Right. They can still have her stricken.

Count so far:

8 coming back:

Males= #1340, #1232, #1129, #1019

Females= #1398, #1312, #1055, #1319


Again, I ask.... are we seating the actual jury and we have 8 so far -- or are we merely selecting jurors to go to the next round? They have a looooooooooong ways to go to seat 12 + alternates if so!

Judge Perry is going to bring in these 8 and 4 more they get to today on Saturday. (Tomorrow.)

If the State and the Defense do not use any of their strikes (they each get 10) to strike the jurors, then they will be sworn in.

He has not mentioned how/when he will get the alternatives yet.

Hope this makes sense.
It makes sense -- but if they only bring 12 in tomorrow (and each side has 10 pre-emptive strikes) -- they will need AT LEAST another week to seat 12 and alternates.

They will need more time, for sure.

How much more, remains to be seen.

I honestly thought they didn't need a reason, I thought if they didn't want them they just said it and they were gone. Isn't that what the 10 challenges are for?

They objected for cause & that was denied.   The State did not use a peremptory challenges.  The State can use one of their 10 PC's.

Ok so The PC is you can dismiss any 10 you like for no reason..



The only reason race was brought up is because the defense made a stink over it in earlier days of voir dire, it wasnt what the judge based his ruling on an objection for cause.   Yes, the State can use one of their peremptory challenges in back strike.

Ok i wasn't even thinking about race. I was concerned that she did a complete 180. So basically the the defense did that to force the state to use one of their PC. Which is fine worth it keep it moving!

I know you didnt, others were concerned it was an issue the judge considered, he did not.   He ruled on the objection to her clear statement that she was against the DP and then changed her answer upon being questioned by the judge.

According to Judge Eaton, it's perfectly legal.  I think it sucks.

Yes, I read that too by Judge Eaton in his "Ask the Judge" thingy.

i hate when the race card is used in any way shape or form but if it needs to be used in some way to make the jury demographics equivalent to orlando's demographics then i guess i have to be ok with it so that it never becomes a basis for appeal.  it's still frustrating though. i think all people regardless of race should be placed on the jury based on if they are qualified to fairly hear the case, not the color of their skin. the political correctness in this country is crazy. this is about an innocent 2 year old murdered baby, not race BOZO.

ICA acts like she does not have a care in the world! 

That won't last, west. When trial begins, things won't go well for the defense and I think we'll see reaction from KC as things go downhill.

I hope so. i am sure they will get to see all the sides of ICA. Crying on cue, flirting, mad, sick, laughing

I have to come down and say I am totally shocked at JP's ruling about that juror.    I am not sure she has the intellect to process the magnitude of forensic evidence in this case.  WOW!

I agree with your assessmennt. That juror is a weird combo of inefficient intellect and "wanna be too much" juror, IMO.
a "wanna be too much" is for sure.  You look lovely CBB.

This is the lady that was not for the death penalty

She needs to go.   The standard in DP cases should be neutral or for but not against.  If one is against its unlikely that they would change their position & then it tilts the jury automatically, IMHO.

The whole death penalty vs LWOP won't come in until penalty phase..and at penalty phase they just need a majority vote for the DP..not unanimous vote.  And I think even if it is a tie 6 to 6 the judge can break the tie towards DP.

I read the same thing about a tie.

 

Correct me if I am wrong, but in Florida even if it's unanimous the Judge has to rule on it anyway....seems like in the trial of John Coey it was 11-1 for death but the judge had to affirm that one too ...

Yes..DP is always reviewed by judge and this iswhy he can also be the one to break a 6/6 tie.

Thanks - that is what I thought. I remember moving here and learning about the majority vote vs unanimous vote wrt the death penalty and had never heard of that before.

WRT the last juror that they are still in sidebar over, she didn't appear to be to smart-IMO not smart enough to understand the complexities of this case and then to say she had NO friends? WTH do you use FB for if you have no friends......she reminds me of the nitwit that was found in contempt who worked at Publix.....once JP got him on the stand I was thinking thank goodness he never made it on the jury, he sounded like he was an idiot, of course JMO
