Adam Baker is expected to be in Superior Court Wednesday for a plea deal, according to his attorney Mark Killian.

“We’ve worked out a plea agreement,” Killian told Superior Court Judge Beverly Beal when Baker’s case was called before the court.

Killian declined to comment on the agreement Tuesday, saying details of the arrangement had not been finalized.

Baker, 34, is charged with one felony count each of identity theft and obtaining property by false pretense for obtaining electricity from Duke Energy in a relative’s name at his Hickory home on 21st Avenue, NW, in August 2010.

His case was held open until Wednesday, when Killian requested that the matter be heard in court.

In addition to the two Catawba County felonies, Baker also has several misdemeanor charges pending against him in Caldwell County, including failure to return rental property, two counts of communicating threats, assault with a deadly weapon and 5 counts of worthless checks. He previously paid the money owed on the worthless check charges.

I hope he gets more than a slap on the wrist!
I am still convinced he had a hand in killing Zahra.

THE father of murdered disabled schoolgirl Zahra Baker hopes to be back in Australia next week.

Adam Baker, who was cleared by US authorities of any involvement in the murder and dismemberment of 10-year-old cancer survivor Zahra in 2010, is expected to agree to a plea deal in a North Carolina court today after being charged with identity theft and obtaining property by false pretences.

It is alleged he used a relative's name to hook up electricity to his North Carolina home.

After meeting with his lawyer Mark Killian and District Attorney's Office prosecutors it was announced Baker would return to the Catawba County Superior Court on Thursday.

Baker, 34, is also charged with nine misdemeanors in another North Carolina county, Caldwell County, including two counts of communicating threats and one count of assault with a deadly weapon.

Baker is not expected to serve jail time.

Mr Killian said he hopes both sets of charges will be resolved on Thursday (US time) and Baker will be on a plane back to Australia next week.

''(Baker) hopes to get back home so he can get back and return to work and do things any normal citizen will do,'' Killian told reporters.

Both Adam and Elisa Baker are expected to wrap up all of their charges in plea deals on Thursday.

Adam Baker came to Catawba County Superior Court on Wednesday, hoping his two felony charges would be resolved so he could move forward with his life. Instead, Baker was told he would have to return Thursday.

Mark Killian represents Baker on his Catawba County charges. He said Wednesday he hoped all of Baker’s charges in Catawba and Caldwell counties would be resolved Thursday, with the charges in Catawba County heard first.

Baker’s wife, Elisa, is also expected to attend a plea hearing Thursday in Charlotte. Elisa, 43, is facing seven federal drug charges involving prescription medications from May 2006 to October 2010. She faces a maximum penalty of 115 years in prison and a fine of $4.2 million if convicted of all charges.

Even if he was cleared of charges in Zahra's death and dismemberment, the  horrible way Zarha lived while in his care (and yes, she was in his care and he was responsible for her!) and the horrible way she died will follow him no matter where he goes imo.  Even if he had never raised a hand against Zahra, he still should be held accountable for child neglect and for failing to protect her in the very, very least.  Failure to provide medical aid.  She didn't have her cancer check ups and the too small prothesis had to be a big problem for Zahra.  It was said she was sick in bed.  He didn't take her to the doctor for that either. He failed to insure she was enrolled in school or receiving an education.  IMO he failed to protect her from abuse from Elisha, both physical and mental.  Others had witnessed this. He failed to stop or report Elisha abusing his daughter.   I find it very, very sad it was hot check charges and using a false name to get electric service turned on as the reason he's behind bars, and not because of Zahra.   I guess it's been decided by the powers that be to get him out of the country and back to Aus.  And equally sad Elisha is in jail for drug charges with plea deals    Where is the justice for Zahra?

CHARLOTTE, N.C. -- The North Carolina woman who pleaded guilty to killing her 10-year-old disabled stepdaughter has pleaded guilty to a federal drug charge.

Elisa Baker on Thursday pleaded guilty in U.S. District Court in Charlotte to one count of conspiracy to sell drugs. Prosecutors then agreed to drop six other charges.

No sentencing date has been set. Baker faces up to 20 years in prison and a $1 million dollar fine when she is sentenced.

LENOIR, N.C. -- Adam Baker, the father of the late Zahra Baker, was expected to plead guilty Thursday afternoon to misdemeanor charges, but he made a surprise move.

Instead, Baker pleaded not guilty to charges of three total counts of assault and communicating threats, all misdemeanors.

With that not guilty plea, Baker's trial started immediately on Thursday.

Baker, meanwhile, had to pay back $350 in restitution after pleading guilty to identity theft in a Catawba County courtroom earlier on Thursday.   ::snipping2::

He currently remains in the United States under an immigration detainer by the US Immigration and Customs Enforcement (ICE), which was placed on him following his arrest in April 2011. "As is routinely done in cases involving non-detained aliens arranging their own departure from the United States, Mr. Baker will provide ICE with flight details for his return to Australia and our agents will verify his departure," Picard said.

He could not comment on whether ICE had Baker's passport, saying that was a violation of Baker's privacy. But Picard said Baker no longer had an ankle monitoring device. And without talking about Baker specifically, Picard said ICE usually keeps individuals' passports until they leave the country.

However, the Hickory Daily Record newspaper reports District Court Judge BJ Mullinax sentenced Baker to 30 days in jail for an assault with a deadly weapon charge relating to an incident where Baker tried to use a car to run a family member off the road.

Baker, who was cleared by North Carolina authorities of playing any role in the 2010 murder and dismemberment of his 10-year-old cancer survivor daughter Zahra, will appeal against the jail sentence.

The judge agreed not to send him to prison until a ruling was made on the appeal.

So where does he serve the 18 months unsupervised probation?  Not feasible that he would spend it in Australia.

Also it seems it could be a while until we can see if our Customs and Immigration personnel meet him on his return to Australia with questions about his taking Zahra out of our country with forged documentation.

This is all beyond belief.

On a nicer note I think the memorial for Zahra off Dudley Shoals Road shows what caring and decent people live there.  Thank you to those involved from Australia.

Why oh why does this country's system continue to fail children so badly?! It's no wonder crimes against children continue to grow.  So, no justice, not even for neglecting his daughter so very badly. Not even that?!

The story of the 10-year-old Australian cancer survivor murdered by her real-life wicked stepmother has spawned strong reactions from scores of people who never had the chance to meet Zahra Baker.

Paul Wise is one of those people.

Friday afternoon, he took the opportunity to let the Hickory Police Department’s officers know how he feels about the job they did in solving Zahra’s murder when he presented them with a framed watercolor painting of Zahra.

Wise was at Full Circle Arts auction recently and saw a watercolor portrait of Zahra called “Little Miss Baker” painted by Hickory artist Tom Helfert. He bought the portrait, thinking he would send it to Emily. Emily already has received her print. She is a Facebook friend with Gary Ridgeway, and she sent this message to share with Wise.

“I just received my surprise from your neighbor, the portrait of Zahra. It has brought tears to my eyes. Please thank him from the bottom of my heart.

“I will get the picture framed after the New Year, once the crazy shoppers have left.

“I really can’t believe it. XOXO.

“Emily”

The original portrait will hang in the Hickory Police Department.

“This will be a constant reminder that our community needs to continue our efforts to protect our children and be willing to report any neglect and abuse,” Adkins said.
