Yes, the memory stick or flash drive serve as portables that can go into any computer.   The material is owned & stored on it, that is still possession because it can still be viewed & distributed.

Texas Statues on Possession Child Phonography

§ 43.26. POSSESSION OR PROMOTION OF CHILD
PORNOGRAPHY.  (a) A person commits an offense if:
      (1)  the person knowingly or intentionally possesses
visual material that visually depicts a child younger than 18 years
of age at the time the image of the child was made who is engaging in
sexual conduct;  and
      (2)  the person knows that the material depicts the
child as described by Subdivision (1).
   (b)  In this section:                                                         
      (1)  "Promote" has the meaning assigned by Section
43.25.                   
      (2)  "Sexual conduct" has the meaning assigned by
Section 43.25.           
      (3)  "Visual material" means:                                                 
         (A)  any film, photograph, videotape, negative,
or slide or any photographic reproduction that contains or
incorporates in any manner any film, photograph, videotape,
negative, or slide;  or
        (B)  any disk, diskette, or other physical medium
that allows an image to be displayed on a computer or other video
screen and any image transmitted to a computer or other video screen
by telephone line, cable, satellite transmission, or other method.
   (c)  The affirmative defenses provided by Section 43.25(f)
also apply to a prosecution under this section.
   (d)  An offense under Subsection (a) is a felony of the third
degree.       
   (e)  A person commits an offense if:                                           
      (1)  the person knowingly or intentionally promotes or
possesses with intent to promote material described by Subsection
(a)(1);  and
      (2)  the person knows that the material depicts the
child as described by Subsection (a)(1).
   (f)  A person who possesses visual material that contains six
or more identical visual depictions of a child as described by
Subsection (a)(1) is presumed to possess the material with the
intent to promote the material.
   (g)  An offense under Subsection (e) is a felony of the
second degree. 


Punishment  for second degree felony is imprisonment for a period of
not less than two years and not more than 20 years, and a $10,000 fine.

Up until now ... I believe that Billie actions have been immoral in her attempt to  distance Shawn from implication in the disappearance of her daughter but ... not illegal.  With the revelation of the pornography which was found in her home ... I believe that a high power attorney will emerge and ... that will be the last we will hear out of Billie's mouth.

I follow what you are saying.  I wonder this as well.  Might be a part of what contributed to her son being removed from the home?  I wonder if they were hoping to use it as part of the evidence against SA or BD in regards to Hailey missing.  And then when it was revealed via the open records request, they were forced to have the DA consider it sooner and as a single charge instead of part of a number of charges related to the disappearance.

The computer was at SA's mother -- would DD have access to it.  As far as the flash-drive, there should be fingerprints or dna on it to suggest who had possession of it.

Janet , they probably sent it to a computer expert not only to view the images but to do a thorough investigation of the hard drive, trace IP's, dust for fingerprints, etc. etc.   They had to catalog every piece.  I think this was already done or almost done but the Reporter requested the public record of same so that is why we are hearing about it now.   It actually probably went with the FBI, not completely positive of that.

Nothing for nothing, Billie and/or Shawn could also face child endangerment charges.   They had that child pornography material in their possession with minor child in the home & since Billie had knowledge of its existence and didnt remove Shawn from the home she put her children at risk.

As to the question as a devil's advocate asking if it is possible she didnt know...logic dictates that although Shawn is a psycho, if he wanted to conceal that magnitude of filth from her he certainly wouldnt have hide it in her bedroom bureau drawer, a place where she goes in and out of on a regular basis.  She had to know it was there.

I see alot of people are getting confused with le's terminology of the PNY Attache 2GB USB Memory Stick. Clint and Billie were both guests on the NG show on January 4th.  Considering Clint did not say anything contrary when Billie claimed there was no computer in her home ... could it be that Shawn used his mother's computer in regards to pornography but brought the "stick" and videos home and hid them?

In other words ... Could it be that Billie was not aware of Shawn's sick perversion.  I assume Billie's reaction to this latest revelation will tell the story.

Capp, I think you got confused. According to an affidavit, police investigators learned of Shawn's computer usage on his mom's computer, so they were granted voluntarily by Christine to come pick it up and search it for clues in Hailey's disappearance. The police got her computer on Dec 30th, her husband answered the door and gave it to investigators. Then, on Jan 5th, Christine called the police station to let them know she was on her way to retrieve her computer, so they checked it into evidence and filed an affidavit. The affidavit filed requesting certain and specific electronics from Billie's home was signed by a judge on Jan 6th. So, I personally believe the investigators knew something was up with Shawn based on what they found on the computer. Then for them to be specific in the affidavits for what they were looking for in Billie's home, it has to be linked unequivocally to Shawn...bc why or how could anybody else from Christine's home come into Billie's home & hide a disk behind a bunch of dvd's in the master bedroom, or hide a portable mem/flash stick in the bottom corner of a drawer?
