Baby girl found dead in dumpster named by Liverpool Police

Liverpool (WSYR-TV) - Liverpool Police have named the infant girl discovered dead in a dumpster outside an apartment complex last Thursday Isabella Marie. The department announced Tuesday it would handle funeral arrangements for the infant.

Police are still looking for the baby's mother. Anyone with information is asked to call 457-0722.

Liverpool (WSYR-TV) - Liverpool Police say they will "adopt" the infant found dead in a dumpster last Thursday, just a day after being born. When the body is released, the department will make arrangements for a funeral and burial.

Prosecutors say they're making progress in their investigation, as they work to find the parents that left their newborn in the dumpster outside an apartment complex on Pearl Street in the Village. They report following many leads provided by tips from the public and the Department of Social Services.

The preliminary autopsy of the child is complete, but details about the gender and the condition of its birth are not being released at this time. Such information could play a role in criminal charges.

Police originally said they believed the parents were likely residents of the area, but Assistant District Attorney Rick Trunfio says they're keeping open the possibility the mother was simply passing through.

Anyone who may have information about this case, but hasn't yet contacted Liverpool Police can do so by calling 457-0722.

Liverpool (WSYR-TV) - The Onondaga County District Attorney's Office says the investigation into how a newborn baby ended up inside a dumpster Thursday night is a criminal investigation.

ADA Rick Trunfio says the case has always been considered a criminal investigation because of the way the child’s body was found.

Trunfio says the preliminary autopsy is now complete.
Meanwhile, Liverpool Police are putting in extra hours to follow leads.  They are still searching for the parents who left their newborn baby in a dumpster outside the Pearl Street Apartment complex.

Liverpool Police Chief William Becker said a man, later identified as Michael Denardo, found the baby while searching through the dumpster. "As soon as he identified it as being a child and not a toy, he was extremely quick to contact our agency," Becker said.

"I had to get away from that for a few minutes, because it made me sick to my stomach. I just had to hurry up, get down to the… I just thought I had to get down to the police station and let them know this," Denardo said.

Chief Becker says the baby was born Thursday, and left in the dumpster the same day. No attempt was made to conceal the child.


Denardo's friend, Larry Boyer of Liverpool, said Denardo was looking for spare wood in the dumpster. He added that his friend was very distraught by finding the baby. "He was over at my house last night and he is messed up about it. He really was. I tried giving him any support he wanted," Boyer said.

Liverpool Deputy Fire Chief Jason Ormsby was one of the first on scene after the child was reported. On the way there, he hung onto hope that it wouldn't turn out the way it did. "You just hope it's not going to be a real baby that maybe it was just a doll or something of the sorts," he said. "It definitely makes you upset. Initially you always want to ask, 'why?'"

Early Friday morning, the police canvassed a nearby apartment complex and removed the dumpster the infant was found near as well as one 15 feet away. The police took the dumpsters to a secure location to search them for evidence. They finished collecting evidence from the dumpsters around 6 a.m. and anticipated returning them to the site. "We were able to take our time to search for any physical evidence that might have been left along with the child," Becker said.

Chief Becker said police were concerned that the snow would damage evidence that might be in the containers.

Police believe the mother is from the immediate area, and are trying to locate the parents. They urge anyone with information to come forward, and say they've already received some credible tips from the public. "Some of it has been very helpful. Some of it has given us new direction to take our investigation as well," Chief Becker said.

Safe Haven Law provides refuge for children

Syracuse (WSYR-TV) - On Thursday night, a dead infant was discovered in a dumpster in a Liverpool apartment complex, but the nearby Liverpool Fire Department would have provided a refuge for the child along with anonymity for the mother.

The Safe Haven Law provides parents with a safe alternative for children that parents cannot keep. According to the law, children can be dropped off at a fire house, a police station, or a hospital.

The Syracuse Fire Department recently gave such a child refuge.

"They need to know there's a place that'll accept the child, take good care of the child and do whatever it needs to make the child safe," Syracuse City Deputy Fire Chief Ed Kurtz.

Under the law, the parent cannot be prosecuted for abandonment if the infant is five days old or fewer. In addition, the parent must intend for the infant to be safe from harm and they must leave the baby with an appropriate person.

"We see tragedy all the time. And, if we can avert one it's something we want to do. All people are more than willing to accept a child, they want to do this," Kurtz said.

Fire Departments are trained for such situations. They send the child to the hospital for evaluation, call child protective services, and complete the appropriate paperwork, but the parent does not have to leave their name.

Update, 4:30 p.m.: District Attorney William Fitzpatrick said Friday that the 29-year-old mother of a baby found dead in a trash bin had been staying in Liverpool. Authorities are still awaiting results from the Onondaga Count medical examiner's office, but Fitzpatrick said in a news conference Friday that if the baby was alive when it was left in the trash bin, he was considering a charge of second-degree murder.

Liverpool, NY -- The mother of a newborn child left dead in a Liverpool trash bin has been found, Liverpool Police Chief William J. Becker said today.

The mother is a 29-year-old woman who lives in the area, Becker said, but declined to identify the woman further. The woman has been interviewed by officers and has provided police a statement, Becker said. The woman was located Thursday.

The woman is being examined and treated for medical issues related to the birth of the child, he said.

Police have not charged the woman, Becker said. The department and the district attorney’s office are awaiting the Onondaga County Medical Examiner’s final report regarding the cause and manner of death of the newborn before any charges could be considered, Becker said.

Police are also examining all the evidence in the case, he said, and detectives are still following leads in the case in an effort to identify everyone connected to the case.

Investigators gave the child the name Isabella, a name suggested by the village police clerk, Becker said. The child was found late Jan. 6 in a trash bin in the 200 block of Pearl Street in the village.

Liverpool, NY -- Nicole C. DeJaynes, the woman accused of putting her newborn in a Liverpool trash bin, is already the mother of a 5-year-old, Onondaga County District Attorney William Fitzpatrick said this morning.

DeJaynes was arraigned Friday night before Liverpool Village Judge Anthony LaValle on a charge of second-degree murder.

She is being held without bail in the Onondaga County Justice Center.

If her lawyer chooses, DeJaynes could appear at a preliminary hearing sometime before Wednesday, Fitzpatrick said.


“I anticipate the medical examiner will have final conclusions by then,” he said.

One of the questions prosecutors need to answer is whether the newborn, named Isabella Marie by Liverpool police officers, was still born or born alive and placed in the trash bin later.
If the child was still,born, the mother could face misdemeanor charges, Fitzpatrick said at a Friday news conference.

If convicted of second degree murder DeJaynes, 29, could face a maximum of 25 years to life in prison, he said this morning.

DeJaynes has a 5-year-old child, but he did not know the child’s sex, Fitzpatrick said this morning. The Department of Social Services is involved with the case, he said.

The child is being cared for by its grandmother, First Chief Assistant District Attorney Rick Trunfio said this morning.

In his time with the office, Fitzpatrick said he can recall five cases in which the mother has disposed of a child in some way.

A man looking for scrap wood in a trash bin behind the Pearl Street Apartments in Liverpool found the newborn’s body on Jan. 6.

The police asked for the public’s help in finding its parents, and a tip from the public lead to DeJaynes.

She didn’t admit anything when she was first questioned by the police four days ago, police said. Since then she has given them a statement, they said.

DeJaynes expressed no remorse to police, said Liverpool Police Chief William Becker at a news conference Friday afternoon.

At the news conference, Fitzpatrick said he would not charge the baby’s mother until there was further review of the facts, circumstances and more complete findings from the medical examiner.

However, police were not notified when DeJaynes was released Friday from a medical facility where she was being evaluated.

“With that critical change in circumstance, combined with concern that she would be a flight risk, District Attorney Fitzpatrick determined that the time table of the charging decision had to be expedited,” a news release said Friday night.

Update: A court appearance scheduled for Nicole DeJaynes in Liverpool Thursday will not be held as her lawyer has agreed to waive her case directly to a grand jury for review, according to First Chief Assistant District Attorney Rick Trunfio.

Syracuse, NY - The baby whose body was found in a trash bin outside a Liverpool apartment complex two weeks ago was suffocated, District Attorney William J. Fitzpatrick announced this morning.

In a brief written statement, Fitzpatrick said the chief medical examiner, Dr. Robert Stoppacher, had determined the baby was born alive and that suffocation was the cause of death.

The body of the baby girl was found Jan. 6 in a trash bin outside the Pearl Street Apartments. Police didn't locate the mother, Nicole DeJaynes, until a week later.

DeJaynes, 29, was charged Friday with second-degree murder when she suddenly checked out of a medical facility to the surprise of law enforcement authorities who thought she was going to be in the facility for several days.

Fitzpatrick today indicated the second-degree murder charge filed last week was based on Stoppacher's preliminary autopsy findings.

The case now will go before an Onondaga County grand jury to determine what charges DeJaynes will be prosecuted for in the baby's death, the District Attorney reported.

First Chief Assistant District Attorney Rick Trunfio today said authorities will now be continuing their investigation to determine exactly how the baby was suffocated.

"We know what she (DeJaynes) said she did," Trunfio said. But officials now will be checking the mother's story against the evidence to see if they match, he added.

Trunfio declined to say what DeJaynes told authorities happened after she gave birth to the baby girl.

According to Trunfio, DeJaynes gave birth to the baby at the apartment complex where the remains were found. He declined to say, however, where exactly the birth took place, if it was in the apartment where DeJaynes reportedly had been staying with friends and if anyone else was present for the delivery.

Trunfio said officials have determined the baby was dead when its remains were placed in the trash bin outside. He also said authorities have determined it was DeJaynes who threw the baby's body in the trash bin.

At this point, authorities do not believe anyone else was involved in that, he added. But the investigation is continuing.

According to Trunfio, the murder charge lodged against DeJaynes Friday night accused her of causing the baby's death by suffocation, based on the preliminary autopsy findings. The medical examiner then needed to verify those preliminary findings by studying other forensic evidence from the autopsy, the prosecutor said.

Trunfio said the critical element for authorities to proceed with a criminal case against the mother was determining the baby was born alive.

"A person has to be born alive. That's crucial to any prosecution for homicide," the prosecutor said.

According to Trunfio, the issue is whether the medical examiner can show "to a reasonable degree of medical certainty" that the baby took a breath after birth. The circumstances of how the baby then ended up dead will dictate what level of homicide charge is pursued against DeJaynes in the grand jury and for trial, he added.

Syracuse, NY - The woman accused of murdering her newborn daughter and throwing the body in a trash bin denies doing anything to harm her baby, the woman's lawyer said this afternoon.

"She denies having done anything to intentionally cause the death of her baby. She denies having done anything to harm the baby," defense lawyer Thomas Ryan said of Nicole DeJaynes.

The District Attorney's Office revealed Wednesday that the baby was born alive and then suffocated Jan. 6. But Ryan said DeJaynes thought the baby was born dead.

"As far as she could tell, the child was not alive," Ryan said.

The defense lawyer said DeJaynes reportedly was all alone in a friend's apartment at the Pearl Street Apartments complex in Liverpool when she gave birth to the baby. There was a lot of blood from the delivery and DeJayne did not have any medical professional available to help her at that time, he said.

"She attempted to do what she could to save the child," Ryan said. She rubbed the child's body, held the baby and tried to get some color into the child, the lawyer said.

Eventually, DeJaynes took the body and disposed of it in the trash bin outside the apartment building, Ryan said. Ryan said some time passed between the birth of the baby and the disposal of the body in the trash bin but he was not sure how long.

DeJayne's admission to throwing away the body was the only admission of any potential criminal liability she made in talking to police last week, the lawyer said.

According to Ryan, DeJaynes' account of what happened is contained in a two-page written statement she gave to police Jan. 13, That's one week after the baby's body was found in the trash bin.

It's also the day before police announced they had located the baby's mother after a week-long search. Several hours after police announced they had located the baby's mother, DeJaynes was charged with second-degree murder when she left the medical facility where she had gone for treatment.

According to Ryan, police had taken DeJaynes to St. Joseph's Hospital Health Center after questioning her in the baby's death. The lawyer said he did not know of any requirement for DeJaynes to remain in the hospital.

She told a detective she would be returning to her mother's home when she was released and that's exactly what she did, Ryan said.

"She certainly didn't leave (the hospital) against medical advice," he added.

Ryan took sharp exception to the law enforcement contention that authorities believed DeJaynes was getting ready to flee.

The lawyer said he believes authorities used that as "an excuse" to arrest her Friday night when they did not have any real basis to charge DeJaynes at the time with any crime in the baby's death.

"There was no basis for anyone to claim she was going to flee," he said. "She went home to her mother's."

Authorities reported police were notified when a Department of Social Services worker found DeJaynes at her mother's home. That's when DeJaynes was charged with second-degree murder based on preliminary autopsy results showing the baby had been suffocated, authorities said.

Ryan said he has not yet received any of the reports from the medical examiner's office supporting the prosecution's suffocation contention.

"Children sometimes die in childbirth," Ryan said, noting he's waiting to see exactly what the medical examiner's reports say about evidence the baby took any breaths after being delivered.

Ryan said it's possible the baby may have taken a single breath before suffocating on mucus in its mouth and nose because DeJaynes was not equipped to deal with the situation.

Ryan said he did not know why DeJaynes did not seek help before giving birth to the baby. He also said he did not know what prompted her to dispose of the baby's body in the trash bin rather than calling for help.

"I don't know if she was in shock, if she was confused, if she was scared, if she just didn't know what to do," he said.

DeJaynes' mental and emotional condition have been of key concern in recent days, Ryan said.

According to the lawyer, DeJaynes has been on "one-on-one watch" in the Justice Center jail since her arrest. That was relaxed Wednesday so she is checked on frequently, he said.

Ryan said he has no immediate plans to seek a bail review for DeJaynes to try and get her released from the jail.

"I'm just making sure she's okay," he said.
