HPD: Baby found dead in dumpster
December 28, 2010
HOUSTON -- The body of a newborn was found in a dumpster Tuesday at a southeast Houston apartment complex, Houston Police Department Homicide investigators said.

A maintenance man found the body at about 11:30 a.m. as he began trying to move trash from an overflowing dumpster at the WindShire Apartment complex to another one on the property, police said.

Police said the full-term or near-full-term baby girl was inside a vacuum cleaner box.

"The maintenance worker puts the box on a golf cart and takes it to an empty dumpster, and makes a turn, and the box falls off the cart -- and that is how he discovered the baby inside the box," said HPD Homicide Sgt. Will Gonzales.

Police could not say if the baby was delivered dead or alive -- the baby was dead when it was found.

Initially, investigators were considering the possibility that the baby could have been delivered somewhere else and dumped at the location, but late Tuesday afternoon, there was evidence found that suggested that the baby came from somewhere in the complex.

Police were searching for the baby’s mother Tuesday and said they were investigating a couple of possibilities at the WindShire Apartment complex.

Anyone with information about the case is asked to call HPD homicide.

Infant's body found in Houston trash bin
December 29, 2010

HOUSTON — Houston police say the body of a baby girl with the umbilical cord still attached was found in a box near a trash bin at a gated apartment complex.

Houston police Sgt. Will Gonzales says a maintenance worker found the box Tuesday morning near an overflowing trash bin.

Gonzales says the worker didn't look in the box, but placed it in a golf cart to move it to another bin. When the box fell off the cart, the body fell out.

Gonzales believes the child was born Monday night or early Tuesday.

He tells the Houston Chronicle that police didn't see any visible signs of trauma to her body.

Investigators at the Harris County Institute of Forensic Sciences will conduct an autopsy Wednesday.

Search continues for mom of dumpster baby
Updated 1:08 December 29, 2010
HOUSTON (KTRK) -- Houston police continue to investigate the disturbing case of a newborn's body found in a southeast Houston apartment dumpster . The discovery was made by a maintenance worker Tuesday morning.
Houston police are investigating the gruesome discovery at the complex on South Shaver near Crenshaw, but the identity of the mother for now is unknown.

An autopsy hasn't yet been performed to determine of the infant was stillborn.

In Texas, the Baby Moses law allows for a mother to safely leave an unwanted infant up to 60 days old at any hospital, fire station or EMT station without fear of prosecution. The baby can be handed over anonymously, and will receive proper medical care.

We'll have much more on this story, and the resources available to desperate mothers, on ABC13 Eyewitness News at 4pm and 6pm.

this is just sick!

women, if you aren't prepared to take care of a baby, get on birth control! not the baby's fault and has to lose their lives cause you are too selfish to do the right thing! this baby could have been given up for adoption. She did not deserve this. This egg donor spend the rest of her life in jail where she belongs.

Mom charged with murder more than 3 months after baby found dead in Dumpster
April 11, 2011

HOUSTON – A 23-year-old Houston mother was behind bars Monday, more than three months after her baby was found dead in a Dumpster.

Angelica Huerta Clark is charged with murder in connection with the death of her newborn daughter on December 28, 2010.

Police were called to the Windshire Apartments in the 4400 block of South Shaver around 10:45 a.m. that day, after the complex maintenance man found the baby.
 ::snipping2::
When police interviewed Clark, they said she initially denied being pregnant.

But after she saw officers going through trash from her home, she told investigators that she did have the baby, but that she didn’t know she was pregnant until she gave birth.
Much more of the story....
 ::snipping2::
But when the medical examiner autopsied the remains, he said the baby was alive and breathing when she was born.

He said the baby died from asphyxiation and exposure, and the manner of death was homicide.

According to the medical examiner, the fact that the newborn was left out in the 45-degree weather caused her organs to shut down, preventing her from breathing.

Clark was arrested on April 8 and was being held in the Harris County Jail without bond.

She was scheduled to appear in court Monday morning.
