PORTLAND – A judge in the civil lawsuit of missing Portland boy Kyron Horman has issued his decision not to grant a stay in the case, and laid out rules for attorneys to gather evidence.

Judge Henry Kantor referred to Kyron's stepmother Terri Horman as a “prime suspect” in the investigation, although Terri Horman has never been formally named a suspect in any criminal case.

Terri Moulton Horman's attorney argues in court papers that his client should have "frequent and continuing contact'' with her daughter, Kiara, now 5, saying it's in the girl's "best interest.''

Horman will seek temporary custody of her daughter at hearings set for Dec. 19 and 20 before Multnomah County Judge Henry J. Kantor.

PORTLAND, Ore. - The divorce trial between Kaine Horman and his estranged wife Terri will begin January 2, Judge Henry Kantor announced on Friday.

The decision came at a hearing where both sides argued several issues including child support, how involved the Multnomah County District Attorney’s Office can be and what information a psychologist can take into account when evaluating the couple.

Lawyers for Terri told the court they would soon request a hearing to get her temporary parenting time and temporary support. The judge scheduled a hearing for December 19 and 20 to hear that issue.

Judge Kantor also scheduled a full custody hearing for June 11-13 of next year. The psychologist told the court that he would need until next May to finish his evaluations.

Terri’s lawyers expressed the concern that law enforcement information could come up during the evaluation process and "contaminate the process." The judge said that the psychologist can be told to ignore that information.

It also came out that Kaine was deposed by Terri’s lawyers earlier this week. They told the judge that they followed his instructions about what they could and couldn’t ask

As for the role of the DA – the judge said while the DA’s office cannot have a formal, continuing role in the process, they will be allowed to appear before the court to argue for the protection of the integrity of the criminal investigation.

PORTLAND – Terri Horman is asking the court to allow her to spend time with her 5-year-old daughter, according to court documents obtained by KGW Monday.

In court documents associated with the divorce case filed Nov. 26, Terri's attorney Peter Bunch said Kaine has shown no evidence that should keep her away from the child and that Terri should have "frequent and continuing contact with Kiara."

Bunch stated in the document that he would present "expert testimony" to assist the case for restoring Terri's parenting access.

It appears that Peter Bunch is taking full advantage of his knowledge that incriminating circumstantial evidence gathered in the Kyron Horman case ... circumstantial evidence that would show cause that that Terri should not be entrusted with Kiara ... cannot be released without compromising the investigation.

Considering the judge is between a legal rock and a legal hard place in regards to a ruling regarding the custody of Kiara ... could it be that dots are being connected within the investigations that may result with an indictment sooner than later.  Could that indictment involve a MFH charge.

PORTLAND -- The landscaper who police believe Terri Horman approached in an alleged murder-for-hire plot against her estranged husband Kaine Horman was scheduled for a deposition Wednesday.  But the interview was later canceled.

Terri Horman's defense lawyer objected to the deposition and requested an emergency hearing to prevent Rudy Sanchez-Estrada from being questioned. No court hearing has been scheduled to discuss the matter.

According to court papers obtained by KGW, Kaine's lawyers wanted to question Sanchez-Estrada as part of the ongoing divorce proceedings with Terri Moulton Horman.

Could it be that prior to investigators informing Kaine that there was probable cause to suspect that Terri was behind the disappearance of Kyron and probable cause Terri was involved in a MFH plot against him ... there was no valid reason to consider his wife an unfit mother ... no valid reason for him to flee with Kiara ... not valid reason to take out a restraining order denying Terri access access to their daughter?

Would you not do likewise in the same situation ... if Kiara was your daughter?

Details in alleged plot to kill Kyron Horman's father

A landscaper claims that Terri Horman tried to hire him to kill her husband and have it made to look like a mugging, according to court papers in the case obtained by KATU.

The papers were filed in the divorce case being fought between Terri and her estranged husband, Kaine.

The couple is better known as the father and step-mother of Kyron Horman, a child who disappeared from Skyline Elementary in June 2010. Law enforcement officials have not found any witnesses who saw the child after he was seen with Terri who had brought him to school that day.

The landscaper, Rodolfo Sanchez claims in a deposition taken last month that:

•    Terri hired him to perform landscaping work in 2008;

•    Kaine was never told that Sanchez was doing the work;

•    Terri had been contemplating divorcing Kaine for many months;

•    Five months before Kyron disappeared, Terri asked Sanchez to a restaurant. She had Kiara, the daughter she and Kaine had, with her. She told Sanchez that Kaine was abusive and asked for his help finding someone to “get rid of” Kaine;

•    When he asked why, Terri allegedly told him that unless she got rid of Kaine, he would take Kiara from her;

•    Terri said that Kaine always carried $10,000 with him and a computer and the murder could be made to look like a mugging;

Sanchez said he told Terri that it was an offer that he could refuse.

A hearing to discuss a recent attempt by Terri to obtain temporary custody of Kiara will be held later this month.

Kaine has been fighting that attempt and his lawyers argue the Sanchez testimony establishes the risk presented by Terri.

After Kyron’s disappearance, Sanchez told law enforcement about his earlier interactions with Terri. When law enforcement officials informed Kaine of what they had learned, he and Kiara left their home, he filed for divorce and obtained an order of protection.

I am told by sources that Terri was involved in an intimate relationship with Rudy Sanchez at some point. The extent of which, to my knowledge has not been verified.

If Bunch did his homework ... the Dateline interview with Kate Snow relates clearly WHEN and WHY Kaine began to fear for the safety of Kiara if she was entrusted to to Terri.

Considering LE briefed Kyron's parents that there was probable cause to suspect Terri had attempted a MFH plot against Kaine ... considering LE had briefed Kyron's parents that there was probable cause that Terri was behind the disappearance of their son ... when I put myself in Kaine and Desiree's place ... I fail to comprehend the undermining on various forums ... the undermining of words and actions regarding their focus on Terri in their mutual quest for answers ... in Kaine's attempt to protect Kiara.

Kaine says police informed him of a harrowing discovery. About six months before Kyron went missing, Kaine's wife, Terri, had allegedly tried to hire a landscaper to kill him. Kaine opened up to Dateline about the allegation.

KAINE HORMAN: Mm-hmm. I didn't believe it at first. It was something that I couldn't even wrap my head around at the time. Just thought...

Kaine has said there were more ups and downs in his marriage to Terri after the birth of their daughter 20 months ago. Still, Kaine says he never saw something like this coming.

KAINE HORMAN: Nothing so far one way or the other that would have even put that on my radar screen as something to worry about.

It was a pivotal moment for Kaine, the moment he stopped trusting his own wife, the woman who'd been helping raise his children. Authorities are still investigating the alleged murder-for-hire attempt, but if the allegation against Terri is true, many think it speaks volume about the mission to find Kyron.

KATE SNOW: Do you think she is capable of hurting a child?

KAINE HORMAN: If you asked me before this situation, my answer's no. Based on what I know now, I don't know. I think anything is possible based on the way things have gone over the past few weeks.

KATE SNOW: You fear for your safety now, Kaine? For your daughter?

Less than two months following the disappearance of their son until the presence ... Kyron's parents have not budged from their focus on Terri for the answers their desperately seek.  Considering Desiree and Kaine are continually briefed regarding the status ot the investigation ... it makes sense that investigators had not budged from their focus.

Beaverton tree lighting draws hundreds despite freezing temps and bitter wind

As 7 p.m. approached, families made their way toward the nearby park, where Beaverton Mayor Denny Doyle counted down the seconds until the huge tree lit up.

Ninety-six strands of lights in bright hues dropped gracefully from the bright star atop the tree, connecting to yellow strands at the base of the branches.

The tree held more than 25,000 lights, estimated Scott Zwingli, co-owner of A Light Up Company. The city contracted with Zwingli's company to decorate the tree.

Susan Zwingli, who owns A Light Up Company with Scott, said light has a special effect on those who see it.

"It's amazing how something like this can bring people such joy," she said, gazing up at the twinkling tree.

Think about it.  Despite their history Kyron's parents after 3 1/2 years remain confidence in the investigation encompassing their son's disappearance.  As long as they both maintain that position ... I will uphold them ... I will not second guess them.  After all ... ongoing briefings with investigators imply that that Kaine and Desiree are in the know.

Kaine, MCSO committed to 'bringing Kyron home'

BEAVERTON, Ore. (KOIN) -- Kaine Horman held a news conference Tuesday afternoon at the Wall of Hope, just hours after the mother of missing Kyron Horman said she dropped a civil suit that may have been keeping the boy's stepmother, Terri Horman, from revealing what she knows about his disappearance.

"We still have extreme confidence that they're going to drive resolution to the case," Horman said to reporters around 3:15 p.m. He said law enforcement is "again asking us to help protect the information as much as we can, so it doesn't interfere with the integrity of what they're doing. And we're doing our best in the civil arena to do that."

The Wall of Hope was constructed outside of his missing son's northwest Portland elementary school shortly after Kyron's June 4, 2010, disappearance. In August 2011 the wall was moved to Beaverton, Ore., where it stands at the parking lot of The Edge Gym.

During Tuesday's press conference, Kaine Horman did express disappointment over Desiree Young's dropped civil suit.

"At the same time," Horman said, "trying to press forward to find Kyron and protect my daughter are the two things that are in the highest priorities."[/color] The daughter's mother is Terri Horman.

He said he does agree with Young that it's probably best to drop any suit that might infringe on the investigation into Kyron's disappearance.

Here's what Young had to say earlier Tuesday: "I don't want anything to compromise the ongoing investigation for Kyron. For these reasons, I have instructed my attorneys to dismiss the civil case."
