ORLANDO, Fla. -- The Casey Anthony defense team has filed a motion that seeks to keep jurors in her upcoming murder trial from seeing how she reacted when she learned her daughter's body had been discovered.

Anthony, 24, is jailed on first-degree murder charges in the death of her daughter, Caylee, whose remains were found in December 2008. Caylee was 2 years old when she was reported missing in July 2008, about a month after she was last seen alive.

Anthony, who was in custody at the Orange County Jail in 2008, was caught on camera while watching news of the discovery on television.

In the motion, Anthony's attorneys said she did not know she was being recorded and investigators set her up so they could get her reaction on camera.

Judge Belvin Perry has not yet set a date to rule on the motion.

Anthony has pleaded not guilty. Her trial is scheduled to begin in May.

Orlando attorney Brad Conway's new client is the wife of a suspect who shot at members of the Panama City School Board before a security guard shot him. The wounded man then shot and killed himself.

In an exclusive interview with WESH 2 News, Conway said Clay Duke's wife, Rebecca, has had her life opened up to police.
She has become the subject of public scorn, Conway said, even though she's not accused of any crime.
Police said Clay Duke was bipolar and blamed the board for laying off his wife.
"She along with everybody else had no idea her husband was going to do such a horrendous thing," Conway said.
Conway said he became Rebecca Duke's attorney last week.
Even though she's accused of no crime, police served a search warrant on her home.
Conway said he is serving in an advisory role for Duke, much like he did for George and Cindy Anthony.
"She does not have a lot of sympathy. She's still trying to grieve. People see a horrific video of a guy shooting at innocent people and not the guy she knew," Conway said.
Conway said that there is no indication at this point that Rebecca Duke will face criminal charges in the future. He said he plans on continuing to be her go-between between with police and the media.

In the documents, Casey’s attorney's, J. Cheney Mason and Jose Baez, requested to have nearly two dozen items tossed out.

One of those items is the tattoo Casey got two weeks after Caylee disappeared, which reads "bella vita" which is Italian for "beautiful life."

The defense also doesn't think the shovel Casey borrowed from a neighbor, traces of chloroform found in the trunk of Casey's car, and a stain found there are relevant.

Baez is also asking the judge to exclude any and all cadaver dog search results, during the time the dogs were looking for Caylee's remains.

Casey's lawyers also want to get the judge to limit or exclude evidence taken from Casey and her mother Cindy's Myspace pages.

Cindy posted a message on the social networking site titled, "My Caylee is Missing," twelve days before she alerted the Orange County Sheriff's Office.

She went on to say "jealousy" took her granddaughter away, and her daughter, Casey, betrayed her and stole her money.

The defense is also trying to keep jurors from hearing about a message that Casey wrote, stating "Everyone lies, everyone dies and life is never easy."
WFTV legal analyst Bill Sheaffer said the defense isn't doing anything surprising.

Sheaffer said the defense is doing what it is supposed to be doing and trying to weaken the case as a whole.

Casey Anthony's lawyers also don't want a jury to see her reaction to Caylee Anthony's remains being found, according to a motion WFTV obtained Thursday. Her reaction was caught on camera from inside the Orange County jail.

Caylee's remains were discovered in December of 2008. Casey was watching coverage about the discovery and became visibility upset, according to officers.

Her lawyers filed a motion late Wednesday to suppress the video. They say her reaction is not relevant and that cameras were rolling as part of a set up.

Casey Anthony is expected in court on Monday, January 3. At that time, the judge will hear a request by prosecutors to bring sanctions against Casey's defense team.

Prosecutors say the defense has ignored the judge's order to provide specific information about defense witnesses' testimony.

Judge to consider Caylee Anthony murder case motions

ORLANDO, Florida (Reuters) - Should jurors see evidence that 2-year-old Caylee Anthony was buried with a duct tape gag around her mouth topped by a heart-shaped sticker? Should they hear testimony her mother borrowed a shovel from a neighbor around the time Caylee was last seen alive?

Lawyers for 24-year-old Casey Anthony, accused of murdering her toddler and facing the death penalty in Orlando, say no.

Orange County Circuit Judge Belvin Perry will begin hearings January 3 on these and other defense motions, filed in the closing days of 2010 to beat the judge's deadline for raising objections to non-scientific or forensic evidence in the murder case.

At stake is how much potentially incriminating evidence jurors at Casey Anthony's trial, set for May 9, will hear.

For the tabloid news-reading public and fans of television true crime shows, the details of the 2008 murder are well known, since by Florida law, prosecutors must release their evidence publicly.

That has resulted in 30-months-and-counting of headline-making fodder.
On July 15, 2008 Cindy Anthony -- the mother of Casey and grandmother of Caylee -- made 911 calls to police to report Caylee was missing, that Casey wouldn't say where the child was, and that Casey's car trunk smelled like a dead body.

In the investigation, detectives determined no one had seen Caylee after June 16, 2008, almost a month before Cindy Anthony made the 911 calls. Friends said Casey explained Caylee's absence by saying she was with a babysitter.

Sometime during the week of June 16, Casey Anthony asked to borrow a shovel from neighbor Brian Burner, telling Burner she needed to dig up a bamboo root she kept tripping over. She returned the shovel the same day.

Defense lawyers want that episode kept from the jurors, arguing the shovel has never been directly tied to the death.

Caylee's skeletal remains were discovered in December 2008 in a bag in the woods a quarter-mile from the Anthony home. Investigators said her skull was wrapped in duct tape at her mouth.

According to an analysis released by prosecutors, residue in the shape of a perfect heart was found on the duct tape which matched a heart-shaped sticker discovered near her body. Similar heart-shaped stickers were found in a subsequent search of the Anthony home.

Defense lawyers, however, call the residue "phantom" evidence which they say was destroyed in the lab and should not be used at trial.

"The alleged existence of this phantom image was only seen for a fleeting moment by two fingerprint examiners who did nothing to preserve it or even photograph it so it could be seen by others," according to their motion.

Casey Anthony had already been indicted by a grand jury for murder and was in jail when her daughter's remains were found. Among the alleged evidence against her: lab tests on the air and carpet in the trunk of Casey Anthony's car found signs of chloroform and decomposition of something that could have been a human body.
According to a defense motion, as the news broke about the discovery of the body Casey Anthony was taken to a jail clinic that was under video surveillance to record her reaction.

The motion argues the video should be banned from the trial because it violated Casey's Fourth Amendment right to counsel, and is irrelevant to the case. So far, the video has not been released publicly.
