The "trial phase" HAS to be unanimous for conviction. A "deadlocked or hung" jury would result in a retrial.

So, either all 12 vote guilty or all 12 vote not guilty or judge declares a mistrial and state decides if they will retry her, right?  But, she would stay in the pokey if they decide to retry her.  Would the state have to say right away if they are going to retry her, or would she go back to jail and await the state's decision? 
In most every circumstance that I've seen -- the Prosecution pretty much decides immediately whether or not to re-try the case. If a jury is pretty much evenly divided, they would probably weigh their odds of a conviction on re-trial. I think a lot depends on whether some evidence is allowed into the original trial or if the Prosecution feels they themselves blew the original trial. If the Prosecution truly believes the defendant is guilty -- they will try again. (I also think the defedant has a very good chance of staying out of custody in this instance.)

Isn't KC already serving a 5-year term for conviction of writing all those bad checks?

I think you are right!! They WILL look for away to keep them locked up if they can!

Same here. The speculation in my house is that they let kc take the heat for the entire thing... she'll claim they were all involved. In the first phone call home kc said to cindy, "You don't know what my involvement is and stuff?"

We all know what she really meant is "You're not backing me up." But she can try to turn it into something else. She could claim she "doesn't know where's she at" as in the call home that day because she really didn't know, but they did...that they put Caylee there. She's got some evidence she can use like Jesse telling police that Lee told him Cindy tried to choke kc. She could say there was a violent fight and Caylee was hurt in the process and eventually died while on her watch after she ran away in fear for her and her daughter's lives and they put all the dirt on her hands alone.

Who knows with this sick monster...but it sure sounds like scapegoat means kc gets blamed for it all.

At this point I wouldn't put it past this monster to blame her crime on Jesus Christ Himself. It's a darn good thing George got the tow yard guy to go back with him to check the trunk at the tow yard...if he hadn't had a witness when opening the trunk, I wonder how the defense would have spun that one. It wouldn't be enough to get her out of this but wow, when I think if she had been a little smarter what she could have and would have done. At times I wonder if she didn't try to think of some way to pin this on George and/or Cindy way before June 08'.

Now that I think of it, strange that GA asked the tow yard guy to go check the trunk with him that day. I do feel certain the family knew something bad happened, and when he smelled kc's car at the tow yard that clenched it for him and he knew it wasn't kc. They had talked to her on the phone but never Caylee. Makes me wonder if GA knew kc would try to blame it on him if given any room to, so he made sure he had a witness with him. He knows her well. The rotten apple didn't fall far from the tree.
