This is another tactical error by this defense if you ask me.  She has been very specific to say that her finding does not eliminate other causes ( such as other than a dead person) this is well covered in deposition.

She should be focusing on the fact that there is no case law in existance for it's use at trial, that is really the heart of "methodology and process" in reverse.  It won't work but it is a stronger issue in my mind.

Dammit! At this point even I understand the difference between postem mortem root bands and darkening not rising to the level of pmrb. Why in hell is this defense lady so dense?

Agree, it seems this defense team is thick in hot air & thin in case law in general.

I believe Ashton is objecting even more than need be to unnerve her & interrupt any rhythm she possibly could muster.

I was under the impression for a while that Simms was a cut above the defense team, but today shows me that's a big NEGATIVE! She's right at home!

Sort of.....I think she is wanting to state that there is a dark area as well on the hair of living beings. However, the witness has stated several times that there is no confusing the two dark areas.
