Texas Statues on Possession Child Phonography

§ 43.26. POSSESSION OR PROMOTION OF CHILD
PORNOGRAPHY.  (a) A person commits an offense if:
      (1)  the person knowingly or intentionally possesses
visual material that visually depicts a child younger than 18 years
of age at the time the image of the child was made who is engaging in
sexual conduct;  and
      (2)  the person knows that the material depicts the
child as described by Subdivision (1).
   (b)  In this section:                                                         
      (1)  "Promote" has the meaning assigned by Section
43.25.                   
      (2)  "Sexual conduct" has the meaning assigned by
Section 43.25.           
      (3)  "Visual material" means:                                                 
         (A)  any film, photograph, videotape, negative,
or slide or any photographic reproduction that contains or
incorporates in any manner any film, photograph, videotape,
negative, or slide;  or
         (B)  any disk, diskette, or other physical medium
that allows an image to be displayed on a computer or other video
screen and any image transmitted to a computer or other video screen
by telephone line, cable, satellite transmission, or other method.
   (c)  The affirmative defenses provided by Section 43.25(f)
also apply to a prosecution under this section.
   (d)  An offense under Subsection (a) is a felony of the third
degree.       
   (e)  A person commits an offense if:                                           
      (1)  the person knowingly or intentionally promotes or
possesses with intent to promote material described by Subsection
(a)(1);  and
      (2)  the person knows that the material depicts the
child as described by Subsection (a)(1).
   (f)  A person who possesses visual material that contains six
or more identical visual depictions of a child as described by
Subsection (a)(1) is presumed to possess the material with the
intent to promote the material.
   (g)  An offense under Subsection (e) is a felony of the
second degree. 


Punishment  for second degree felony is imprisonment for a period of
not less than two years and not more than 20 years, and a $10,000 fine.

This statute is pretty close to other states....this applies to BOTH Shawn & Billie

She cannot claim stupidity on this one, it was in her drawer of her home.  Even if she attempts to claim she didnt know he had it, certainly he wouldnt have put it in her dresser drawer!   Wonder if this is what he was doing in their room when David came home...possibly reliving what he did in some demented heinous fashion.

It just occurred to me that ugly creeks and ugly fields are offensive to BD, but apparently porn and "deviant images" (which I suspect are like the one that SA has on his old myspace, and her own brother has on his myspace - DD) are acceptable to be kept in the house in a dresser, as well as descriptions of sexual crimes kept under the bed.

Bed, bedroom, deviance.  The world gets to look in your bedroom when you let someone like SA into your life (or is BD into it as strongly) and your kid goes missing.  There are no secrets anymore.  Honestly, it's kind of awful.

To be honest, BD is going to have some pretty fancy tap-dancing to be doing, because the stuff she printed out at work and stored beneath her bed contained a good amount of sexual-type crimes done to the underaged.  Note - I am NOT saying that it was her interest, but you know - if you have that stuff that YOU obviously printed, and similar but worse content in YOUR dresser (when SA is supposedly moved out) .... there's some 'splainin' to do, and it is NOT going to be pretty.

Personally I am very very uncomfortable with the combination of the following:

The possibility of victim grooming by SA on HD via a relationship with BD (unproven)
The location of these materials, both printed and saved: bedroom, and not the closet (proven).
The types of images that we see SA is interested in by his representation of himself on his old myspace. (publicly available), i.o.w. murdered and dismembered young blondes in bondage gear.
The types of images that BD's brother has on his myspace (same as Shawn's) (pubicly available)
The abrupt and unique description by SA of HD as promiscuous, boy crazy, experimental, and loving him with "all her heart"  (public descriptions and documents).
A missing, cute, blonde girl.

I have been with my husband for years and years and we have a young daughter. I love my husband dearly, but if I EVER found anything like that on our computer, EVEN ON SINGLE IMAGE, he would be out the door and I would file for immediate sole custody. There is never ever any excuse for this filth!

Almost 109,000 images and videos depicting "deviant acts" and pornography were found on a computer and memory stick confiscated in the investigating of the disappearance of Colorado City teenager Hailey Dunn, according to authorities investigating the case.

The Dell Inspiron 530 computer contained "approximately 108,498 pictures depicting deviant acts," according to evidence seized after a search warrant issued in early January. The computer was confiscated from the home of Shawn Adkins' mother in the 2800 block of Apache Street in Big Spring.

A memory stick confiscated from a dresser in the master bedroom of the Dunn residence in Colorado City was found to contain "320 images and videos of a pornographic nature."

Both the computer and the memory stick contain images depicting bestiality and child pornography, said Mitchell County Sheriff Patrick Toombs.

Criminal charges could be filed regarding the memory stick found at the Dunn residence, Toombs said.

"We will have to get with the district attorney in Howard County to see if criminal charges are warranted," Toombs said about the images reportedly found on the computer hard drive.
