Fathima Rifqa Bary, the Ohio teen who fled to Florida out of fear her Muslim family would harm or kill her because she converted to Christianity, was scheduled to participate in mediation today.

An Orange County judge ordered Bary and her family to participate in mediation during earlier court proceedings.

But because mediation is private and juvenile records are not public, it's unclear if the meeting will take place today. It's also unknown where the parties and their respective attorneys would meet.

Rifqa has been in Orlando since July, when she ran away from her home in the Columbus area and sought shelter with pastors she met through a Facebook prayer group.

Eventually, the 17-year-old was ordered into the custody of the Department of Children and Families, and she's been in state foster care in Central Florida since.

Rifqa's parents have said they have not threatened to kill her, and they want her returned to Ohio. Law-enforcement in both states have said they found no credible threats against the teen.
The battle over Rifqa is now being played out in courtrooms in Ohio and Orlando. A hearing is scheduled in the Orange County case Tuesday.

The stunning indictment outlined here in the investigation of the Noor mosque is damning enough, but this new revelation over at Jawa leaves no doubt as to how Rifqa will be received by the jihad mosque leaders. Tomorrow is her hearing. More on Saqr here (he's big in the Muslim Brotherhood).

But another piece of the puzzle comes into play connecting both of these established facts, namely, that phone records obtained by the Department of Justice for top Hamas leader Mousa Abu Marzook shows that he and Saqr were in direct communication at the time that Marzook was overseeing millions in disbursements to the terrorist organization. At the time, Hamas was getting as much as 30 percent of its budget from the US. The graphic below taken from Marzook's phone records (p. 21) show calls between Saqr and the terror leader in June 1992, among others (courtesy of the Florida Security Council).

Hamas had already been identified by the State Department as a terrorist group when these calls took place, and according to the official Hamas website, Marzook was operating as its top leader since at least 1991. Some insider accounts from pro-Hamas scholars claim Marzook had been leading the organization since 1988.

One has to wonder if Hany Saqr disclosed his leadership role in the international Muslim Brotherhood movement, his supervision of a terrorist financier, and his communications with the top Hamas leader on his immigration paperwork as is required by law? That might explain why Saqr's friend, Meredith "Hijab" Heagney of the Columbus Dispatch, has thus far failed to make any inquiries into this information

Ohio teen runaway Fathima Rifqa Bary, who has been living in Central Florida for nearly three months, is expected to be back in court this afternoon.

Lawyers in Florida and Ohio have been battling over 17-year-old Rifqa's fate. Rifqa's family wants her returned to the Columbus area. The teen wants to stay here.

Rifqa ran away from home in mid-July and said she feared her Muslim family would harm or kill her because she converted to Christianity. Her family said her fears are unfounded.

The Florida Department of Law Enforcement didn't find any threats.

After arriving in Orlando, Rifqa sought shelter with local husband and wife pastors she met through Facebook, and lived with their family for several weeks.

In early August, an Orange County Circuit judge ordered Rifqa be placed in custody of the Florida Department of Children and Families. She's remained in foster care since.

One of the issues that remains unresolved is which state has jurisdiction -- Florida or Ohio.

Last week, the parties involved in Rifqa's case met for mediation.

But because juvenile records are private and mediation is not public, it's not clear what was discussed.
Today's hearing is slated to begin at 2:30 p.m. It isn't publicly known what will be discussed. It also is not known if Rifqa will appear -- though she has attended previous hearings.

ORLANDO, Fla. -- Rifqa Bary, 17, will appear in a Central Florida courtroom for a pretrial hearing on Tuesday.

While it's unclear exactly why the hearing is slated, several things could happen inside the courtroom.

A judge could decide on jurisdiction and whether the case should be heard in a Florida courtroom or moved to Ohio. The hearing could also be a status hearing to figure out how counseling for both sides is progressing.

The details are unclear because the case is being heard in juvenile court.

Bary is known as a religious runaway, and she made national headlines when she fled from her parents' home in Ohio because she claimed they planned to kill her for converting to Christianity. Bary posted a video on YouTube calling her parent radical.

A Florida Department of Law Enforcement investigated Bary's claims and found no evidence she would be a victim of an honor killing if she were returned home. There was also no evidence of assault or abuse.

Muhammad Musri, the leader of the Islamic Society of Central Florida said it's a story of a typical teenager at odds with her parents.

"The teenager in this case exaggerates the story just to be able to to justify her running away," Musri said.
Bary's parents filed a criminal complaint against the local pastors who assisted their daughter.

It seems to me that even if there were no danger if Rifqa returns to her parents (Although I am sure there will be) the mere fact that she is afraid to go home should be enough to keep her in FL. She is not six years old.  She is a young adult who will reach her majority in a few months and I can't understand why they would go against her wishes.  She fears for her life.  How can a judge ignore that and send her to the place she fears? 

There is little doubt that again we will see bowing to Muslims.  The US is becoming like Western Europe.  Of course with a President who spent the first ten years or so of his life as a Muslim and who insists that Islam is a "Religion of peace," what can we expect from the courts who probably buy the "Peace" bit and have never read anything of substance about this so-called religion?

Practicing Muslims who live by the Koran are required to kill Rifqa if she returns to Ohio.  It is "Pleasing to Allah."

"It's possible and the purpose of today, although being a pretrial, with having the parties together, and having a number of outstanding issues to address, I think that we could and should expect, perhaps, a status update on some parts of this case, including jurisdiction," said Carrie Hoeppner, a spokeswoman for the Department of Children and Families.

3:35 p.m.: Judge rules -- Rifqa will complete Florida Virtual schooling until the end of the grading period.   DCF will directly turn over custody of the child to Franklin County Children Services.

The ongoing story of Rifqa Bary, the Ohio teen who earlier this year ran away from her devout Muslim parents out of fear for her life after having become a Christian, took another turn today when during an odd joint court session, one held in Florida where Rifqa is currently located and one in Ohio, it was ruled she should be returned to Ohio.

Rifqa's return is contingent on her parents providing the documentation concerning her immigration status. Despite this request having been made several times by both Rifqa's legal representation in Florida and the court in Florida since the start of the case it has yet to be produced. It is not known what would happen should it be revealed that Rifqa and her family are in the United States illegally as has been surmised by some bloggers following the case.
Another element not known is what will happen to the case when Rifqa is returned to Ohio. Although a representative from Ohio's Office of Families and Children stated during today's court proceedings that a foster home has been found for Rifqa, deep concerns have been expressed that once Rifqa is back in Ohio her parents will seek to have the case dismissed, thus leaving her unprotected.

None of the above is designed to either assert or imply that Rifqa's parents are going to carry out an honor killing of their daughter. What is being said is given the inexorable division within the Bary family caused by Rifqa being a Christian, it is more than unlikely an amiable resolution can be reached. Also, given the actions of Bary's parents since she ran away including making her journal public and stating to the court she is incorrigible one is given cause to wonder how this rift, even if Rifqa's fear of an honor killing is unfounded, can be healed.

All believers are urged to keep Rifqa in prayer that she may be allowed to worship Jesus in peace and safety.

Fathima Rifqa Bary is likely coming home to Ohio, the state she fled nearly three months ago, saying she feared death for her conversion to Christianity.

But she'll be staying in a foster home, not her parents' Northeast Side apartment.

Jurisdiction in the 17-year-old's case should be transferred from Florida to Ohio, judges in both states decided via conference call yesterday.

Dependency cases were filed in both states to determine whether the girl should be returned to her parents, who she says would harm her for leaving Islam.

"I believe this is the home state and the most convenient forum with respect to the issues as I understand them," said Franklin County Juvenile Judge Elizabeth Gill.
Judge Daniel P. Dawson of the 9th Judicial Circuit Court of Florida agreed, but he required certain steps be taken before she is returned.

Rifqa ran away in July, saying her father threatened to kill her for becoming a Christian. Mohamed Bary denied her accusations, and a Florida Department of Law Enforcement investigation found no credible threats to her safety.

She could be back in Ohio by Oct. 27, when a hearing is scheduled in Franklin County Juvenile Court, said Dawson, speaking from Orlando.

But before ordering her into the care of Franklin County Children Services, Dawson wanted two issues settled.

He asked for documented assurance that Rifqa's online schooling can continue in Ohio. Dawson also asked that Rifqa's parents provide all paperwork related to her immigration status before she crosses state lines.

Rifqa, a native of Sri Lanka, is not a U.S. citizen.

It isn't yet clear exactly when Rifqa will return, or how she will be transported. She will receive a psychological evaluation when she gets here.

Dawson asked whether the Barys could simply dismiss the Ohio dependency case because they filed it themselves in an attempt to transfer jurisdiction.

Assistant Franklin County Prosecutor Chris Julian said they would not agree to dismiss the case. A Children Services official added that it would not be in Rifqa's or her family's best interest for her to live at home at this time.

In Gill's courtroom yesterday, Mohamed Bary and his wife, Aysha, sat calmly between their attorneys. They laughed when they heard Rifqa's Florida attorney, John Stemberger, say that she was in danger of being sent back to Sri Lanka where she could be killed or institutionalized.

Stemberger also said Rifqa wants to stay in Florida.

After the hearing, the Barys and their 18-year-old son, Rilvan, said they were told not to comment. Rifqa's Ohio attorney, Kort Gatterdam, cited a gag order in declining to comment.

Dawson expressed frustration during the hearing that the Barys had not provided Rifqa's immigration paperwork after repeated requests.

He gave them 10 business days to comply, under threat of being found in contempt of court.
He also ordered the release of the 110-page transcript of a nearly three-hour interview with Rifqa that was conducted by Florida Department of Law Enforcement investigators. But some information must be redacted first, he said, not specifying an exact release date.

    * July 19, 2009: Rifqa Bary disappears. It is later determined that she had taken a bus to Orlando, Fla., where she met Beverly Lorenz. Mrs. Lorenz met the girl through a Facebook prayer group. Rifqa has since been assigned to a foster family approved by the Florida Department of Children and Families.

    * July 29, 2009: The first call about Rifqa to the Florida Department of Children and Families is made. Officials wouldn't say whether it was a member of the Lorenz family who called.

    * Aug. 13, 2009: Rifqa's Muslim parents say their daughter has been brainwashed and that she was free to be a Christian.

    * Aug. 21, 2009: A judge rules that Rifqa will stay in Florida while custody issues are being settled. Mohamed Bary, Rifqa's father, told the judge that his daughter would be able to practice Christianity if she returned home.

    * Aug. 31, 2009: An attorney for Rifqa alleges in court documents that her family's mosque in Dublin, Ohio, has terrorist ties, a charge disputed by the Islamic center's leader. Rifqa said in a sworn statement that her family regularly attended gatherings at the Noor Islamic Cultural Center in Hilliard, and her attorney said in a memo that the mosque hosted extremist speakers and supported a scholar with ties to the militant group Hamas.

    * Sept. 2, 2009: Mobin-Uddin, a Columbus pediatrician, is among the members of the Noor Islamic Culture Center who invited reporters to the facility for a tour and to distance themselves from the legal battle between Rifqa and her family.

    * Sept. 3, 2009:
          o Christian supporters of Rifqa, some of them from out of state, hold Bibles and try to crowd into the 9th Judicial Circuit Court of Florida alongside an army of newspaper and TV reporters and bloggers. Activists hold a news conference outside to rally against their view of Islam, exchanging shouts with an angry Muslim man from the area. Inside the 9th Judicial Circuit Court of Florida, Judge Daniel P. Dawson was given the task of looking past the culture war to the issue of what to do with Rifqa.
          o A pretrial-hearing date is set for Sept. 29. The two sides were ordered by Dawson into mediation in the next 30 days. Dawson issues a gag order.
    *
          o Eric Fenner, executive director of Franklin County Children Services, says that the agency has "no reason to believe" that Rifqa wouldn't be safe with her parents.

    * Sept. 8, 2009: The parents of Fathima Rifqa file a complaint in Franklin County Juvenile Court accusing their daughter of being incorrigible. The filing further states that Rifqa is "habitually disobedient," comes and goes as she pleases, defies her parents and their rules, and is truant at home and school.

    * Sept. 14, 2009: The summary of a report by investigators with the Florida Department of Law Enforcement says that no evidence has been found that Fathima Rifqa Bary was threatened with death by her Muslim father for converting to Christianity. The report further states that there is no credible evidence of abuse and that Rifqa had help getting to Orlando. Rifqa's case is now in dependency court in Orlando, where a judge is to decide whether she will live with her parents or in foster care. A pretrial hearing is set for Sept. 29; Rifqa and her parents are to attempt mediation before then.

    * Sept. 21, 2009:
          o Rifqa's father steps up a strategy to bring his daughter back to Columbus. Mohamed Bary files a criminal complaint against the Orlando pastors who helped shelter Rifqa for more than two weeks before the state intervened.
          o In a hearing, Orange County, Fla. Circuit Judge Daniel Dawson does nothing to change the custody of the 17-year-old, who is living with a foster family near Orlando, and says he plans to talk to the Franklin County judge handling the case to find out whether there is a legitimate custody action in Ohio.

    * Sept. 22, 2009: The legal battle over Rifqa continues in a Franklin County Juvenile Court.

    * Oct. 13, 2009: A Florida judge orders Rifqa back to Ohio. Orange County, Fla., Circuit Judge Daniel Dawson said that Bary, 17, who has been staying in Orlando, should return to her family. Franklin County Children Services has accepted the case and has a foster family for Bary.
