CLARENDON, Texas - A Donley County man has been charged with capital murder in the death of his 4-year-old son.
An affidavit from Sheriff Charles "Butch" Blackburn says 38-year-old Robert Monroe Babcock provided information that linked him to the death of his son, Chance Mark Jones.
KVII-TV reports the boy was found unresponsive Tuesday at his home near Clarendon after the father called 911. The child later died at a hospital.
Blackburn says there was evidence that the victim was assaulted. Prosecutor Luke Inman says the boy suffered "a horrific death."
Further details on the child's injuries were not immediately released. An autopsy was scheduled Thursday.
The Donley County Sheriff's Office early Thursday declined to release more details on Babcock, who was arrested Tuesday.

Man charged in son's beating death

Authorities charged a Donley County man with capital murder in the death of his son, who died Wednesday, a few weeks after Child Protective Services placed the child in his father's care.
Donley County Sheriff Butch Blackburn said authorities found 4-year-old Chance Mark Jones unresponsive with cuts and bruises on his body about 9:40 a.m. Tuesday after the boy's father, Robert Monroe Babcock, 38, called 911 to report his son was injured. No one else lived at Babcock's home at 12750 County Road W. southeast of Clarendon, Blackburn said.
"It appeared the boy had had blunt force trauma to the head and also had bruising on his torso," he said.
Blackburn said emergency officials flew Chance by LifeStar helicopter to Northwest Texas Hospital in Amarillo, where he died. An autopsy has been ordered for today in Lubbock.
Deputies interviewed Babcock on Tuesday, and he was charged with capital murder Wednesday. He remained in the Donley County jail Wednesday night and was expected to be arraigned today.
Blackburn said officials believe the apparent abuse started around Dec. 25. There were no signs of sexual abuse, he said.
"This young, defenseless child suffered a horrific death," 100th Judicial District Attorney Luke Inman said in a statement.
Blackburn said the boy was enrolled in Clarendon Consolidated Independent School District's Head Start program, which was on holiday break until Wednesday. There were no previous reports of abuse, and deputies had never been called to the home before Tuesday, he said.
CPS spokesman Paul Zimmerman said Chance was placed with Babcock in mid-December after case workers started investigating abuse or neglect allegations against the mother of the child and his 2-year-old half sister.
Zimmerman said the boy's mother voluntarily surrendered the two children. CPS conducted "a family team meeting" with all interested parties to determine what to do with the children.
"The mom said she wanted (Chance) to be placed with the biological father," Zimmerman said. Placements with screened relatives are common in lieu of foster care, he said. CPS would not discuss the placement of the other child.
He could not discuss why the children were removed from their mother's care or release her name, citing privacy rights. Zimmerman said CPS was working with the mother on a plan that could reunite her with her two children if she met certain requirements.
He said CPS officials ran a background check on Babcock before Chance went to live with his father. It included a criminal history check, a CPS history review and lengthy interviews.
"He checked out," Zimmerman said.
Zimmerman said other than a driving under the influence arrest in 2006 and some "minor stuff" in 1997, Babcock had a clean criminal history. "(The charges) didn't weigh in on his ability to properly care for a child," he said.
Zimmerman did not know if Chance knew his father before being placed with him or if Babcock had cared for the boy before.
Blackburn said his office and the Texas Rangers are still investigating. He said Chance's death was the county's first homicide in more than a decade.

Two days after her four-year-old son's death, Chance Mark Jones' mom is pointing fingers at Child Protective Services. Nancy Brown says she has nightmares about what happened to her son in a home Southeast of Clarendon.
She says, "He looked like he'd been tossed around like a ragdoll than run over by an 18-wheeler."
The four-year-old died Wednesday morning, allegedly at the hands of his own dad, Robert Babcock... Who now sits behind bars in Donley County for capital murder.
The boy was taken away from his mom in mid-November, after CPS found evidence of abuse and neglect. Following a criminal background check and an in-depth interview, CPS allowed Babcock to take custody of his son in mid-December.
While Brown says she never thought Babcock was capable of something like this, she says it could have been prevented. "I do believe CPS should have been doing their house checks with the kids that they have not done and they may have caught the child abuse early."
She's blaming the agency, saying they did not play by the rules. But CPS says they acted by the book.
CPS tells us in cases where the biological parent is in custody, they do not have to do welfare checks every ten days like they would if it was not the biological parent who has custody.
Texas Rangers say the young boy had been beaten sporadically since Christmas Eve. If convicted, his dad could face the death penalty.

Forgive me Ms. Brown, but if you had been doing what you were suppose to be doing, your son would still be alive and with you. IMO the bio dad is a POS and you need to go look in the mirror.

MEMPHIS, Texas (AP) -
A Texas Panhandle man has been sentenced to life in prison for the 2011 beating death of his 4-year-old son.
A Hall County jury on Thursday afternoon convicted 39-year-old Robert Monroe Babcock of capital murder. Prosecutors did not seek the death penalty, so
the Clarendon-area man received an automatic sentence of life in prison without parole.
