early implementation and execution has revealed only because of circumstances independent of his will has not been completed."

4.5. Article 1 of the Ordinance of 12 August 2004 amending the Criminal Code of Aruba (AB 2004, No. GT 51) (Criminalization of terrorism and terrorist and related crimes) include the provision of Article 47, first paragraph, of Code referred to henceforth read:

"Trying to crime is punishable if the intention of the offender by an early implementation has revealed."

4.6. Moreover, that article implies that there is a new article in the Penal Code of Aruba shall be inserted, namely Article 48b, which is read:

"Preparation is neither attempt if the crime is not completed due to circumstances, the will of the perpetrator depends."

4.7. This change is in accordance with Article II of the Ordinance deals August 31, 2004, therefore before the primary charge event occurred. The court was entitled to the (new) Article 47 of the Criminal Code of Aruba applied as a result of which - unlike the counsel shall - lack of - in short - "voluntary resignation" is no longer part of the attempt.

5. Ex officio, I found no reason to set aside the judgment should lead.

Uitspraak op het hoger beroep van:

de minister van Justitie,
appellant,

tegen de uitspraak van het Gerecht in eerste aanleg van Aruba van 21 mei 2007 in het geding tussen:

de naamloze vennootschap "World Wide Trading N.V.", gevestigd in Aruba,

en

appellant.


1. Procesverloop

Bij beschikking van 21 juni 2005 heeft appellant (hierna: de minister) geweigerd aan de naamloze vennootschap "World Wide Trading N.V." (hierna: World Wide Trading) machtiging voor de handel in wapens en vuurwapens te verlenen.

Bij beschikking van 8 augustus 2006 heeft de minister het daartegen door World Wide Trading gemaakte bezwaar ongegrond verklaard.

Bij uitspraak van 21 mei 2007 heeft het Gerecht in eerste aanleg van Aruba (hierna: het Gerecht), voor zover thans van belang, het daartegen door World Wide Trading ingestelde beroep gegrond verklaard, de beschikking van 8 augustus 2006 vernietigd en de minister opgedragen opnieuw op het gemaakte bezwaar te beslissen met inachtneming van hetgeen in die uitspraak is overwogen.

Tegen deze uitspraak heeft de Minister bij brief van 2 juli 2007, bij het Hof ingekomen op dezelfde dag, hoger beroep ingesteld bij het Hof.

Bij brief van 20 augustus 2007 heeft World Wide Trading een reactie ingediend.

Het Hof heeft de zaak ter zitting behandeld op 3 oktober 2007, waar de minister, vertegenwoordigd door mr. M.B. Boyce, ambtenaar in dienst bij het Land, en World Wide Trading, vertegenwoordigd door
mr. P.A.P.J. van der Sloot, advocaat, zijn verschenen.


2. Overwegingen

2.1. De minister klaagt dat het Gerecht de termijnoverschrijding bij het indienen van het beroep ten onrechte verschoonbaar heeft geacht.

2.2. Ingevolge artikel 27, eerste lid, van de Landsverordening administratieve rechtspraak (hierna: de Lar) bedraagt de termijn voor het indienen van een beroepschrift zes weken en gaat in op de dag na die waarop de beslissing op het bezwaarschrift is gedagtekend.
Ingevolge artikel 28, eerste lid, voor zover thans van belang, wordt een beroepschrift niet-ontvankelijk verklaard, indien het is ingediend nadat de termijn is verstreken.
Ingevolge het derde lid, blijft ten aanzien van een na afloop van de termijn ingediend beroepschrift niet-ontvankelijkverklaring op die grond achterwege, indien de indiener aannemelijk maakt dat hij het geschrift heeft ingediend zo spoedig als dit redelijkerwijs verlangd kon worden en het tegendeel daarvan niet blijkt.
Ingevolge artikel 29, eerste lid, aanhef en onder c, bevat het beroepschrift ten minste de gronden waarop het beroep berust.

2.2.1. Vast staat dat het beroepschrift niet is ingediend binnen de daarvoor gestelde termijn. Het Gerecht heeft ten onrechte in de omstandigheid dat het advies van de bezwaaradviescommissie en het verslag van de hoorzitting eerst op 12 februari 2007 aan World Wide Trading is verzonden grond gevonden voor het oordeel dat de overschrijding van de beroepstermijn verschoonbaar is. World Wide Trading had, toen zij op 10 augustus 2006 kennis kreeg van de beschikking op bezwaar, ter bewaring van de termijn een beroepschrift kunnen indienen met het verzoek om de gronden van het beroep aan te mogen vullen, wanneer zij over voormelde stukken kon beschikken. Artikel 29, eerste lid, aanhef en onder c, van de Lar staat daaraan niet in de weg. Het betoog slaagt.

2.3. Het hoger beroep is gegrond. De aangevallen uitspraak dient te worden vernietigd. Doende hetgeen het Gerecht had behoren te doen, zal het Hof het beroep van World Wide Trading tegen de beschikking van 8 augustus 2008 niet-ontvankelijk verklaren.

2.4. Voor een proceskostenveroordeling bestaat geen grond.


3. Beslissing

Het Gemeenschappelijk Hof van Justitie van de Nederlandse Antillen en Aruba

Recht doende in naam der Koningin:

I. verklaart het hoger beroep gegrond;
II. vernietigt de uitspraak van het Gerecht in eerste aanleg van Aruba van 21 mei 2007 in zaak no. Lar 377 van 2007;
III. verklaart het bij het Gerecht in die zaak ingestelde beroep van World Wide Trading tegen de beschikking van de Minister van Justitie van 8 augustus 2006, kenmerk CWJZ/1510geh, niet-ontvankelijk.

1. Proceedings

By order of June 21, 2005 has appellant (hereinafter the Minister) denied to the corporation "World Wide Trading SA" (the World Wide Trading) authorization to trade in weapons and firearms should be granted.

2. Considerations

2.1. The Minister complains that the Court of delay in filing the appeal is deemed excusable wrong.

2.2. Under Article 27, first paragraph, the Administrative Procedure Ordinance (hereinafter: the Lar), the period for lodging an appeal six weeks starting on the day after the conclusion reached is dated.

1. Het verloop van de procedure

Voor hetgeen in eerste aanleg is gesteld en verzocht, voor de procesgang aldaar en voor de overwegingen en beslissingen van het Gerecht in eerste aanleg van Aruba (hierna het GEA), wordt verwezen naar de tussen partijen op 7 mei 2009 gewezen beschikking.
ATC is van deze beschikking in hoger beroep gekomen door op 10 juni 2009, dus tijdig, een beroepschrift ter griffie van het GEA in te dienen. Haar conclusie strekt ertoe dat het Hof de bestreden beschikking zal vernietigen, alsnog een voorlopig getuigenverhoor zal bevelen en geïntimeerden zal veroordelen in de kosten van de procedure.
Geïntimeerden hebben gezamenlijk één verweerschrift ingediend waarin zij hebben geconcludeerd, kort gezegd, tot bevestiging van de bestreden beschikking, met veroordeling van ATC in de kosten van de procedure.
Bij de mondelinge behandeling hebben partijen volstaan met het overleggen van pleitaantekeningen, ATC onder het overleggen van op voorhand toegezonden producties.
Partijen hebben hierna een beschikking gevraagd, waarvan de uitspraak is bepaald op heden.


2. De beoordeling

2.1 ATC wenst te worden toegelaten tot een voorlopig getuigenverhoor om bewijs te verkrijgen omtrent feiten en omstandigheden aangaande de feitelijke uitvoering van de heffing en de vergoeding zijdens het Land voor het ophalen en verwerken en/of ter verwerking aanbieden van huishoudelijk afval. Van belang, aldus ATC, is het antwoord op de vraag of Serlimar niet betaald wordt voor alle ophaalpunten doch slechts voor die ophaalpunten waar zij daadwerkelijk huisvuil ophaalt.

2.2 Genoemde heffingen en vergoedingen vinden hun grondslag in art. 8 van de Landsverordening instelling Servicio di Limpiesa di Aruba. De vaststelling daarvan is een publiekrechtelijke taak en beide verweerders zijn publiekrechtelijke rechtspersonen. Omtrent de vaststelling is tussen partijen geprocedeerd en uitspraak gedaan door de Lar-rechter op 9 januari 2008 (LAR nr. 3324 van 2006).
ATC stelt dat de burgerlijke rechter hier toch een taak heeft of kan hebben omdat het aan het licht brengen van de juiste toedracht betekent dat vast komt te staan dat verweerder(s) onrechtmatig hebben gehandeld, wanprestatie hebben gepleegd en/of dat verweerder(s) ongerechtvaardigd zijn verrijkt.
Al deze gestelde grondslagen laten echter onverlet dat het verzoek uitsluitend betrekking heeft op feiten die van belang (kunnen) zijn voor het antwoord op de vraag of de door ATC aangevochten heffingen en vergoedingen moeten worden vernietigd en/of gewijzigd, maar die, wanneer de administratieve rechter zich heeft uitgesproken, geen onderwerp van debat meer kunnen zijn in een geding voor de burgerlijke rechter, waarin in vervolg op die uitspraak een vordering op grond van onrechtmatige daad, wanprestatie en/of ongerechtvaardigde verrijking wordt ingesteld (vergelijk HR 20 april 1990, NJ 1990, 825).
Het feit dat eerder een civiele feitenrechter zich bij vonnis in kort geding wel inhoudelijk over deze problematiek heeft uitgelaten, maakt dit niet anders, alleen al omdat civiele vonnissen andere rechterlijke instanties ter zake van rechtskwesties niet binden en een kort gedingvonnis geen gezag van gewijsde kent..

2.3 De bestreden beschikking zal derhalve worden bevestigd. ATC zal, als de in het ongelijk gestelde partij, de kosten van het hoger beroep dienen te dragen. Nu geïntimeerden hetzelfde verweerschrift hebben ingediend en dezelfde pleitnotities hebben overgelegd, zal het Hof hen gezamenlijk één bedrag aan proceskosten toekennen.


BESLISSING:

Het Hof:

bevestigt de beschikking waarvan beroep;

veroordeelt ATC in de kosten van het hoger beroep aan de zijde van het Land en Serlimar gevallen en begroot op in totaal NAF. 5.100,-.

1. Ontstaan en loop van het geding.

Op 6 oktober 2006 heeft appellant een bezwaarschrift ingediend bij het gerecht in ambtenarenzaken (verder te noemen het Gerecht) tegen het Landsbesluit van 27 juni 2006, no. 10. Bij uitspraak van 13 december 2006 heeft het Gerecht het bezwaar ongegrond verklaard.

Hiertegen is namens appellant hoger beroep ingesteld bij schrijven, ter griffie ingekomen op 10 januari 2007. Geïntimeerde heeft een contra-memorie ingediend.

Het beroep is behandeld ter zitting van de Raad in Aruba op 21 april 2008, waar appellant is verschenen, bijgestaan door zijn gemachtigde. Geïntimeerde heeft zich doen vertegenwoordigen door zijn gemachtigde.

De uitspraak is bepaald op heden.


2. Feiten.

Appellant is bij Landsbesluit van 13 oktober 1987 aangesteld als hoofd van het Gevangeniswezen en het Huis van Bewaring in schaal 13. Vooruitlopend op de herwaardering van deze functie is hem bij Landsbesluit van 1 oktober 1999 een persoonlijke toelage toegekend tot het bezoldigingsbedrag in schaal 14. Daarnaast is hem een tijdelijke toelage van 25% toegekend op de bezoldiging en persoonlijke toelage, vooruitlopend op de herziening van de Bezoldigingsregeling Aruba 1986.

Bij Landsbesluit van 24 juli 2000 no. 3 is appellant onder meer overgeplaatst naar het secretariaat van de Ministerraad en benoemd in de rang van administrateur, onder behoud van de door hem genoten bezoldiging, pensioengrondslag conform hoofdschaal 13 van de bezoldigingsregeling Aruba 1986. Daarbij is hem laatstelijk een persoonlijke toelage ter grootte van het verschil tussen de bezoldigingsbedragen in de schalen 13 en 14 toegekend alsmede een tijdelijke toelage naar reden van 25% van het bezoldigingsbedrag in hoofdschaal 14 van de Bezoldigingsregeling Aruba 1986.

Aan appellant is bij Landsbesluit van 13 februari 2006, no. 42 wegens het bereiken van de pensioengerechtigde leeftijd ontslag verleend. Bij het bestreden Landsbesluit is hem een pensioen toegekend naar reden van Afl. 53.016,-= per jaar, welk bedrag blijkens de bij dat besluit behorende toelichting is gebaseerd op een pensioengrondslag conform schaal 13, dienstjaar 1.


3. Overwegingen

In artikel 6 van de Pensioenlandsverordening landsdienaren (PLD) is bepaald dat de door de ambtenaar bovenop zijn salaris genoten toelagen niet bij de vaststelling van de pensioengrondslag kunnen worden betrokken.

Appellant klaagt erover dat geïntimeerde bij het nemen van het in bezwaar bestreden Landsbesluit niet heeft onderkend dat de hem toegekende persoonlijke toelage ter overbrugging van het verschil tussen schaal 13 en schaal 14 in materieel opzicht onderdeel uitmaakt van zijn bezoldiging. Hij wijst er daarbij op dat deze toelage hem is toegekend naar aanleiding van een uitspraak van de Raad waarin hem een schadevergoeding is toegekend gelijk het verschil tussen de bezoldiging in schaal 13 en de bezoldiging die hij zou hebben genoten als hij was gehandhaafd in zijn functie van hoofd van het huis van bewaring. Deze functie is gewaardeerd op schaal 14 en het huidige hoofd wordt ook volgens die schaal bezoldigd.

Artikel 6 PLD verzet zich er naar het oordeel van de Raad tegen om de door appellant genoten persoonlijke toelage bij de berekening van zijn pensioengrondslag te betrekken, ook indien rekening wordt gehouden met zijn betoog met betrekking tot de grond voor toekenning van zijn persoonlijke toelage. Doorslaggevend is, gelet op deze bepaling, slechts de wijze waarop een financiële beloning wordt toegekend en niet de -door appellant aan die beloning toegekende- materiële betekenis daarvan. Om diezelfde reden komt geen gewicht toe aan het feit dat de 25%-toelage aan appellant is toegekend in afwachting van de definitieve inschaling van de aanvankelijk door hem vervulde functie en in afwachting van de herziening van de bezoldigingsregeling Aruba 1986.

Er is geen andere wettelijke bepaling aan te wijzen op grond waarvan de beide toelagen van appellant -zijn persoonlijke toelage en zijn 25%-toelage- in afwijking van het in de PLD bepaalde, wel bij de berekening van appellants pensioengrondslag kunnen worden betrokken. Een basis voor toekenning van pensioen over de door appellant genoten toelagen ontbreekt derhalve.

Niet is gebleken dat geïntimeerde in gevallen waarin de pensioengrondslag wordt vastgesteld van een ambtenaar die een 25%-toelage heeft genoten, in een zodanige mate afwijkt van het in de PLD bepaalde dat in het geval van appellant niet aan het daarin bepaalde zou kunnen worden vastgehouden. Slechts onder uitzonderlijke omstandigheden is geïntimeerde gehouden om op grond van de algemene beginselen van behoorlijk bestuur van de wet af te wijken. Daarvan zou sprake kunnen zijn indien in vergelijkbare gevallen stelselmatig daarvan wordt afgeweken. Dat geïntimeerde dat heeft gedaan in andere gevallen dan de vijf in het Landsbesluit houdende algemene maatregelen ambtelijke pensioengrondslag geregelde gevallen, is niet aannemelijk geworden. Integendeel, ambtshalve is de Raad bekend dat in andere gevallen de 25%-toelage niet bij vaststelling van de pensioengrondslag is betrokken. Geïntimeerde kon dus weigeren de door appellant ontvangen 25%-toelage bij vaststelling van de pensioengrondslag te betrekken.

Het vorenstaande leidt tot de conclusie dat de aangevallen uitspraak moet worden bevestigd.


4. Beslissing

De Raad van Beroep:

- bevestigt de bestreden uitspraak.

1. Origin and course of the proceedings.

On October 6, 2006 appellant has lodged an objection with the court in civil matters (hereinafter the Court) against the Decree of June 27, 2006, No. 10. By decision of 13 December 2006, the Court dismissed the objection.

2. Facts.

Appellant is the Decree of October 13, 1987 appointed head of the Prisons and the prison in scale 13. Article 6 prohibits PLD, in the opinion of the Council against the appellant enjoyed by personal allowance when calculating his pension making process, even when account is taken of his argument regarding the grounds for grant of personal allowance. A basis for granting the pension benefits received by the appellant is therefore missing.

There is no evidence that the respondent in cases where the pension is determined by an official that a 25% allowance has enjoyed such a degree deviates from the PLD certain that in the case of the appellant not to its provisions could be retained . Only under exceptional circumstances, respondent is obliged to under the general principles of proper administration of the law to the contrary. Of them could exist if in similar cases systematically from them. That the respondent has done in other cases than the five in the National Decree containing general measures official regular pension cases, is not plausible. On the contrary, ex officio Council is aware that in other cases the 25% allowance is not in the determination of pensionable salary is concerned. Respondent to refuse the appellant could receive a 25% allowance in the determination of pensionable making.

tegen de uitspraak van het Gerecht in eerste aanleg van Aruba van 9 januari 2008 in het geding tussen:

de naamloze vennootschap "Associated Transport Co. Aruba N.V.", gevestigd in Aruba,

en

appellant.

1. Procesverloop

Bij brief van 8 maart 2006 heeft de naamloze vennootschap "Associated Transport Co. Aruba N.V." (hierna: ATCO) appellant (hierna: de minister) verzocht:
"een deel van de subsidie, die aan de door onze onderneming   behandelde klanten ten deel dient te vallen, aan onze onderneming te doen uitbetalen tegen hetzelfde tarief van Afl. 20,- per adres per   maand, tot het moment dat Serlimar haar cliënten zal gaan belasten en vervolgens tegen het tarief van Afl. 20,- minus het door Serlimar in rekening gebrachte tarief."

Bij brief van 18 april 2006 heeft de minister dat verzoek afgewezen.

Bij beschikking van 12 oktober 2006 heeft de minister het door ATCO daartegen gemaakte bezwaar ongegrond verklaard.

Bij uitspraak van 9 januari 2008 heeft het Gerecht in eerste aanleg van Aruba (hierna: het Gerecht) het door ATCO daartegen ingestelde beroep gegrond verklaard, die beschikking vernietigd en bepaald dat de minister opnieuw op het door ATCO gemaakte bezwaar beslist met inachtneming van hetgeen in de uitspraak is overwogen.

Bij brief, bij het Gerecht ingekomen op 19 februari 2008, heeft de minister tegen die uitspraak hoger beroep ingesteld bij het Hof.

Bij brief van 28 maart 2008 heeft ATCO een verweerschrift ingediend.

Het Hof heeft de zaak ter zitting behandeld op 17 april 2007 waar de minister, vertegenwoordigd door mr. P.A.P.J. van der Sloot en mr. A.A.D.A. Carlo, beiden advocaat, en ATCO, vertegenwoordigd door
mr. R.T.J.M. Oomen, advocaat, zijn verschenen.

2. Overwegingen

2.1. De Servicio di Limpiesa di Aruba (hierna: Serlimar) is bij artikel 2, eerste lid, van de Landsverordening instelling Servicio di Limpiesa di Aruba (hierna: de Landsverordening instelling Serlimar) ingesteld en belast met de inzameling en verwerking op een efficiënte wijze en overeenkomstig de daarvoor geldende milieunormen van afval in vaste of vloeibare vorm, afkomstig van particuliere huishoudens en bedrijven, alsmede met het onderhoud van domeingronden en plantsoenen rondom overheidsgebouwen, en van openbare wegen en stranden.
Ingevolge het derde lid van dat artikel heeft Serlimar rechtspersoonlijkheid.
Ingevolge artikel 8, eerste lid, heft Serlimar per ophaalpunt een bedrag als vergoeding voor het ophalen en verwerken van huishoudelijk afval. Onder ophaalpunt wordt verstaan een woning op een perceel of elke afzonderlijke wooneenheid op een perceel, dat krachtens een zakelijk recht, vruchtgebruik of een persoonlijk recht wordt bewoond. Een ieder, op wiens naam het zakelijk recht of vruchtgebruik, bedoeld in de tweede volzin, is gesteld, is verplicht het krachtens de eerste volzin verschuldigde bedrag te betalen.

Ingevolge artikel 1, eerste lid, van de Subsidieverordening instellingen van openbaar nut (hierna: de Subsidieverordening) wordt in deze landsverordening onder "subsidie" verstaan de overdracht om niet van landsgelden door of namens een minister aan een derde, in het kader van het verrichten door deze derde van een taak die door de overheid had behoren te worden verricht.
Ingevolge artikel 2, aanhef en onder a, wordt subsidie uitsluitend verleend met inachtneming van de voorschriften van deze landsverordening, voor zover het betreft rechtspersoonlijkheid bezittende instellingen die blijkens hun statuten een algemeen belang nastreven. 

2.2. De minister betoogt onder meer dat het Gerecht heeft miskend dat de brief van 18 april 2006 geen beschikking behelst. De vergoedingen die per ophaalpunt aan Serlimar worden toegekend, zijn geen subsidie, zodat het verzoek van ATCO geen verzoek om subsidie is. De afwijzing van dat verzoek is daarom geen beschikking, aldus de minister.

2.2.1. Dat betoog slaagt. Ingevolge voormeld artikel 2, derde lid, van de Landsverordening instelling Serlimar heeft Serlimar rechtspersoonlijkheid. Voorts is ingevolge artikel 2, eerste lid van die landsverordening aan Serlimar het inzamelen en verwerken van afval opgedragen. Aldus is Serlimar een verzelfstandigde dienst die een door de overheid aan zich getrokken taak vervult, het ophalen en verwerken van afval. Dat, als gesteld, ook ATCO zich met het ophalen en verwerken van afval bezighoudt, maakt dat niet anders.
Serlimar is onder die omstandigheden geen derde, als bedoeld in artikel 1 van de Subsidieverordening en het toekennen van vergoedingen per ophaalpunt aan haar is geen verlening van subsidie, doch verstrekking van financiële middelen aan een rechtspersoon die krachtens publiekrecht is ingesteld.
Het verzoek van ATCO strekt dan ook niet tot toekenning van subsidie. Nu dat verzoek evenmin de uitoefening van enige andere bestuurlijke bevoegdheid betreft, is afwijzing ervan niet op enig publiekrechtelijk rechtsgevolg gericht. De minister heeft het door ATCO gemaakte bezwaar dan ook ten onrechte niet niet-ontvankelijk verklaard als niet tegen enige beschikking gericht.

2.3. Het hoger beroep is reeds hierom gegrond. Hetgeen verder in hoger beroep is aangevoerd, behoeft geen bespreking. De aangevallen uitspraak dient te worden vernietigd. Doende hetgeen het Gerecht had behoren te doen, zal het Hof het door ATCO ingestelde beroep gegrond verklaren en de beschikking van 12 oktober 2006 vernietigen. Nu de minister het door ATCO gemaakte bezwaar met inachtneming van hetgeen in deze uitspraak is overwogen slechts niet-ontvankelijk mag verklaren, ziet het Hof aanleiding om op na te melden wijze zelf in de zaak te voorzien.

2.4. De minister dient op na te melden wijze in de proceskosten te worden verwezen.


3. Beslissing

Het Gemeenschappelijk Hof van Justitie van de Nederlandse Antillen en Aruba

Recht doende in naam der Koningin:

I. verklaart het hoger beroep gegrond;
II. vernietigt de uitspraak van het Gerecht in eerste aanleg van Aruba van 9 januari 2008 in zaak nr. Lar 3324 van 2006;
III. verklaart het bij het Gerecht in die zaak ingestelde beroep tegen de beschikking van de minister van Volksgezondheid, Milieu, Administratieve en Vreemdelingenzaken van 12 oktober 2006, kenmerk 2428geh, gegrond;
IV. vernietigt die beschikking;
V. verklaart het door ATCO tegen de brief van 18 april 2006 gemaakte bezwaar niet ontvankelijk;
VI. bepaalt dat deze uitspraak in zoverre in de plaats treedt van de vernietigde beschikking;
VII. veroordeelt de minister van Volksgezondheid, Milieu, Administratieve en Vreemdelingenzaken tot vergoeding van de bij de naamloze vennootschap "Associated Transport Co. Aruba N.V."
in verband met de behandeling van het beroep opgekomen proceskosten tot een bedrag van Naf. 1400,00
(zegge: duizend vierhonderd gulden), geheel toe te rekenen aan door een derde verleende rechtsbijstand; dit bedrag dient door de minister van Volksgezondheid, Milieu, Administratieve en Vreemdelingenzaken aan de naamloze vennootschap "Associated Transport Co. Aruba N.V." te worden betaald;
VIII. gelast dat het Land Aruba aan de naamloze vennootschap "Associated Transport Co. Aruba N.V." het door haar voor de behandeling van het beroep betaalde griffierecht ten bedrage van Afl. 25.00 (zegge: vijfentwintig gulden) teruggeeft;

1. Proceedings

By letter dated 8 March 2006, the corporation "Associated Transport Co.. Aruba NV (hereinafter: ATCO) appellant (hereinafter the Minister) asked:
"Part of the grant, which the company granted by our clients to participate should be subject to our company do pay the same rate of Afl. 20, - per visit per month, until the time that its clients will Serlimar and then charge at the rate of Afl. 20, - minus the price charged by Serlimar. "

By letter dated April 18, 2006, the Minister rejected the claim.

By order of October 12, 2006, the Minister by ATCO objection made against unfounded.

2. Considerations

2.1. The Limpiesa Servicio di di Aruba (hereinafter Serlimar), Article 2, first paragraph of the Ordinance setting Limpiesa Servicio di di Aruba ("the Ordinance setting Serlimar) established and charged with the collection and processing in an efficient manner and in accordance the relevant environmental standards of waste in solid or liquid form, from private households and businesses, as well as maintenance of grounds and gardens area around government buildings, public roads and beaches.

2.2. The Minister argues inter alia that the Court failed to recognize that the letter of April 18, 2006 decision not substance. The fees per collection point Serlimar are awarded, no subsidy, so the request by ATCO no request for subsidy. The rejection of that request is therefore not a decision, he said.

2.2.1. That argument fails. Under that article 2, third paragraph of the Ordinance setting Serlimar Serlimar has legal personality. Furthermore, Article 2, first paragraph of this Ordinance to Serlimar collection and processing of waste assigned. Thus Serlimar an autonomous entity which is pulled by the government to task, the collection and processing of waste. That, as mentioned, also ATCO themselves with the collection and processing of waste involved, is no different.
Serlimar third under those circumstances not provided for in Article 1 of the Subsidy and awarding compensation for each collection point to it not to grant subsidy, but provision of financial resources to a legal person under public law established.
The request by ATCO therefore not intended to grant a subsidy. Now that request nor the exercise of any other administrative powers, rejection is not directed at any public law legal. The minister has made objections by ATCO therefore erred in not inadmissible as not directed against any decision.

2.3. The appeal has been so successful. Which further appeal was argued, needs no discussion.Attacked the decision must be annulled. Doing what the Court ought to do so, the Court upheld the action brought by ATCO and declare the decision of October 12, 2006 destruction. As the Minister made by ATCO objection subject to the provisions of this statement is only considered inadmissible may declare, that the Court saw reason to sign up after themselves in the manner provided case.

2.4. The Minister should report to the manner in proceedings to be ordered.

3. Decision

The Common Court of Justice of the Netherlands Antilles and Aruba

I. explains the appeal is well founded;
II. destroys the ruling of the Court of First Instance of Aruba on January 9, 2008 in Case No. 3324 of 2006 Lar;

1. Het verloop van de procedure

1.1 Op 25 juni 2009 heeft het Gerecht in eerste aanleg van Aruba (hierna te noemen “GEA”) tussen [appellant] als verzoeker en [geintimeerde] en [J.L.] (hierna: [J.L.]) een beschikking gegeven. Voor hetgeen in eerste aanleg is gesteld en verzocht, de procesgang aldaar en de overwegingen en beslissingen van het GEA wordt verwezen naar die beschikking.

1.2 [appellant] is van de beschikking in hoger beroep gekomen door op 3 augustus 2009 een beroepschrift in te dienen. Zijn conclusie strekt ertoe dat het Hof, met vernietiging van de beschikking, het verzoek tot ontslag van [geintimeerde] en [J.L.] alsnog zal toewijzen, met veroordeling van [geintimeerde] en [J.L.] in de kosten van beide instanties.

1.3 [geintimeerde] en [J.L.] hebben gezamenlijk een verweerschrift ingediend, strekkende tot bevestiging van de bestreden beschikking, met veroordeling van [appellant] in de proceskosten.

1.4 Het hoger beroep is, ten overstaan van een lid van het Hof, behandeld ter terechtzitting van 27 november 2009. Bij die gelegenheid heeft [appellant] het verzoek tot ontslag van [J.L.] ingetrokken en heeft [J.L.] met die intrekking ingestemd. [appellant] en [geintimeerde] hebben hun standpunten aan de hand van pleitaantekeningen nader toegelicht. De zaak is verwezen naar de rol van 19 januari 2010 voor uitlating voortprocederen. Daarop is door [appellant] een akte uitlating genomen waarbij om een beslissing is verzocht. [geintimeerde] heeft zich niet meer uitgelaten.

1.5 Beschikking is bepaald op heden.


2. De beoordeling

2.1 Gelet op de intrekking van het verzoek tot ontslag van [J.L.], richt het hoger beroep zich nog uitsluitend op de beoordeling van het verzoek tot ontslag van [geintimeerde] als bestuurder van de stichting “Elias Mansur Sport Stichting” (hierna: de stichting).

2.2 Het verweer van [geintimeerde] dat artikel 12 van de Landsverordening op stichtingen (Lvos) de rechter alleen bevoegdheid geeft een geheel bestuur, en dus niet een individuele bestuurder, te ontslaan, heeft het GEA terecht verworpen. Het Hof volgt [appellant] in zijn lezing dat geen bijzondere betekenis kan worden gehecht aan het gegeven dat bij de omzetting van Nederlands-Antilliaanse Landsverordening op stichtingen (P.B. 1967, 191) in de Arubaanse Lvos het woord “bestuurder” is gewijzigd in “bestuur”. Gelet op het bepaalde in de Algemene overgangsregeling wetgeving en bestuur (AB 1987, no. GT 2, hierna: Aowb), op grond waarvan de tekst van de Lvos is vastgesteld, vinden in de tekst van de regelingen die ingevolge artikel 4 Aowb de staat van landsverordening van Aruba verkrijgen alleen die aanpassingen plaats die met toepassing van de volgende leden van dat artikel noodzakelijk zijn als gevolg van het verkrijgen van die nieuwe hoedanigheid. Inhoudelijke wijzigingen zijn daarbij niet beoogd. Overigens brengt ook gelet op de aard van de regeling van art. 12 Lvos, die beoogt een zekere mate van toezicht mogelijk te maken op de bestuurders van een stichting (waar dit toezicht op de bestuurders van een dergelijke rechtspersoon niet op andere wijze in de wet is geregeld), een redelijke wetsuitleg met zich dat ingeval sprake is van disfunctioneren in de zin van art. 12 Lvos van een of meer individuele bestuursleden van een stichting, de rechter bevoegd is die individuele bestuursleden te ontslaan. Bovendien geldt in dit geval dat de statuten van de stichting zelf een regeling bevatten waarbij is bepaald het lidmaatschap van het bestuur kan eindigen door ontslag door de rechter.

2.3 Bij de vraag of de rechter van de bevoegdheid tot ontslag van een stichtingsbestuurder in een concreet geval gebruik dient te maken, moet niet alleen worden beoordeeld of zich een of meer van de in art. 12 onder a en b Lvos genoemde omstandigheden voordoen maar dienen ook alle overige omstandigheden van het geval bij de beoordeling te worden betrokken. Zo kunnen onder meer de aard en de ernst van het aan de bestuurder verweten handelen of nalaten een rol spelen alsmede de binnen een stichting heersende bestuurscultuur.

2.4 De verwijten die aan [geintimeerde] worden gemaakt zijn, naar het Hof begrijpt:
a. [geintimeerde] heeft goedgevonden dat [J.L.] onbevoegd namens de stichting huurcontracten heeft ondertekend;
b. [geintimeerde] en [J.L.] hebben nimmer verantwoording afgelegd over de inkomsten van en het beheer over het stadion;
c. [geintimeerde] en [J.L.] hebben het stadion slecht (laten) onderhouden;
d. [geintimeerde] heeft onvoldoende notulen opgemaakt en/of niet alle notulen in afschrift aan de overige bestuursleden verstrekt.

2.5 Ten aanzien van de verwijten onder a en b heeft [appellant], ook tegenover de betwisting door [geintimeerde], onvoldoende gemotiveerd en (feitelijk) onderbouwd in welke opzicht [geintimeerde] in strijd met de wet of statuten heeft gehandeld of zich schuldig heeft gemaakt aan wanbeheer. Dat geldt ook voor het verwijt onder c. De exploitatie van het stadion is een verantwoordelijkheid van het gehele bestuur en in welk opzicht [geintimeerde] ten aanzien van de staat van het onderhoud van het stadion een persoonlijk verwijt kan worden gemaakt, is onvoldoende gebleken. Aan deze verwijten gaat het Hof daarom voorbij.

2.6 Dat het notuleren en het verstrekken van afschriften van notulen niet geheel volgens de statuten is verlopen, staat vast. Met het GEA is het Hof evenwel van oordeel dat dit enkele gegeven niet het ontslag van [geintimeerde] rechtvaardigt. Het Hof verenigt zich met hetgeen het GEA daarover heeft overwogen. Dat door andere bestuursleden, waaronder de voorzitter, tegen het handelen of nalaten van [geintimeerde] ten aanzien van de notulen van bestuursvergaderingen in het verleden nimmer is geprotesteerd, heeft het GEA daarbij terecht als een factor van belang laten meewegen. De stelling in hoger beroep dat [geintimeerde] opzettelijk de rechten van [appellant] op inzage in de notulen zou hebben gefrustreerd, heeft [appellant] onvoldoende onderbouwd. Ook voor het overige is in hoger beroep niets (nieuws) aangevoerd dat tot een andere conclusie zou moeten leiden. Daarbij merkt het Hof op dat [appellant] het blijkens de pleitaantekeningen in hoger beroep nieuw aangevoerde verwijt dat [geintimeerde] zou hebben nagelaten ten spoedigste een bestuursvergadering bijeen te roepen om in de vacature als gevolg van het vertrek van [J.L.] te voorzien, ter zitting heeft laten vallen nu ook hij van mening was dat van [geintimeerde] niet kan worden verlangd een bestuursvergadering bijeen te roepen terwijl een bodemprocedure aanhangig is over de vraag wie nu eigenlijk als bestuursleden moeten worden aangemerkt. Dit verwijt behoeft dus geen bespreking meer.

2.7 Dit alles betekent dat het GEA het verzoek tot ontslag van [geintimeerde] als bestuurder van de stichting terecht heeft afgewezen. De bestreden beschikking zal worden bevestigd. [appellant] zal als de in het ongelijk gestelde partij in de kosten van het hoger beroep worden veroordeeld. Hoewel het verzoek jegens [J.L.] eerst is ingetrokken nadat door [J.L.] reeds proceshandelingen waren verricht, ziet het Hof geen aanleiding voor een proceskostenveroordeling ten gunste van [J.L.] nu niet is gebleken dat door [J.L.], die door dezelfde gemachtigden is bijgestaan als [geintimeerde], afzonderlijk kosten zijn gemaakt. Wel ziet het Hof aanleiding om de proceskostenveroordeling uitvoerbaar bij voorraad te verklaren.


BESLISSING

Het Hof:

bevestigt de bestreden beschikking;

veroordeelt [appellant] in de kosten van het hoger beroep aan de zijde van [geintimeerde] gevallen en tot op heden begroot op Afl. 5.100,-- aan gemachtigdensalaris;

verklaart deze proceskostenveroordeling uitvoerbaar bij voorraad.

1. The course of the proceedings

1.1 On June 25, 2009, the Court of First Instance of Aruba (hereinafter "CFI") between [appellant] as the applicant and [RESPONDENT] and [JL] (hereinafter [JL]) a decision. 2. The assessment

2.1 Given the withdrawal of the request for dismissal of [JL], the appeal is still focused exclusively on the assessment of the request to dismiss [RESPONDENT] as director of the foundation "Mansur Elias Sports Foundation" (hereinafter: the foundation ).

2.2 The defense [RESPONDENT] that Article 12 of the Ordinance on Foundations (Lvos) empowers a court only the whole government, not an individual driver to dismiss, the CFI has rightly rejected. 1. Procesverloop

Bij onderscheiden beschikkingen van 31 augustus 2005 heeft de Procureur Generaal (hierna: de PG) de uitzetting van appellante bevolen en met het oog hierop haar inbewaringstelling gelast.

Bij beschikking van 12 juni 2006 heeft de Advocaat-Generaal (hierna: de AG) de daartegen door appellante gemaakte bezwaren namens de PG ongegrond verklaard.

Bij uitspraak van 27 september 2006 heeft het Gerecht in eerste aanleg van Aruba (hierna: het Gerecht) het daartegen door appellante ingestelde beroep ongegrond verklaard.

Tegen deze uitspraak heeft appellante bij brief, bij het Gerecht ingekomen op 7 november 2006, hoger beroep ingesteld.

Bij brief, ingekomen op 23 januari 2007, heeft de PG van antwoord gediend.

Het Hof heeft de zaak ter zitting behandeld op 26 maart 2007, waar appellante in persoon, bijgestaan door mrs. P.A.P.J. van der Sloot en A.A.D.A. Carlo, beiden advocaat, en de AG mr. N. Jörg zijn verschenen.
 
2. Overwegingen
2.1. Ingevolge artikel 1, eerste lid, aanhef en onder d, van de Landsverordening toelating en uitzetting, zoals die ten tijde van belang luidde (hierna: de LTU), is deze, met uitzondering van de bepalingen van de artikelen 22 tot en met 25, niet van toepassing op de buiten Aruba geboren leden van het wettig gezin van de op het eiland Aruba geboren man van Nederlandse nationaliteit.
Ingevolge het tweede lid, voor zover thans van belang, wordt in deze landsverordening onder wettig gezin de niet van tafel en bed gescheiden echtgenote verstaan.
Ingevolge artikel 15, eerste lid, aanhef en onder b, kunnen personen worden uitgezet, voor wie ingevolge deze landsverordening toelating is vereist en wier verblijf met het oog op de zedelijkheid, de openbare orde of de publieke rust of veiligheid niet wenselijk wordt geacht.
 
Ingevolge artikel 1:71a van het Burgerlijk Wetboek (hierna: BW) kan een huwelijk op vordering van het openbaar ministerie als schijnhandeling wegens strijd met de Arubaanse openbare orde worden nietig verklaard, indien het oogmerk van de echtgenoten, of één hunner, niet was gericht op de vervulling van de door de wet aan de huwelijkse staat verbonden plichten, doch op het verkrijgen van toelating tot Aruba.

2.2. Appellante klaagt dat het Gerecht ten onrechte niet zelf heeft onderzocht, of haar huwelijk met de in Aruba geboren Nederlander [de man] een schijnhuwelijk is en heeft miskend dat zij echtgenote is in de zin van artikel 1, tweede lid, van de LTU.

2.2.1. De klacht faalt. Het was niet de taak van het Gerecht om de uitvoering van de LTU maar aanleiding van het ingestelde beroep zelf ter hand te nemen, doch om de uitvoering door het bestuur op rechtmatigheid te toetsen.
De Ambtenaar van het Bevolkingsregister heeft voorts bij beschikking van 24 september 2004 geweigerd om het in Colombia gesloten huwelijk van haar met [de man] in het bevolkingsregister van Aruba in te schrijven, omdat het een schijnhuwelijk is. Die beschikking is gebaseerd op het oordeel dat het oogmerk van appellante en [de man], of één hunner, niet op de vervulling van de door de wet aan de huwelijkse staat verbonden plichten was gericht, doch op het verkrijgen van toelating tot Aruba. Nu appellante tegen die beschikking geen rechtsmiddel heeft aangewend, mocht de PG van de juistheid van die beschikking uitgaan. Dat zou anders zijn, indien de PG reden had om aan te nemen dat de beschikking op een feitelijke of juridische misslag berust, dan wel zodanig nieuwe feiten en omstandigheden zijn gebleken, dat aannemelijk is dat de Ambtenaar van het Bevolkingsregister, waren deze hem bekend geweest, tot een ander oordeel zou zijn gekomen. Dat is gesteld noch gebleken.

2.3. Voorts klaagt appellante dat het Gerecht heeft miskend dat de PG geen gebruik heeft kunnen maken van de bevoegdheid haar uit te zetten, nu zij [de man] heeft te verzorgen.

2.3.1. Deze klacht faalt evenzeer. Het is aan de PG om te beoordelen of een niet toegelaten vreemdeling, als appellante is, voor uitzetting met toepassing van artikel 15, eerste lid, aanhef en onder b, van de LTU in aanmerking komt. Van klemmende redenen van humanitaire aard, in verband waarmee moet worden geoordeeld dat de PG ten aanzien van appellante in redelijkheid geen gebruik kon maken van deze bevoegdheid, is niet gebleken. Dat appellante, naar zij stelt, [de man] moet verzorgen, levert zodanige reden niet op, reeds omdat appellante niet hier te lande mag verblijven en ook niet om toelating al dan niet in verband daarmee heeft verzocht.

2.4. Tot slot klaagt appellante dat ingevolge artikel VI van de verordening tot wijziging van de LTU (A.B. 2006, no. 30) artikel 15, derde lid, van de thans geldende tekst van de LTU op haar van toepassing is, nu zij met toepassing daarvan instemt, waardoor in de uitzettingsbeschikking van 31 augustus 2005 haar toelating tot Aruba ten onrechte voor onbepaalde tijd is geweigerd.

2.4.1. Nu appellante dit voor het eerst ter zitting in hoger beroep heeft aangevoerd en het aangevoerde verder strekt, dan dat het Gerecht de rechtsgronden ten onrechte niet ambtshalve heeft aangevuld, zal het Hof hieraan voorbij moeten gaan.

2.5. Het hoger beroep is ongegrond. De aangevallen uitspraak dient te worden bevestigd.

2.6. De PG heeft het Hof nog verzocht de schorsing door het Gerecht van de beschikkingen van 31 augustus 2005 op te heffen.

2.6.1. In de Landsverordening administratieve rechtspraak (hierna: de Lar) is niet bepaald, wanneer een door het Gerecht getroffen voorlopige voorziening, als in dit geval de schorsing, vervalt. Evenmin is voorzien in de mogelijkheid om het Hof, hangende het hoger beroep, te verzoeken een door het Gerecht getroffen voorlopige voorziening ongedaan te maken. Uit het systeem van de Lar leidt het Hof evenwel af dat een door het Gerecht getroffen voorlopige voorziening vervalt, zodra het in het bodemgeschil bij uitspraak op het beroep heeft beslist, voor zover in de beslissing van het Gerecht geen eerder tijdstip is bepaald. Verder brengt redelijke toepassing van de Lar mee dat hoofdstuk V, dat bepalingen bevat omtrent schorsing en voorlopige voorziening, in hoger beroep van overeenkomstige toepassing is.

2.6.2. Het voorgaande betekent dat de schorsing van de beschikkingen van 31 augustus 2005 tot uitzetting en inbewaringstelling door het Gerecht bij uitspraak van 19 oktober 2005 van rechtswege is vervallen toen het de uitspraak van 27 september 2006 deed, zodat de PG geen belang heeft bij het gedane verzoek en het deswege dient te worden afgewezen.

2.7. Voor een proceskostenveroordeling bestaat geen grond.


3. Beslissing

Het Gemeenschappelijk Hof van Justitie van de Nederlandse Antillen en Aruba

Recht doende in naam der Koningin:

I. bevestigt de aangevallen uitspraak;
II. wijst het verzoek van de PG om opheffing van de schorsing door het Gerecht van de beschikkingen van 31 augustus 2005 af.

2. Considerations
2.1. Under Article 1, first paragraph, heading and d, admission and expulsion of the Ordinance, as it was at the relevant time (hereinafter: the LTU), this, except the provisions of Articles 22 to 25, not apply to the outside Aruba born members of the legitimate family of the man born on the island of Aruba a Dutch national.
Following the second paragraph, if of any interest in this Ordinance under the legal family is not legally separated spouse.
Under Article 15, first paragraph, heading and b, may be expelled persons to whom permission is required under this ordinance and whose residence for the purpose of morality, public order or public peace or safety is not considered appropriate.
 
Pursuant to article 1:71 a of the Civil Code (hereinafter CC), a marriage at the request of the prosecution as a sham transaction because of conflict with the Aruban public order be annulled if the purpose of the spouses or one of them, not focused the fulfillment of the law duties associated with marriage, but to obtain admission to Aruba.

2.2. Appellant complains that the Court was wrong not to examine themselves, their marriage in Aruba, Dutch [man] a sham marriage and failed to recognize that spouse within the meaning of Article 1, second paragraph of the LTU.

2.2.1. The complaint fails. It was not for the Court to implement the LTU, but following the appeal itself to grab, but the execution by the board to review legality.
Officer of the Population has also, by order of September 24, 2004 refused the marriage in Colombia with her [the husband] in the population of Aruba to register because it is a sham marriage. That decision is based on the view that the intention of the appellant and [the husband], or one of them, not the fulfillment of the law obligations associated with marriage was addressed, but to obtain admission to Aruba. Now the appellant against the decision not legal remedies, if the PG of the correctness of that decision out. That would be different if the PG had reason to believe that the decision on a mistake of fact or law or does such new facts and circumstances have proved that it is plausible that the officials of the people, that he had been known to a different conclusion would have been. This is neither alleged nor proved.

2.3. Moreover, appellant complains that the Court failed to recognize that the PG did not use to exercise the power to deport her, now they [the husband] has to care.

2.3.1. The complaint also fails. It is in the PG to assess whether an unauthorized alien, as appellant, for expulsion pursuant to Article 15, first paragraph, heading and b of the LTU is eligible. Of compelling humanitarian reasons, on which must be considered that the PG in relation to the appellant reasonably could not make use of that power, has not disclosed. That the appellant, it claims to [the husband] should care, so why does not, because appellant has not this country should stay and not leave or not requested in connection therewith.

2.4. Finally, appellant complains that Article VI of the Regulation amending the LTU (AB 2006, No. 30) Article 15, third paragraph, of the current text of the LTU applicable to her, now she agrees with their application which the expulsion order of August 31, 2005 her admission to Aruba wrongly been denied indefinitely.

2.4.1. Now the appellant was first hearing the appeal, arguing it relied more exhausted than the legal grounds that the Court erred in not officially issued, the Court will have to forego them.

2.5. The appeal is unfounded. Attacked the decision must be confirmed.

2.6. The PG, the Court has requested the suspension by the Court of the decisions of 31 August 2005 to lift.

2.6.1. The Administrative Procedure Ordinance (hereinafter: the Lar) was not determined if one adopted by the Court injunction, as in this case the suspension expires. Nor has the possibility of the Court, pending the appeal, to request the Court made an interim correction. The system leads the Lar however, the Court concludes that the Court made an interim injunction is void if it is in the land dispute by ruling on the appeal by deciding where in the decision of the tribunal earlier states. Furthermore, just reasonable application of Lar that Chapter V, which contains provisions on interim suspension and, on appeal shall apply.

2.6.2. All this means that the suspension of the decisions of August 31, 2005 deportation and detention of the Court by order of October 19, 2005 is legally void when the ruling of September 27, 2006 did, so the PG has no interest in the request made and they call must be rejected.

2.7. For an order for costs is no reason.


3. Decision

De beoordeling of (vervolgens) de uitlevering i.v.m. een lopende strafvervolging niet kan worden toegestaan, komt toe aan de Minister van Justitie (HR NJ 1981, 318 en HR LJN AZ1984. Gelet hierop komt i.c. het oordeel toe aan de Gouverneur. Opmerking verdient dat de stelling dat een voorlopig gestaakte vervolging een uitleveringsbeletsel oplevert i.d.z.v. art. 5 NAUB gelet op de wetsgeschiedenis genoemd in de conclusie AG en op art. 9b Uw onjuist is.

Arrest

op het beroep in cassatie tegen een einduitspraak van het Gemeenschappelijk Hof van Justitie van de Nederlandse Antillen en Aruba van 5 juni 2007, nummer H-72/2007, op een verzoek van de autoriteiten van de Verenigde Staten van Amerika tot uitlevering van:
[verdachte], geboren in de [geboorteplaats] op [geboortedatum], ten tijde van de betekening van de aanzegging gedetineerd in het "Korrektie Instituut Aruba" op Aruba (Nederlandse Antillen).

1. Geding in cassatie

1.1. Het beroep is ingesteld door de opgeëiste persoon. Namens deze heeft mr. P.A.P.J. van derSloot, advocaat te Oranjestad (Aruba), bij schriftuur een middel van cassatie voorgesteld. De schriftuur is aan dit arrest gehecht en maakt daarvan deel uit.
De Advocaat-Generaal Vellinga heeft geconcludeerd dat de opgeëiste persoon niet-ontvankelijk wordt verklaard in haar cassatieberoep voor zover dat beroep niet is gericht tegen de beslissingen van het Hof inzake de toelaatbaarheid van de uitlevering en tot verwerping van het beroep voor het overige.

1.2. De Hoge Raad heeft kennisgenomen van het schriftelijk commentaar van de raadsman op de conclusie van de Advocaat-Generaal.

2. Beoordeling van de ontvankelijkheid van het beroep

2.1. Ingevolge art. 2, eerste lid, van de Cassatieregeling in uitleveringszaken voor de Nederlandse Antillen en Aruba neemt de Hoge Raad in uitleveringszaken kennis van het beroep in cassatie tegen de einduitspraken van het Gemeenschappelijk Hof ingesteld door de procureur-generaal van een van de landen of door de opgeëiste persoon. Op grond van art. 1 van die Cassatieregeling moet onder "einduitspraak" worden verstaan: het advies van het Gemeenschappelijk Hof, bedoeld in artikel 8, tweede lid, van het Nederlands-Antilliaanse Uitleveringsbesluit (NAUB) (Pb. 1983, 84), voor zover dit advies betreft de toelaatbaarheid van de uitlevering en de afgifte dan wel teruggave van inbeslaggenomen voorwerpen.

2.2. Uit het vorenoverwogene vloeit voort dat de opgeëiste persoon niet kan worden ontvangen in haar cassatieberoep voor zover dat beroep zich niet richt tegen de beslissingen van het Gemeenschappelijk Hof inzake de toelaatbaarheid van de uitlevering. Dat brengt mee dat het middel onbesproken moet blijven voor zover daarin wordt geklaagd dat het Hof in zijn advies de voor de beslissing van de Gouverneur relevante punten ten aanzien van de op Aruba aangevangen (maar gestaakte) vervolging tegen de opgeëiste persoon had moeten opnemen en voor zover daarin wordt geklaagd over het ontbreken van een advies van het Gemeenschappelijk Hof aan de Gouverneur om de gevraagde uitlevering uit hoofde van het belang van een goede rechtsbedeling te weigeren (vgl. HR
3 juni 2008, LJN BD1833).

3. Beoordeling van het middel

3.1. Het middel behelst onder meer de klacht dat het Hof, gelet op de tegen de opgeëiste persoon in Aruba aangevangen vervolging, ten onrechte ervan is uitgegaan dat het ne bis in idem beginsel in acht genomen is.

3.2. De bestreden einduitspraak houdt, voor zover voor de beoordeling van deze klacht van belang, het volgende in:
"11. Ne bis in idem
Conform artikel 5 van het Uitleveringsverdrag wordt uitlevering niet toegestaan wanneer de opgeëiste persoon door de aangezochte staat ter zake van het feit waarvoor uitlevering wordt verzocht wordt vervolgd, vervolgd is geweest of is berecht en veroordeeld of vrijgesproken. Ter zitting heeft de procureur-generaal verklaard dat de vervolging in Aruba weliswaar was aangevangen, maar is gestaakt en slechts dan zal worden hervat indien geen uitlevering plaats vindt. Aan het genoemde verdragsvereiste is daardoor voldaan."

3.3. Art. 5 van het Uitleveringsverdrag tussen het Koninkrijk der Nederlanden en de Verenigde Staten van Amerika (Trb. 1980, 111) (hierna: het Verdrag) luidt als volgt:
"Uitlevering wordt niet toegestaan wanneer:
a. de opgeëiste persoon door de aangezochte Staat ter zake van het feit waarvoor uitlevering wordt verzocht wordt vervolgd, vervolgd is geweest, of is berecht en veroordeeld of vrijgesproken; of
b. uit anderen hoofde tegen de opgeëiste persoon geen vervolging kan worden ingesteld ter zake van het feit waarvoor uitlevering wordt verzocht, krachtens het recht in de aangezochte Staat met betrekking tot het effect van een voorafgaande strafvervolging."

3.4. Het NAUB kent, afgezien van het in art. 5 geregelde geval van verjaring van de misdrijven waarvoor de uitlevering wordt gevraagd, niet een bepaling als art. 9 Uitleveringswet (hierna: Uw). Art. 9 Uw luidt als volgt:
"1. Uitlevering van de opgeëiste persoon wordt niet toegestaan voor een feit terzake waarvan:
a. ten tijde van de beslissing op het verzoek tot uitlevering een strafvervolging in Nederland tegen hem gaande is;
b. hij in Nederland is vervolgd maar hernieuwde vervolging is uitgesloten op grond van artikel 255, eerste of tweede lid, of artikel 255a, eerste of tweede lid, van het Wetboek van Strafvordering;
c. hij bij gewijsde van de Nederlandse rechter is vrijgesproken of ontslagen van rechtsvervolging, dan wel te zijnen aanzien een overeenkomstige onherroepelijke beslissing door een andere rechter is genomen;
d. hij bij rechterlijk gewijsde is veroordeeld, in gevallen waarin:
1. de opgelegde straf of maatregel reeds is ondergaan, of
2. die straf of maatregel niet voor onmiddellijke tenuitvoerlegging of verdere tenuitvoerlegging vatbaar is, of
3. de veroordeling een schuldigverklaring zonder oplegging van straf of maatregel inhoudt, dan wel
4. het gewijsde afkomstig is van de Nederlandse rechter en niet bij verdrag voor zodanig geval de bevoegdheid tot uitlevering is voorbehouden;
e. naar Nederlands recht wegens verjaring geen vervolging, of, zo de uitlevering is gevraagd ten behoeve van de tenuitvoerlegging van een straf of maatregel, geen bestraffing meer kan plaatshebben.
2. Het bepaalde in het vorige lid, aanhef en onder a, lijdt uitzondering in gevallen waarin Onze Minister bij zijn beslissing tot inwilliging van het verzoek tot uitlevering tevens opdracht geeft de vervolging te staken.
3. Het bepaalde in het eerste lid, aanhef en onder b, lijdt uitzondering in gevallen waarin de vervolging in Nederland is gestaakt, hetzij omdat de Nederlandse strafwet op grond van de artikelen 2-8 van het Wetboek van Strafrecht niet van toepassing bleek te zijn, hetzij omdat aan berechting in het buitenland de voorkeur werd gegeven.
4. Het eerste lid, aanhef en onder e, lijdt uitzondering voorzover krachtens het toepasselijke verdrag uitlevering niet kan worden geweigerd uitsluitend op grond van het feit dat het recht tot strafvervolging of het recht tot tenuitvoerlegging van die straf of maatregel naar het recht van de aangezochte staat is verjaard."

3.5. Uit de parlementaire geschiedenis van de Cassatieregeling in uitleveringszaken voor de Nederlandse Antillen en Aruba (Rijkswet van 8 mei 2003, Stb. 2003, 204) volgt dat de rijkswetgever zoveel mogelijk heeft willen aansluiten bij het systeem van het Nederlandse uitleveringsrecht en met name ook bij de jurisprudentie van de Hoge Raad (vgl. HR 25 oktober 2005, LJN AU2698 en HR 15 november 2005, LJN AU3943).

3.6. Art. 5 van het Verdrag heeft, voor zover in de onderhavige zaak van belang, dezelfde strekking als art. 9 Uw. Ten aanzien van laatstgenoemde bepaling heeft de Hoge Raad geoordeeld dat de omstandigheid dat in Nederland een strafvervolging gaande is ter zake van feiten die ook in het verzoek tot uitlevering zijn betrokken - op welke situatie art. 9, eerste lid onder a en tweede lid, Uw betrekking heeft - aan een toelaatbaarverklaring door de uitleveringsrechter niet in de weg staat. De beoordeling of (vervolgens) de uitlevering in verband met een lopende strafvervolging niet kan worden toegestaan, komt toe aan de Minister van Justitie (vgl. HR 3 februari 1981, NJ 1981, 318, HR 25 juli 2000, LJN ZD1984).

3.7. Hetgeen hiervoor is overwogen brengt mee dat de beslissing of de uitlevering van de opgeëiste persoon behoort te worden geweigerd op de grond dat een strafvervolging gaande is ter zake van feiten die ook in het verzoek tot uitlevering zijn betrokken, niet toekomt aan het Hof, maar is voorbehouden aan de Gouverneur.

3.8. Daarbij verdient nog opmerking dat ook de in de toelichting op het middel betrokken stelling waarop deze klacht berust - dat een voorlopig gestaakte vervolging een uitleveringsbeletsel oplevert in de zin van art. 5 van het Verdrag - gelet op de onder 9 van de conclusie van de Advocaat-Generaal weergegeven wetsgeschiedenis en op art. 9, eerste lid onder b, UW onjuist is.

3.9. Deze klacht van het middel is dus vruchteloos voorgesteld.

3.10. De overige klachten van het middel kunnen niet tot cassatie leiden. Dit behoeft, gezien art. 81 RO, geen nadere motivering, nu deze klachten niet nopen tot beantwoording van rechtsvragen in het belang van de rechtseenheid of de rechtsontwikkeling.

4. Beslissing

De Hoge Raad:
verklaart de opgeëiste persoon niet-ontvankelijk in haar beroep voor zover dat beroep zich niet richt tegen de beslissingen van het Gemeenschappelijk Hof inzake de toelaatbaarheid van de uitlevering;
verwerpt het beroep voor het overige.

Dit arrest is gewezen door de vice-president A.J.A. van Dorst als voorzitter, en de raadsheren W.A.M. van Schendel en J. de Hullu, in bijzijn van de waarnemend griffier L.J.J. Okker-Braber, en uitgesproken op 9 december 2008.

Conclusie inzake:

[opgeëiste persoon]

1. Het Gemeenschappelijk Hof van de Nederlandse Antillen en Aruba (het Hof) heeft bij advies van 5 juni 2007 het verzoek van de Verenigde Staten van Amerika tot uitlevering van de opgeëiste persoon ter vervolging toelaatbaar verklaard voor de feiten bedoeld onder 1 en 2 en geadviseerd om tot uitlevering van de opgeëiste persoon voor die feiten over te gaan.(1)

2. Namens de opgeëiste persoon heeft mr. P.A.P.J. van der Sloot, advocaat te Oranjestad (Aruba) één middel van cassatie ingediend.

3. Het middel komt op tegen het oordeel van het Hof dat de uitlevering toelaatbaar is. Voorts wordt, naar ik begrijp, geklaagd over (de motivering van) het advies van het Hof aan de Gouverneur om tot uitlevering over te gaan.

4. Ten eerste wordt geklaagd dat het Hof er ten onrechte, althans zonder toereikende motivering, vanuit is gegaan dat "officiële verzoeken tot uitlevering binnen de termijn van artikel 11 lid 4 van het Uitleveringsverdrag tussen het Koninkrijk der Nederlanden en de Verenigde Staten van Amerika (...) zijn overgelegd bij het bevoegd gezag in deze." Daaraan wordt toegevoegd dat voor zover het verzoek binnen de termijn van zestig dagen is ingediend bij de Nederlandse Ambassade in Washington geldt dat de ambassade niet is "het bevoegd gezag zoals bepaald in het Uitleveringsverdrag."(2)

5. Het onderhavige verzoek is gegrond op het Uitleveringsverdrag tussen het Koninkrijk der Nederlanden en de Verenigde Staten van Amerika,(3) (het Verdrag). Dit Verdrag bepaalt in art. 9 lid 1 dat het verzoek tot uitlevering langs diplomatiek weg wordt gedaan.(4) Dat wil zeggen via de ambassade van de verzoekende staat en het ministerie van buitenlandse zaken.(5) Art. 11 van het Verdrag geeft voorschriften voor de procedure van de zogenoemde voorlopige aanhouding en luidt als volgt:
"1. In geval van spoed kan elke Verdragsluitende Partij de voorlopige aanhouding verzoeken van ieder die wordt vervolgd of is veroordeeld. Het verzoek tot voorlopige aanhouding kan worden gedaan hetzij langs diplomatieke weg, hetzij in rechtstreeks contact tussen het "Department of Justice" van de Verenigde Staten en het Ministerie van Justitie in Nederland of het Ministerie van Justitie in de Nederlandse Antillen, naar gelang het geval.
(...)
4. De voorlopige aanhouding wordt beëindigd indien de aangezochte Staat niet binnen 60 dagen na de inhechtenisneming van de gezochte persoon het officiële verzoek tot uitlevering en de in artikel 9 vermelde stukken ter ondersteuning daarvan heeft ontvangen.
5. De beëindiging van de voorlopige aanhouding volgens het vierde lid vormt geen beletsel voor de uitlevering van de opgeëiste persoon indien het verzoek tot uitlevering en de in artikel 9 vermelde documenten ter ondersteuning daarvan op een latere datum worden overgelegd."

6. Het Hof heeft in het advies overwogen dat het verzoek langs diplomatiek weg is ingediend. Wanneer het verzoek is ontvangen is voor de beslissing of de uitlevering toelaatbaar is niet relevant. Uit het vijfde lid van art. 11 van het Verdrag volgt immers dat ook als het verzoek is ontvangen nadat de termijn van zestig dagen als bedoeld in het vierde lid was verstreken dit geen beletsel vormt voor de uitlevering van de opgeëiste persoon. In de toelichting op het middel wordt in de uitspraak van het Hof dus ten onrechte gelezen dat het Hof ervan is uitgegaan dat de termijn van art. 11 lid 4 van het Verdrag in acht is genomen. De klacht mist dus feitelijke grondslag.

7. De tweede klacht luidt dat het Hof ten onrechte heeft geoordeeld dat "het ne bis in idem in acht genomen is." Daarbij wordt met een beroep op art. 5 van het Verdrag gesteld dat indien "tegen de opgeëiste persoon in de aangezochte staat een vervolging is ingesteld, (...) de uitlevering als regel ontoelaatbaar [dient] te worden verklaard."

8. Het bestreden advies houdt, voor zover hier van belang, het volgende in:
"11. Ne bis in idem
Conform artikel 5 van het Uitleveringsverdrag wordt uitlevering niet toegestaan wanneer de opgeëiste persoon door de aangezochte staat ter zake van het feit waarvoor uitlevering wordt verzocht wordt vervolgd, vervolgd is geweest of is berecht en veroordeeld of vrijgesproken. Ter zitting heeft de procureur-generaal verklaard dat de vervolging in Aruba weliswaar was aangevangen, maar is gestaakt en slechts dan zal worden hervat indien geen uitlevering plaats vindt. Aan het genoemde verdragsvereiste is daardoor voldaan."

9. Art. 5 van het Verdrag luidt, voor zover hier van belang, als volgt:
"Uitlevering wordt niet toegestaan wanneer:
a. de opgeëiste persoon door de aangezochte Staat ter zake van het feit waarvoor uitlevering wordt verzocht wordt vervolgd, vervolgd is geweest, of is berecht en veroordeeld of vrijgesproken; of
b. uit anderen hoofde tegen de opgeëiste persoon geen vervolging kan worden ingesteld ter zake van het feit waarvoor uitlevering wordt verzocht, krachtens het recht in de aangezochte Staat met betrekking tot het effect van een voorafgaande strafvervolging."

De Toelichtende Nota behorend bij de parlementaire goedkeuring van het Uitleveringsverdrag N-VS houdt met betrekking tot artikel 5 het volgende in:
"Onderdeel (a) heeft betrekking op de situatie dat in de aangezochte staat ter zake van het feit waarvoor uitlevering wordt gevraagd nog een vervolging gaande is. Die situatie is voorzien in artikel 9, eerste lid, onder (a), van de Uitleveringswet. Onderdeel (b) heeft betrekking op alle gevallen waarin naar het recht van de aangezochte staat geen verdere vervolging meer kan plaatsvinden. Dit onderdeel dekt alle situaties voorzien in artikel 9, eerste lid, onder b, c, en d van de Uitleveringswet. Deze soepele formulering is gekozen omdat het Amerikaanse recht een minder vergaande regeling op dit gebied kent dan het Nederlandse recht."(6)

Artikel 9 lid 1, Uitleveringswet luidt, voor zover hier van belang:
"Uitlevering van de opgeëiste persoon wordt niet toegestaan voor een feit terzake waarvan:
a. ten tijde van de beslissing op het verzoek tot uitlevering een strafvervolging in Nederland tegen hem gaande is;
b. hij in Nederland is vervolgd, indien hernieuwde vervolging is uitgesloten op grond van artikel 255, eerste en tweede lid, van het Wetboek van Strafvordering;
c. hij bij gewijsde van de Nederlandse rechter is vrijgesproken of ontslagen van rechtsvervolging, dan wel te zijnen aanzien een overeenkomstige onherroepelijke beslissing door een andere rechter is genomen;
d. hij bij rechterlijk gewijsde is veroordeeld, in gevallen waarin:
1. de opgelegde straf of maatregel reeds is ondergaan, of
2. die straf of maatregel niet voor onmiddellijke tenuitvoerlegging of verdere tenuitvoerlegging vastbaar is, of
3. de veroordeling een schuldigverklaring zonder oplegging van straf of maatregel inhoudt, dan wel
4. het gewijsde afkomstig is van de Nederlandse rechter en niet bij verdrag voor zodanig geval de bevoegdheid tot uitlevering is voorbehouden;"

10. In het licht van deze verdragsgeschiedenis moet art. 5 van het Verdrag voor zover het bepaalt dat er een beletsel voor uitlevering bestaat als de opgeëiste persoon is vervolgd, aldus worden verstaan dat daarvan geen sprake is als de aangevangen vervolging is gestaakt maar wel als de vervolging is geëindigd en in beginsel ook niet kan worden hervat zoals in geval van een ook in het Arubaanse recht bekende kennisgeving van niet verdere vervolging, buitenvervolgingstelling of verklaring dat de zaak geëindigd is (art. 282 SvA). Dat de Uitleveringswet niet van toepassing is op Aruba maakt voor de uitleg van het Verdrag naar mijn inzicht geen verschil.(7)

11. In de overwegingen van het Hof ligt besloten dat de situatie dat de opgeëiste persoon in Aruba werd vervolgd en hernieuwde vervolging is uitgesloten omdat de vervolging 'formeel' - door een buitenvervolgingstelling, een verklaring dat de zaak geëindigd is, of een kennisgeving van niet verdere vervolging, vgl. art. 282 SvA - is beëindigd zich hier niet voordoet.(Cool Daarvan uitgaande heeft het Hof terecht geoordeeld dat de exceptie van art. 5 van het Verdrag dat de uitlevering wordt geweigerd indien de opgeëiste persoon vervolgd is geweest niet van toepassing is.

12. Voorts is het oordeel of vanwege een lopende vervolging de uitlevering moet worden geweigerd niet aan de rechter(9) maar - in Arubaanse zaken - de Gouverneur.(10) Art. 5 van het Verdrag maakt dat niet anders.(11) De bij de schriftuur gevoegde stukken waaruit volgens de steller van het middel zou volgen dat de vervolging nog steeds gaande dan wel hervat is, zijn derhalve in het onderhavige geding niet van belang.

13. Voor zover het middel opkomt tegen het oordeel van het Hof dat art. 5 van het Verdrag niet aan uitlevering in de weg staat faalt het.

14. In de toelichting op middel wordt voorts gesteld dat het "op de weg van het Hof had gelegen om de Gouverneur te adviseren dat het in het belang van een goede rechtsbedeling opportuun is de vervolging in Aruba voort te zetten (of niet als het Hof een andere mening is toegedaan, maar het gaat dan met name om de motivering)." Daarbij wordt aangevoerd dat het Hof "de relevante punten terzake aan de Gouverneur [had dienen] voor te leggen (en niet een conclusie)" en dat de opgeëiste persoon "haar sociale netwerk meer in Aruba heeft dan in de Verenigde Staten van Amerika".

15. Het bestreden advies houdt, na de conclusie dat de uitlevering voor de onder 1 en 2 bedoelde feiten toelaatbaar is, in dat het Hof adviseert om ter zake van die feiten tot uitlevering over te gaan. Tegen dit onderdeel van het advies staat geen cassatieberoep open.(12) Daarom kan de opgeëiste persoon in zoverre niet in haar cassatieberoep worden ontvangen.

16. Het middel faalt.

17. Ambtshalve heb ik geen gronden aangetroffen waarop het bestreden advies, voor zover vatbaar voor cassatie, zou dienen te worden vernietigd.

18. Deze conclusie strekt ertoe dat de opgeëiste persoon niet-ontvankelijk wordt verklaard in haar cassatieberoep voor zover dat beroep niet is gericht tegen de beslissingen van het Hof inzake de toelaatbaarheid van de uitlevering en tot verwerping van het beroep voor het overige.

on the appeal in cassation against a final decision of the Common Court of Justice of the Netherlands Antilles and Aruba on June 5, 2007, issue H-72/2007, on a request from the authorities of the United States of America on extradition:
[Suspect], born in the [birth place] on [birth date], at the time of service of the notice detained in the "correction Aruba Institute 'on Aruba (Netherlands Antilles).

1. Cassation proceedings

1.1. The appeal was lodged by the person sought. On behalf of these has Mr. P.A.P.J van der Sloot, Bar Oranjestad (Aruba), by means of writing a proposed appeal. The scripture above is attached and forms part.
Vellinga The Advocate General concluded that the person claimed inadmissible is stated in her appeal to the extent that action is not directed against the decisions of the Court on admissibility of the extradition and to dismiss the action for the remainder.

1.2. The Supreme Court has noted the written comments of counsel at the conclusion of the Attorney General.

2. Assessing the admissibility of the appeal

2.1. Under Art. 2, first paragraph of the Supreme Control in extradition cases for the Netherlands Antilles and Aruba, the Supreme Court in extradition cases knowledge of the appeal in cassation against the final decisions of the Joint Court by the Attorney General of one of the countries or the claimed person. Under Art. 1 of the Appeal Rules, the term `final decision 'means: the opinion of the Joint Court, Article 8, second paragraph, of the Dutch Antilles Extradition Decree (NAUB) (Pb. 1983, 84), to the extent that opinion relates to the permissibility of the extradition and to issue or return of seized property.

2.2. From the above considerations it follows that the person sought can not be received in its appeal to the extent that action is not aimed against the decisions of the Community Court on the admissibility of extradition. This means that the drug not discussed should remain where it is complained that the Court's opinion for the decision of the Governor relevant points as regards to Aruba started (but discontinued) charges against the person claimed should have included and so far as criticizing the lack of an opinion of the Community Court to the Governor for the requested extradition under the interests of justice to deny (cf. HR
June 3, 2008, LJN BD1833).

3. Assessment of the drug

3.1. The submission will include the complaint that the Court in view of the person claimed against the prosecution in Aruba started wrongly assumed that the ne bis in idem principle is respected.

3.2. The contested final decision shall, as required for the assessment of this complaint is important, the following:
"11. Ne bis in idem
Under Article 5 of the Extradition Treaty, extradition is not allowed when the person sought by the requested State in respect of the offense for which extradition is sought is being prosecuted, has been prosecuted or tried and convicted or acquitted. At the hearing the Attorney General stated that although the prosecution in Aruba had begun but was discontinued and only then will resume if no extradition takes place. At that convention requirement is therefore met. "

3.3. Art. 5 of the Extradition Treaty between the Kingdom of the Netherlands and the United States of America (Treaty Series 1980, 111) (hereinafter the Convention) provides:
"Extradition shall not be granted if:
a. the person sought by the requested State in respect of the offense for which extradition is sought is being prosecuted, has been prosecuted, or tried and convicted or acquitted, or
b. other reason the person claimed no prosecution may be imposed for the offense for which extradition is requested, under the law in the State regarding the effect of a prior criminal prosecution. "

3.4. The NAUB know, apart from in art. 5 regular case of limitation of the crimes for which extradition is sought is not a provision like art. 9 Extradition Act (the UW). Art. Your 9 reads as follows:
"1. Extradition of the person sought is not allowed for a fact concerning which:
a. at the time of the decision on the extradition request for a criminal prosecution against him going in the Netherlands;
b. He was prosecuted in the Netherlands but has renewed prosecution excluded under Article 255, first or second paragraph, or Article 255a, first or second paragraph of the Code of Criminal Procedure;
c. he final of the Dutch court acquitted or acquitted, or in his case a corresponding final decision was taken by another judge;
d. he judicial res judicata in cases where:
1. the sanction imposed has been served, or
2. that penalty is not for immediate implementation or further enforceable, or
3. the conviction of a guilty verdict without imposing any penalty entails, or
4. the final comes from the Dutch court and no convention for such a case the power of extradition is reserved;
e. Dutch law limitation because no prosecution, or, if the extradition is requested for the implementation of a penalty, no punishment more may occur.

3.7. Been considered the foregoing implies that the decision or the extradition of the person sought is to be refused on the grounds that an ongoing criminal prosecution in consideration of the facts which also involved a request for extradition is not accorded to the Court, but reserved to the Governor.

3.8. 1. The Common Court of the Netherlands Antilles and Aruba (the Court) at June 5, 2007 opinion of the request from the United States to extradite the person sought for prosecution declared permissible for the acts referred to in 1 and 2 and advised to extradition of the person sought for those facts to proceed (1).

2. On behalf of the person sought has Mr. paste in der Sloot, Bar Oranjestad (Aruba) a means of appeal filed.

3. The appeal challenges the finding of the Court that the extradition admissible. Furthermore, I understand, complaining about (the reasons for) the opinion of the Court to the Governor for extradition to proceed.

4. First, complained that the Court erred, at least without sufficient justification, the assumption that "official request for extradition within the deadline of Article 11 paragraph 4 of the Extradition Treaty between the Kingdom of the Netherlands and the United States of America (.. .) have been submitted to the competent authority in this. " Further adding that provided the application within a period of sixty days has been submitted to the Dutch Embassy in Washington is that the embassy was not "the competent authority as stipulated in the Extradition Treaty." 5. The present application is based on the Extradition Treaty between the Kingdom of the Netherlands and the United States of America (3) (the Treaty). This Convention provides in Art. 9 paragraph 1 that the request for extradition through diplomatic means is made. (4) That is, through the embassy of the requesting State and the Ministry of Foreign Affairs. (5) Art. 11 of the Convention provides rules for proceedings of the so-called provisional arrest as follows:
"1. In case of emergency, any Contracting Party provisional arrest requests from anyone prosecuted or convicted. The request for provisional arrest may be made either through diplomatic channels, either through direct contact between the Department of Justice of the United States and the Netherlands Ministry of Justice or the Ministry of Justice in the Netherlands Antilles, as appropriate.
(...)
4. Provisional arrest shall be terminated if the Requested State within 60 days after the arrest of the person sought the formal request for extradition and the documents mentioned in Article 9 has received to support them.
5. The termination of provisional arrest under the fourth paragraph shall not prevent the extradition of the person sought if the request for extradition and the documents mentioned in Article 9 to support them at a later date be presented. "

6. The Court has considered the opinion that the request was made through diplomatic means.When the request is received to decide whether the extradition admissible is irrelevant. The fifth paragraph of Art. 11 of the Treaty is apparent that even if the application is received after the deadline of sixty days referred to in paragraph expired this does not prevent the extradition of the person sought. 7. The second complaint is that the Court erred in holding that "the ne bis in idem principle is respected." It is by invoking Art. 5 of the Treaty states that if "the person claimed in the State has been charged, (...) extradition usually unacceptable [should] be declared."

8. The contested opinion, so far as relevant here, the following:
"11. Ne bis in idem
Under Article 5 of the Extradition Treaty, extradition is not allowed when the person sought by the requested State in respect of the offense for which extradition is sought is being prosecuted, has been prosecuted or tried and convicted or acquitted. At the hearing the Attorney General stated that although the prosecution in Aruba had begun but was discontinued and only then will resume if no extradition takes place. At that convention requirement is therefore met. "

9. Art. 5 of the Convention reads, so far as relevant, as follows:
"Extradition shall not be granted if:
a. the person sought by the requested State in respect of the offense for which extradition is sought is being prosecuted, has been prosecuted, or tried and convicted or acquitted, or
b. other reason the person claimed no prosecution may be imposed for the offense for which extradition is requested, under the law in the State regarding the effect of a prior criminal prosecution. "

The Explanatory Memorandum related to the parliamentary approval of the N-US Extradition Treaty with regard to Article 5 does the following:
"Part (a) covers the situation in the State for the offense for which extradition is requested that a prosecution is ongoing. This situation is provided in article 9, paragraph (a) of the Extradition Act. Part (b) covers all cases where the law of the State no longer taking any action to occur. This section covers all situations in article 9, paragraph b, c and d of the Extradition Act. This flexible formulation was chosen because the U.S. law a less restrictive regulation in this area than the Dutch law. "(6)

Article 9 paragraph 1, Extradition Act reads, so far as relevant:
"Extradition of the person sought is not allowed for a fact concerning which:
a. at the time of the decision on the extradition request for a criminal prosecution against him going in the Netherlands;
b. He was prosecuted in the Netherlands, where renewed prosecution is excluded under Article 255, first and second paragraph of the Code of Criminal Procedure;
c. he final of the Dutch court acquitted or acquitted, or in his case a corresponding final decision was taken by another judge;
d. he judicial res judicata in cases where:
1. the sanction imposed has been served, or
2. that penalty is not for immediate execution or further execution fixed feasible, or
3. the conviction of a guilty verdict without imposing any penalty entails, or
4. the final comes from the Dutch court and no convention for such a case the power is reserved for extradition; "

10. In light of this history Convention, art. 5 of the Convention, insofar as it provides that an obstacle to extradition exists if the person sought has been prosecuted, must be understood that their absence if commenced proceedings have been stopped but when the persecution ended and in principle can not be resumed as in the case of a well-known in the Aruban law does not notice any action or statement that acquittal was the case is closed (art. 282 SVA).That the Extradition Act does not apply to Aruba is the explanation of the Treaty, to my knowledge no difference (7).

11. The considerations of the Court is decided that the situation that the person claimed in Aruba was prosecuted and renewed prosecution is excluded because the prosecution "formal" - by an acquittal was, a statement that the case is closed, or a notification of non prosecution , cf.SVA 282 - ended here does not arise. 13. To the extent the plea challenging the opinion of the Court, Art. 5 of the Extradition Treaty does not preclude it fails.

14. The explanation of plea further states that 'while the Court had lain to the Governor to advise that it is in the interest of justice the prosecution in Aruba is appropriate to continue (or not as the Court another disagrees, but then in particular the justification). Inhoudsindicatie:   Antilliaanse zaak. Voor onderzoek door de cassatierechter komen alleen in aanmerking middelen van cassatie als in de wet bedoeld. Als een zodanig middel kan slechts gelden een stellige en duidelijke klacht over de schending van een bepaalde rechtsregel en/of het verzuim van een toepasselijk vormvoorschrift door de rechter die de bestreden uitspraak heeft gewezen. De schriftuur voldoet niet aan dit vereiste, zodat zij onbesproken moet blijven. Nu verdachte niet binnen de bij de wet gestelde termijn bij de HR door een raadsman een schriftuur houdende middelen van cassatie heeft doen indienen, is niet in acht genomen het voorschrift van art. 437.2 Sv, zodat verdachte in het beroep niet kan worden ontvangen. Conclusie AG: anders.

op het beroep in cassatie tegen een vonnis van het Gemeenschappelijk Hof van Justitie van de Nederlandse Antillen en Aruba van 10 maart 2008, nummer H-20/08, in de strafzaak tegen:
[Verdachte], geboren op [geboorteplaats] op [geboortedatum] 1965, wonende op [woonplaats].

1. Geding in cassatie

Het beroep is ingesteld door de verdachte. Namens deze heeft mr. P.A.P.J. van der Sloot, advocaat te Oranjestad (Aruba), bij schriftuur een middel van cassatie voorgesteld. De schriftuur is aan dit arrest gehecht en maakt daarvan deel uit.
De Advocaat-Generaal Vegter heeft geconcludeerd tot verwerping van het beroep.

2. Beoordeling van de schriftuur en de ontvankelijkheid van het beroep

2.1. Voor onderzoek door de cassatierechter komen alleen in aanmerking middelen van cassatie als in de wet bedoeld. Als een zodanig middel kan slechts gelden een stellige en duidelijke klacht over de schending van een bepaalde rechtsregel en/of het verzuim van een toepasselijk vormvoorschrift door de rechter die de bestreden uitspraak heeft gewezen. De schriftuur voldoet niet aan dit vereiste, zodat zij onbesproken moet blijven.

2.2. Nu de verdachte niet binnen de bij de wet gestelde termijn bij de Hoge Raad door een raadsman een schriftuur houdende middelen van cassatie heeft doen indienen, is niet in acht genomen het voorschrift van art. 437, tweede lid, Sv, zodat de verdachte in het beroep niet kan worden ontvangen.

3. Beslissing

De Hoge Raad verklaart de verdachte niet-ontvankelijk in het beroep.

Conclusie inzake:

[Verdachte]

1. Het Gemeenschappelijk Hof van Justitie van de Nederlandse Antillen en Aruba heeft verdachte op 10 maart 2008 ter zake van "feit 1: als ambtenaar een gift aannemen, wetende dat zij hem gedaan wordt teneinde hem te bewegen om in strijd met zijn plicht in zijn bediening iets te doen of na te laten, meermalen gepleegd, strafbaar gesteld bij artikel 379 van het Wetboek van Strafrecht van Aruba; feit 2 en 3 telkens: valsheid in geschrift, meermalen gepleegd, strafbaar gesteld bij de artikelen 230 jo. 49 van het Wetboek van Strafrecht van Aruba" veroordeeld tot een gevangenisstraf voor de duur van twee jaren, met aftrek als bedoeld in artikel 31 Wetboek van Strafrecht van Aruba. Voorts heeft het Hof verdachte veroordeeld tot ontzetting van het recht om ambten te bekleden voor de duur van vijf jaren, de duur van de hoofdstraf te boven gaande. Ten slotte heeft het Hof de teruggave aan de verdachte van de in het arrest vermelde inbeslaggenomen voorwerpen bevolen en de overige op de beslaglijsten vermelde inbeslaggenomen voorwerpen verbeurd verklaard.

2. Verdachte heeft op 20 maart 2008 cassatie ingesteld. Namens verdachte heeft Mr. P.A.P.J.van der Sloot, advocaat te Oranjestad (Aruba), een schriftuur ingezonden.

3. De onderhavige schriftuur houdt allereerst in dat middelen van cassatie worden voorgedragen, gevolgd door de zin: "Schending van het recht en/of verzuim van vormen waarvan het niet in acht nemen nietigheid meebrengt". Vervolgens bevat de schriftuur een aantal opmerkingen weergegeven A) tot en met H), ieder gevolgd door een toelichting. Vervolgens geeft de schriftuur in de nummers I) tot en met P) de inhoud van het bestreden arrest weer - te weten de bewezenverklaring, de kwalificatie, de strafbaarheid van verdachte en de op te leggen straf en maatregel -, gevolgd door een aantal opmerkingen genummerd 1 tot en met 5.

4. De ingediende schriftuur geeft aanleiding tot het plaatsen van enkele kanttekeningen. Allereerst wijs ik op HR 1 september 2009, LJN BI2364 A, waarin de Hoge Raad heeft geoordeeld dat de cassatieschriftuur, eveneens ingediend door Mr. P.A.P.J. van der Sloot, niet voldoet aan de eisen als in de wet bedoeld. Zoals ik in de bij voornoemde zaak behorende conclusie al opmerkte, herhaal ik dat voor onderzoek door de cassatierechter alleen in aanmerking komen middelen van cassatie als bedoeld in art. 437 Sv. Dat betekent dat het moet gaan om 'een stellige en duidelijke klacht over de schending van een bepaalde rechtsregel en/of het verzuim van een toepasselijk vormvoorschrift door de rechter die de bestreden uitspraak heeft gewezen'.(1)
De thans voorliggende schriftuur laat zich niet of nauwelijks lezen als een schriftuur houdende middelen van cassatie. Of er één of meer middelen van cassatie worden voorgedragen is niet duidelijk. Ik lees de schriftuur zo dat er één middel van cassatie is voorgedragen dat verschillende klachtonderdelen bevat. De klachtonderdelen zijn in de schriftuur opgenomen door een overweging uit het arrest van het Hof te citeren. De toelichting op het klachtonderdeel doet doorgaans niet anders dan opnieuw het in feitelijke instantie uiteengezette standpunt verwoorden. Op welke beslissing van het Hof het klachtonderdeel betrekking heeft wordt doorgaans niet aangegeven. Bij de bespreking van de klachtonderdelen hieronder zal steeds het kader gekozen worden waarin het Hof de overweging heeft gegeven. De klachtonderdelen A t/m H zullen daarom in hoofdzaak in de sleutel van de ontvankelijkheid van het openbaar ministerie worden gezet. Waarom een beslissing van het Hof onjuist of onvoldoende gemotiveerd is, wordt in het klachtonderdeel doorgaans niet uiteen gezet. Welke rechtsregel is geschonden of welke vorm is verzuimd wordt als regel niet vermeld.
Ik zal hieronder alle klachten bespreken, hoewel ik mij heb afgevraagd of dat wel zinvol is. Het gaat mij echter te ver om in algemene termen te formuleren dat de klachtonderdelen niet aan te merken zijn als middelen met uitzondering van een nader te noemen klacht over de strafmotivering.

5. Het Gemeenschappelijk Hof heeft in het arrest naar aanleiding van gevoerde verweren onder meer het volgende overwogen:

"De geldigheid van de dagvaardingen
Anders dan de raadsman heeft aangevoerd betreffen de twee dagvaardingen niet hetzelfde feitencomplex. De eerste dagvaarding ziet kort gezegd op (aanvaarding van steekpenningen voor het plegen van) valsheid in geschrifte ten aanzien van de roze duplicaat rijbewijzen en de gele kaarten, terwijl de tweede dagvaarding ziet op (aanvaarding van steekpenningen voor het plegen van) valsheid in geschrifte ten aanzien van de aanvraagformulieren voor duplicaat carnet rijbewijzen. Ook overigens geven de dagvaardingen voldoende duidelijk weer welke verschillende feiten de verdachte tenlastegelegd worden. Gelet daarop stond niets eraan in de weg een tweede aanvullende dagvaarding (die ook expliciet als 'tweede dagvaarding' wordt aangeduid) uit te brengen.
Het Hof verwerpt dan ook het verweer dat de dagvaardingen nietig zijn.

Het vonnis waarvan beroep
Het vonnis waarvan beroep zal vernietigd worden omdat het Hof zich daarmee niet verenigt. Het betoog van de raadsman dat het vonnis van 28 september 2007 nietig is omdat ter terechtzitting in eerste aanleg niet alle (voor het bewijs gebruikte) stukken zijn voorgelezen of daarvan de korte inhoud is meegedeeld, kan dan ook daargelaten worden.

De ontvankelijkheid van het OM
De raadsman heeft aangevoerd dat het OM niet-ontvankelijk dient te worden verklaard in zijn vervolging op grond van het feit dat:
1 in eerste aanleg niet alle (voor het bewijs gebruikte) stukken zijn voorgehouden;
2 er twee dagvaardingen zijn uitgebracht over hetzelfde feitencomplex;
3 het onderzoek ter terechtzitting in eerste aanleg niet onafgebroken is voortgezet;
4 het vonnis en het proces-verbaal niet binnen twee maal 24 uur ondertekend zijn door de rechter en de griffier, althans zulks blijkt niet uit het vonnis en het procesverbaal;
5 de procureur-generaal geweigerd heeft om 2 getuigen te dagvaarden die ook ter terechtzitting in eerste aanleg een getuigenis hadden afgelegd;
6 en om de volgende reeds in eerste aanleg genoemde en in hoger beroep niet nader toegelichte normschendingen: beïnvloeding getuigen, tot 4 maal toe toegang weigeren tot de verdachte, geen kennis kunnen nemen van de stukken tijdens de voorlopige hechtenis, onrechtmatige vrijheidsberoving, het buiten het strafdossier houden van het CID rapport.

Het Hof verwerpt dit verweer.
Ad 1 overweegt het Hof dat zulks niet tot de niet-ontvankelijkheid van het OM kan leiden nu voor zover sprake is van een vormverzuim een bijzondere wettelijke bepaling (art. 337 Sv) reeds in de gevolgen van de normschending voorziet.
Ad 2 geldt dat hiervoor reeds is overwogen dat zulks geen normschending betreft.
Ad 3 geldt dat de eerste rechter terecht geoordeeld heeft dat het niet beschikbaar zijn van zittingsruimte een schorsing van het onderzoek rechtvaardigde; ook op dit punt is dus geen norm geschonden.
Ad 4 overweegt het Hof dat, nog daargelaten dat niet is voorgeschreven dat in het proces-verbaal en/of het vonnis het tijdstip van ondertekening wordt opgenomen en dat niet is gesteld of aannemelijk geworden dat de verdachte daardoor nadeel heeft ondervonden, zulks geen normschending betreft op grond waarvan het openbaar ministerie niet-ontvankelijk kan worden verklaard (geen sprake is van een door met de opsporing of vervolging belaste ambtenaren gemaakte ernstige inbreuk op de beginselen van een behoorlijke procesorde).
Ad 5 geldt dat de raadsman ter terechtzitting in hoger beroep het Hof had kunnen verzoeken alsnog de dagvaarding van die getuigen te bevelen. Van die mogelijkheid heeft hij echter uitdrukkelijk afgezien. Van een normschending is geen sprake.
Ad 6 overweegt het Hof dat de genoemde beïnvloeding van getuigen (ook in het pleidooi in eerste aanleg), en de stelling dat de raadsman geen kennis heeft kunnen nemen van stukken voorafgaand aan de rechtmatigheidstoetsing (waar de raadsman blijkens zijn pleidooi in eerste aanleg kennelijk op doelt), niet onderbouwd zijn. Dat er sprake is geweest van beïnvloeding van getuigen en dat er op genoemd moment stukken zijn onthouden, is dan ook niet aannemelijk geworden. De raadsman heeft ook niet gesteld dat de verdachte door het onthouden van stukken voorafgaand aan de
rechtmatigheidstoetsing in zijn verdediging is geschaad. Datzelfde geldt voor de stelling dat de raadsman (uit het pleidooi in eerste aanleg begrijpt het Hof: op 2 dagen) niet is toegelaten tot de verdachte. Niet heeft de raadsman aangegeven dat hij daardoor onvoldoende contact met zijn cliënt heeft kunnen hebben. Voor wat betreft het beroep op onrechtmatige detentie blijkt het uit het pleidooi in eerste aanleg te gaan om het feit dat de verdachte te laat aan de rechter-commissaris is voorgeleid (ex art. 89 SV). Tegen de beslissing van de rechter-commissaris dat de voorzetting van de inverzekeringstelling niet onrechtmatig is staat geen hogere voorziening open. Het gesloten stelsel van rechtsmiddelen zou op een onaanvaardbare wijze worden doorkruist indien bij de behandeling van de zaak ter terechtzitting opnieuw of alsnog een beroep zou kunnen worden gedaan op verzuimen die aan de rechter-commissaris zijn of hadden kunnen worden voorgelegd. Het CID-rapport bevat blijkens het dossier alleen startinformatie en behoefde dan ook niet aan het dossier te worden toegevoegd. Ook op dit punt heeft de raadsman overigens niet aangevoerd dat de verdachte daardoor in zijn verdediging is geschaad."

6. In de schriftuur wordt de onder A) weergegeven opmerking met als kopje "Dat het openbaar ministerie ontvankelijk is" gevolgd door een toelichting bestaande uit twee klachten.

7. Ten eerste wordt geklaagd over 's Hofs oordeel dat de dagvaarding van 5 september 2005 geen inhaaldagvaarding is van de dagvaarding van 30 augustus 2007. Gesteld wordt dat een inhaaldagvaarding in strijd is met het rechtssysteem, en, onder verwijzing naar HR 15 februari 1949, NJ 1949, 305, tot niet-ontvankelijkheid had moeten leiden.
De officier van justitie behoort zich te onthouden van het doen uitgaan van een tweede inleidende dagvaarding ter zake van hetzelfde feit voordat over of op de grondslag van de inleidende dagvaarding onherroepelijk is beslist.(2) In het onderhavige geval zijn juist twee dagvaardingen uitgebracht, die niet hetzelfde feitencomplex betreffen.(3) Het Hof heeft dat ook uitdrukkelijk toegelicht en in de schriftuur wordt niet uiteengezet waarom dat oordeel onjuist is. Dat laatste leidt tot de conclusie dat van een middel niet kan worden gesproken.
De toelichting op het onder A) gestelde klaagt voorts over het oordeel van het Hof dat het besluit van de rechter in eerste aanleg om het onderzoek vanwege het ontbreken van zittingsruimte te schorsen geen normschending is. Ik stel voorop dat niet valt in te zien dat schorsing van het onderzoek ter terechtzitting een grond kan zijn om de officier van justitie niet-ontvankelijk te verklaren. In de schriftuur wordt dat ook niet met argumenten naar voren gebracht. Ook al zou hier dus van enige normschending sprake zijn dan betekent dat nog niet dat het openbaar ministerie daarmee het vervolgingsrecht verspeelt. Beslissingen over aanhouding vallen tot op grote hoogte binnen de vrije, door de cassatierechter niet te betreden beleidsruimte van de feitenrechter.(4) In het bestreden vonnis heeft het Hof overwogen dat de eerste rechter geoordeeld heeft dat het niet beschikbaar zijn van zittingsruimte een schorsing van het onderzoek rechtvaardigde en dat ook op dit punt dus geen norm is geschonden. Blijkens het proces-verbaal ter terechtzitting van het Gerecht in Eerste Aanleg van Aruba d.d. 7 september 2007 heeft de officier van justitie meegedeeld dat de zaak pro forma is aangebracht omdat het die dag niet samen met andere verdachte uit het dossier kon worden behandeld. Voorts is meegedeeld dat het inhoudelijk behandelen van een strafzaak tegen 15 verdachten niet lukt op één zittingsdag. De raadsman heeft daarop verzocht om de zaak die dag wel inhoudelijk te behandelen. Vervolgens heeft de rechter meegedeeld dat de zaak die dag niet inhoudelijk kán worden behandeld, omdat er gewoonweg, fysiek, geen zittingsruimte beschikbaar is. Bovendien heeft de rechter meegedeeld dat door het gerecht alle moeite is gedaan om de zaak op zo'n kort mogelijke termijn alsnog te behandelen. De rechter heeft het onderzoek geschorst tot 13 september 2007. Blijkens het proces-verbaal d.d. 13 september 2007 heeft de rechter die dag het geschorste onderzoek van 7 september 2007 hervat. In de schriftuur wordt betoogd dat schorsing van het onderzoek ter terechtzitting niet kan worden gebaseerd op een gebrek aan zittingsruimte, omdat gebrek aan zittingsruimte niet aan te merken is als een onderzoeksbelang. Het komt mij voor dat onvoldoende tijd voor een goede behandeling van de zaak wel degelijk als een dergelijk belang kan gelden. Dit oordeel geeft geen blijk van een onjuiste rechtsopvatting en is evenmin onbegrijpelijk.
Nu de schriftuur niet meer inhoudt dan dat het Hof een verkeerde maatstaf heeft gebruikt voor de beoordeling van de schorsingsbeslissing van het Gerecht in Eerste Aanleg en niet uiteenzet waarom de ontvankelijkheidsbeslissing van het Hof onjuist of onvoldoende gemotiveerd is, meen ik dat hier evenmin sprake is van een middel.

8. De onder opmerking B) vervatte klacht richt zich tegen het oordeel van het Hof dat het niet-oproepen door de Procureur-Generaal van twee getuigen geen normschending is. In de schriftuur wordt niet toegelicht wat de juridische basis is voor de stelling dat het niet oproepen van getuigen door het openbaar ministerie tot niet-ontvankelijkheid leidt. Evenmin wordt betoogd dat het oordeel van het Hof dat de raadsman het Hof had kunnen verzoeken de getuigen alsnog op te roepen onjuist of niet voldoende gemotiveerd is. In cassatie kan slechts geklaagd worden over rechtsschending of vormverzuim door de rechter die de bestreden uitspraak heeft gewezen.(5) Ook hier geldt dat de klacht niet kan worden aangemerkt als een middel van cassatie.

9. Onder C) wordt geklaagd over 's Hofs verwerping van het verweer dat het vonnis en het proces-verbaal niet binnen tweemaal 24 uur zijn ondertekend door de rechter en de griffier. In de schriftuur wordt niet toegelicht wat de juridische basis is voor de stelling dat gebreken in de ondertekening van een vonnis moeten leiden tot niet-ontvankelijkheid van het openbaar ministerie. Nu de gemotiveerde beslissing van het Hof dat er geen sprake is van een normschending die tot niet-ontvankelijkheid moet leiden niet wordt bestreden, is ook hetgeen onder C) wordt betoogd niet aan te merken als een middel.

10. Onder D) wordt gesteld: "Dat het feit dat in eerste aanleg niet alle bezwarende stukken zijn voorgelezen dan wel hun korte inhoud is meegedeeld, terwijl op deze stukken wel acht is geslagen voor de veroordeling daargelaten kan worden omdat het vonnis vernietigd wordt." In het arrest is inderdaad, zoals hierboven onder 5 naar voren kwam, het vonnis het Gerecht in Eerste Aanleg vernietigd. Waarom er desondanks op gebreken bij de behandeling in eerste aanleg moet worden ingegaan wordt niet uiteengezet en evenmin wordt toegelicht waarom een dergelijk gebrek tot niet-ontvankelijkheid zou moeten leiden. Inzoverre geldt ook hier dat van een middel niet kan worden gesproken.

11. In de toelichting bij hetgeen onder D) wordt gesteld, valt nog te lezen: "Dit klemt te meer nu het Hof heeft geweigerd om al deze stukken voor te lezen, terwijl het niet voorlezen van de stukken op grond van art. 337 lid 5 A. Sv nietigheid van het vonnis met zich brengt." Hier wordt geen zelfstandige klacht geformuleerd, maar hetgeen wordt betoogd moet kennelijk steun bieden aan de klacht over het voorhouden van stukken in eerste aanleg. Het betreft echter een zelfstandig punt en nu het niet alszodanig wordt gepresenteerd gaat het te ver om het als zelfstandig middel aan te merken. Maar zelfs als de klacht wordt aangemerkt als een zelfstandig middel dan faalt deze. Het proces-verbaal ter terechtzitting in hoger beroep houdt - voor zover voor bespreking van de klacht van belang - het volgende in:

"Verzoek raadsman
De raadsman verzoekt het Hof om op grond van artikel 337 van het Wetboek van Strafvordering alle stukken voor te lezen dan wel alle bewijsmiddelen die bij een eventuele veroordeling van de verdachte zullen worden gebruikt aan hem voor te houden. Op vragen van de voorzitter antwoordt de raadsman dat hij het gehele dossier met de verdachte heeft doorgenomen. De verdachte zwijgt, ook ten aanzien van het verzoek welke stukken hij nog voorgehouden wenst te krijgen en ten aanzien van de vraag of hij iets wenst te verklaren naar aanleiding van andere, nog niet voorgehouden, stukken.
De procureur-generaal merkt op dat de verdachte het dossier kent en dat voorlezing van het gehele dossier de grenzen van redelijkheid overschrijdt. Het verzoek dient zijn inziens te worden afgewezen. (...)
De voorzitter hervat het onderzoek ter terechtzitting en deelt mede dat het Hof heeft besloten dat voor zover het verzoek van de verdediging voorlezing van alle stukken die zich in het dossier bevinden behelst, het verzoek wordt afgewezen. Voorlezing van alle stukken van het dossier overschrijdt, gelet op de grote omvang van het dossier, de redelijke grenzen. Daarbij heeft het Hof mede in aanmerking genomen dat de verdachte het dossier met zijn raadsman heeft doorgenomen en de verdachte op vragen van de voorzitter en tijdens het voorhouden van de stukken slechts heeft gezwegen. Mocht de verdachte specifieke bewijsmiddelen (nader) willen zien voorgehouden, dan zal het Hof zulks doen. De raadsman laat weten geen verzoek te doen voor het (nader) voorhouden van (andere) stukken."

12. Artikel 337 Sv Aruba houdt het volgende in:

Artikel 337
1. Processen-verbaal, verslagen van deskundigen of andere stukken worden door de voorzitter, wanneer deze of een van de rechters of wel de procureur-generaal dit verlangt, voorgelezen, voor zover daarbij naar zijn oordeel redelijke grenzen niet worden overschreden.
2. Gelijke voorlezing heeft plaats op verzoek van de verdachte, tenzij het Hof ambtshalve of op het verzet van de procureur-generaal anders beveelt.
3. In alle gevallen waarin de verdachte verzoekt dat een getuigenverklaring op de terechtzitting zal worden voorgelezen, ten einde als aldaar afgelegd te worden aangemerkt, zal die voorlezing moeten geschieden.
4. De voorlezing van stukken kan, tenzij de procureur-generaal of de verdachte zich daartegen verzet, worden vervangen door een mondelinge mededeling van de korte inhoud door de voorzitter.
5. Ten bezware van de verdachte wordt, op straffe van nietigheid, op geen stukken acht geslagen, dan voor zover zij zijn voorgelezen, of hun korte inhoud overeenkomstig het vierde lid is meegedeeld.
6. Stukken, die op de terechtzitting in eerste aanleg zijn voorgelezen, mogen voor de behandeling in hoger beroep als voorgelezen worden aangemerkt. Indien echter de verdachte verzoekt, dat bepaalde stukken opnieuw zullen worden voorgelezen, wordt aan dat verzoek gevolg gegeven, voor zover door die voorlezing naar het oordeel van het Hof redelijke grenzen niet worden overschreden.

13. Anders dan door de raadsman van verdachte ter terechtzitting in hoger beroep is betoogd, kan schending van het bepaalde in artikel 337 Sv Aruba ingevolge het vijfde lid van voornoemde bepaling niet leiden tot niet-ontvankelijkheid van het Openbaar Ministerie, maar uitsluitend tot nietigheid. Voor zover uit de klacht voorts al kan worden opgemaakt of er enig rechtsgevolg moet worden verbonden aan het niet voorlezen van de stukken in hoger beroep slaagt de klacht evenmin. Blijkens het proces-verbaal ter terechtzitting in hoger beroep heeft verdachte niet geantwoord op de vraag van de rechter welke stukken hij nog voorgehouden wenst te krijgen en op de vraag of hij iets wenst te verklaren naar aanleiding van andere, nog niet voorgehouden, stukken. Voorts heeft de raadsman van verdachte laten weten geen verzoek te doen voor het (nader) voorhouden van (andere) stukken. Nu ingevolge het derde lid van voornoemde bepaling voorlezing van de stukken - in het bijzonder getuigenverklaringen - uitsluitend is vereist indien de verdachte (of zijn raadsman(6)) daarom vraagt, kon het Hof derhalve volstaan met het voorhouden van de stukken, zoals blijkens het proces-verbaal ter terechtzitting in hoger beroep ook is gedaan.

14. Opmerking E) behelst een herhaling van de overweging van het Hof dat het gesloten stelsel van rechtsmiddelen op onaanvaardbare wijze zou worden doorkruist indien bij de behandeling van de zaak ter terechtzitting opnieuw of alsnog een beroep zou kunnen worden gedaan op verzuimen die aan de rechter-commissaris zijn of hadden kunnen worden voorgelegd. Volgens de toelichting kan de rechter ingevolge artikel 413 SV Aruba gevolgen verbinden aan normschendingen, waaronder normschendingen tijdens aanhouding/inverzekeringstelling en voorlopige hechtenis. Voorts wordt opgemerkt dat het feit dat een degelijke (ik neem aan dat bedoeld wordt: dergelijke) normschending aan de rechter-commissaris is voorgelegd, dan wel voorgelegd had kunnen worden hieraan niet af doet.

15. Uit de schriftuur zelf valt niet of nauwelijks op te maken of hier wordt geklaagd over een specifieke beslissing van het Hof. Nu een overweging van het Hof over de ontvankelijkheid van het openbaar ministerie wordt geciteerd, valt aan te nemen dat ook deze klacht zich richt tegen de beslissing het openbaar ministerie ontvankelijk te verklaren. De klacht is heel algemeen van aard. Niet betoogd wordt dat van een specifieke normschending in het onderhavige geval sprake is en dat daaraan een bepaald rechtsgevolg dient te worden verbonden. Inhoudelijke bespreking van de klacht kan achterwege blijven nu de klacht geen middel van cassatie is.(7)

16. In opmerking F) wordt de overweging van het Hof herhaald, inhoudende dat de raadsman niet heeft aangevoerd dat de verdachte in zijn verdediging is geschaad door het ontbreken van het CID- rapport. Volgens de toelichting zou de raadsman van verdachte hebben betoogd dat door het ontbreken van het CID- rapport niet is vast te stellen of er wel rechtmatige opsporingsmethoden zijn gebruikt. Door het CID- rapport als afscherming te gebruiken zou aan verdachte een fair trial zijn onthouden.
In de pleitnota heeft de raadsman van verdachte ter terechtzitting in hoger beroep betoogd dat de inhaaldagvaarding samen met andere normschendingen dient te leiden tot niet- ontvankelijkheid van het openbaar ministerie. In de pleitnota daarbij wordt tussen haakjes verwezen naar een aantal (vermeende) normschendingen en daartoe behoort ook: "het buiten het strafdossier houden van het CID-rapport."

17. Het Hof heeft bovenstaand verweer verworpen, zoals weergegeven hierboven onder 5. Over het CID -rapport wordt overwogen:

"Het CID-rapport bevat blijkens het dossier alleen startinformatie en behoefde dan ook niet aan het dossier te worden toegevoegd. Ook op dit punt heeft de raadsman overigens niet aangevoerd dat de verdachte daardoor in zijn verdediging is geschaad."

18. Ook ten aanzien van deze klacht geldt dat niet wordt aangegeven "waarom de gegeven beslissing onjuist is of in welk opzicht de motivering van die beslissing onvoldoende zou zijn".(Cool Derhalve kan deze klacht evenmin als een middel van cassatie worden beschouwd.

19. Opmerking G) geeft de overweging van het Hof weer, inhoudende dat de raadsman niet nader heeft toegelicht dat de getuigen zijn beïnvloed. Volgens de toelichting is in eerste aanleg uitvoerig aan de orde geweest dat het openbaar ministerie de getuigen [getuige 1 en 2] (de getuigen die ook niet werden opgeroepen in hoger beroep door de Procureur-Generaal) voor de zitting van 7 september 2007 heeft benaderd. Dit zou een ontoelaatbare beïnvloeding zijn, en dit is bij het Hof herhaald.
Uit de bij het proces-verbaal ter terechtzitting in hoger beroep behorende pleitnota maak ik op dat de raadsman enkel heeft aangevoerd dat de in eerste aanleg genoemde normschendingen, waaronder beïnvloeding getuigen, dienen te leiden tot niet-ontvankelijkheid. De pleitnota noch het proces-verbaal ter terechtzitting in hoger beroep houdt enige toelichting in over de in cassatie gestelde beïnvloeding van getuigen. Het oordeel van het Hof dat de raadsman niet nader heeft toegelicht dat de getuigen zijn beïnvloed is daarom niet onbegrijpelijk. De raadsman kan niet met vrucht in cassatie klagen over een toelichting op een stelling die hij wel in eerste aanleg heeft gegeven, maar in beroep niet heeft herhaald. Nu de klacht geen verbinding legt met de (motivering van de) beslissing betreffende de ontvankelijkheid van het openbaar ministerie meen ik dat deze klacht evenmin kan worden aangemerkt als een middel van cassatie.

20. Opmerking H) bevat de overweging van het Hof, inhoudende "dat 4 maal toegang weigeren tot verdachte, geen kennis kunnen nemen van de stukken tijdens de voorlopige hechtenis en onrechtmatige vrijheidsberoving geen normschendingen betekenen." Volgens de toelichting zouden deze normschendingen in eerste aanleg en in hoger beroep aan de hand van stukken zijn toegelicht. Betoogd wordt dat het normschendingen zijn omdat zij een inbreuk maken op de artikelen 59 en 70 Sv Aruba en wat de onrechtmatige vrijheidsberoving betreft op artikel 89 Sv Aruba.

21. Ook uit deze klacht valt niet op te maken "waarom de gegeven beslissing onjuist is of in welk opzicht de motivering van die beslissing onvoldoende zou zijn", en is er derhalve geen sprake van een middel van cassatie.(9) Van enige toelichting is overigens in hoger beroep geen sprake.

22. De opmerkingen I tot en met P, waarin de inhoud van het bestreden vonnis wordt weergegeven, kunnen niet als middelen van cassatie worden beschouwd.

23. In de daarop volgende opmerkingen 1 en 4 valt een klacht over de strafmotivering te lezen. Gesteld wordt dat het Hof in zijn strafmotivering niet de redenen heeft vermeld die tot de keuze van een vrijheidsontnemende straf hebben geleid.

24. Het Hof heeft ten aanzien van de op te leggen straf en maatregel het volgende overwogen:

"De op te leggen straf en maatregel
Bij de bepaling van de straf heeft het Hof gelet op de aard en de ernst van het bewezen en strafbaar verklaarde, op de omstandigheden waaronder de verdachte zich daaraan schuldig heeft gemaakt en op de persoon van de verdachte, zoals van een en ander uit het onderzoek ter terechtzitting in hoger beroep is gebleken.
Verdachte heeft als ambtenaar die werkzaamheden verrichtte bij de rijbewijsafdeling van het Korps Politie Aruba (KPA) duplicaat rijbewijzen valselijk opgemaakt en daarvoor telkens steekpenningen aangenomen. Daarnaast heeft hij gele kaarten, met daarop informatie over de afgelegde rijexamens van rijbewijshouders valselijk opgemaakt. Door rijbewijzen of extra categorieën te verzorgen voor mensen die niet middels een rijexamen hebben aangetoond in staat te zijn een gemotoriseerd voertuig van een bepaalde categorie (op een verantwoorde wijze) te kunnen besturen, heeft hij de verkeersveiligheid in Aruba ernstig in gevaar gebracht. Hij heeft het vertrouwen dat het KPA in zijn ambtenaren mag hebben geschonden en bovendien het aanzien van het KPA grovelijk geschaad. Van voormelde belangen heeft de verdachte zich niets aangetrokken. Hij was kennelijk slechts uit op geldelijk gewin. Hij heeft geen medewerking verleend aan het opsporingsonderzoek en dus ook geen inzicht gegeven in de motieven van zijn handelen.
Ten voordele van de verdachte houdt het Hof rekening met het feit dat de verdachte niet eerder veroordeeld is voor een strafbaar feit.
Strafvermindering op basis van de door de raadsman gestelde normschendingen komt om dezelfde redenen als onder het kopje 'de ontvankelijkheid van het OM' vermeld ad 1,2, 3, 5 en 6 niet in aanmerking. Ad 4 (de gestelde niet tijdige ondertekening van het proces- verbaal en het vonnis) geldt dat niet gesteld of aannemelijk geworden is dat de verdachte daardoor nadeel heeft ondervonden, zodat reeds om die reden (lees: geen; PV) strafvermindering zal worden gegeven.
Gelet op de aard en de ernst van het bewezen verklaarde acht het Hof een onvoorwaardelijke vrijheidsstraf van na te noemen duur noodzakelijk. Voor een zwaardere straf ziet het Hof, mede gelet op de (relatief beperkte) strafbedreiging die op
de bewezen verklaarde feiten staat, geen aanleiding."

25. De klacht dat wat het Hof ten aanzien van de op te leggen straf en maatregel heeft overwogen niet als een zodanige motivering kan gelden gezien het algemene en onvoldoende specifieke karakter ervan, mist feitelijke grondslag.(10) Immers blijkt uit bovenstaande strafmotivering dat het Hof niet heeft volstaan met de standaardmotivering, maar daarentegen de specifieke omstandigheden van het bewezenverklaarde daarbij in aanmerking heeft genomen. Die specifieke omstandigheden zijn bepalend voor de aard en ernst en van het bewezenverklaarde en maken naar het oordeel van het Hof de onvoorwaardelijke vrijheidsstraf noodzakelijk.

26. De opmerkingen 2 en 3 kunnen niet worden beschouwd als middelen van cassatie, aangezien aan de schendingen waarop die opmerkingen betrekking hebben geen eenduidige conclusie worden verbonden.

27. Opmerking 5 behelst de klacht dat in strijd met hetgeen bepaald is in artikel 408 Sv Aruba de bestreden uitspraak niet is voorgelezen aan verdachte door de griffier, en verdachte evenmin kennisgeving is gedaan van hetgeen is vermeld in artikel 409 Sv Aruba.

28. De in de klacht genoemde bepalingen luiden als volgt:

Artikel 408
1. De verdachte die zich ter zake van het ter terechtzitting onderzochte feit in voorlopige hechtenis bevindt, is bij de uitspraak
tegenwoordig, tenzij hij daartoe buiten staat is of hij mondeling of schriftelijk te kennen heeft gegeven weg te willen blijven.
2. Is zodanige verdachte tot het bijwonen van de uitspraak buiten staat, dan wordt ten spoedigste het vonnis hem ter plaatse waar hij wordt gevangengehouden, door de griffier voorgelezen, met de kennisgeving in artikel 409 voor de voorzitter voorgeschreven. Van een en ander wordt door de griffier op het vonnis melding gemaakt.

Artikel 409
1. Indien de verdachte in het geding in eerste aanleg bij het uitspreken van het vonnis tegenwoordig is, geeft de rechter hem daarbij mondeling kennis van het rechtsmiddel, dat tegen het vonnis openstaat, en van de termijn waarbinnen dat rechtsmiddel kan worden aangewend.
2. In hoger beroep geeft de voorzitter de verdachte op gelijke wijze kennis van diens bevoegdheid cassatie in te stellen bij de Hoge Raad der Nederlanden.

29. Het proces-verbaal ter terechtzitting van 10 maart 2008 houdt onder meer het volgende in:

"De verdachte, ter terechtzitting verschenen, (...)
Uitspraak vonnis
Aan de orde is de uitspraak van het vonnis in hoger beroep tegen het vonnis van 29 september 2007 van het Gerecht in Eerste Aanleg van Aruba.
De voorzitter spreekt het door het Hof in deze zaak gewezen vonnis in het openbaar uit en deelt de verdachte mede, dat voor het instellen van beroep in cassatie een termijn van 14 dagen na heden open staat."

30. De klacht mist feitelijke grondslag. Ten eerste was verdachte blijkens het hiervoor weergegeven proces-verbaal ter terechtzitting ter terechtzitting aanwezig, en is de uitspraak door de voorzitter uitgesproken. Voorlezing door de griffier geschiedt alleen indien de verdachte buiten staat is de uitspraak bij te wonen. Ten tweede heeft de voorzitter blijkens het hiervoor weergegeven proces-verbaal ter terechtzitting verdachte medegedeeld dat voor het instellen van beroep in cassatie een termijn van 14 dagen na de dag van de uitspraak openstaat.

31. Indien de schriftuur zo gelezen wordt dat deze één middel met meer onderdelen behelst, kan het (voor zover geklaagd wordt over de strafmotivering en de schending van de artikelen 408 en 408 Sv) worden verworpen met de aan artikel 81 RO ontleende motivering. Ambtshalve heb ik geen grond aangetroffen die tot vernietiging van het bestreden arrest behoort te leiden.

32. Deze conclusie strekt tot verwerping van het beroep.

1. 12. Article 337 Sv Aruba includes the following:

Article 337

20.
