Casey Anthony trial: Family is trademarking 'Justice for Caylee'

George and Cindy Anthony are trademarking their granddaughter's name, as well as "Justice for Caylee," so people won't be able use or sell items with the toddler's likeness, their lawyer told the Orlando Sentinel today.

1. They do not have standing to trademark anything of Caylee's, they are not her parent or legal guardian.  The only way they could even consider something so ridiculous, is if they have been granted Power of Attorney over Caylee's estate by her Mother.  

2. They are not trademarking a "phrase" to keep others from using it, they are doing it so they can use it, and they can receive a royalty of fee for anyone that does.

3. Casey cannot do this herself, because she is being sued civilly, and she is already under a restitution order fine for the economic felony conviction.

4. You cannot trademark a person's name, that is ridiculous.

5. It is not retroactive, meaning it is only in effective from the time it is granted, and they have already been turned down once.

Hi Blink---question about that trademark stuff...that 911 widow Lisa Beamer trademarked the phrase "Let's roll" and it was discussed about no one can use that phrase...would this be the same thing the A's are trying to do?

Here is the thing, that phrase, was uttered and heard from an individual and it is "unique" to that person and event.

His wife trademarked it, as the executrix of his estate, as was appropriate.

This is an example of the correct use of a trademark.  Nobody else can use or publish that without the mention of the trademark or specific use permissions.

You cannot trademark a common name, and you would be very hard-pressed to trademark a phrase "Justice For Caylee" as unique, when it has been used frequently for almost 3 years now.  What do they think they are going to do- erase google and start over, just for them?

You are 100% correct Blink.  The old push has started to come to shove..and I bet Cindy and George with their attorney's help can shove pretty damn hard.  They won't get the trademark..but they have staked a claim and made their point to their darling daughter Casey..this is war.
