It makes me upset that she is allowed to sit and shake her head.  To me that is her nonverbal testimony.  I hope that if she does NOT take the stand, it ticks off the jury to see her shaking her head but then not get up and actually defend herself.

I thought the same thing.  I wouldn't think a witness should be allowed to take notes.
