I was here until about 1, then left for a nap, came back around 6, read all the pages, and I do not remember her craying at all.  There was a note handed to her at some point that seemed to get a reaction, but I do not recall seeing anybody wagging their finger in her face, but I could be wrong.

I think we all do a great job of staying OT until the breaks when we have to stare at her and after court ends for the day when we all want to vent about that day's events.  I really try.  I will try harder.

Just a word about the O/T:

The OT issue has always ebbed and flowed here at SM. Believe it or not, it's often complaint driven. When it occurs in moderation and at times like you mentioned (after a hearing, during breaks, late at night, etc.) mods and Klaas sometimes just look the other way.... to a point. I think we all recognize that when there is a lot of activity in a case, posters come to know and enjoy each other and it's hard not to just converse sometimes. The problem is that when folks come to the thread to actually catch up, it's hard for them to wade through the chit chat to get the day's news. They rightfully complain and sometimes feel it's disrespectful to the victim.

We created the Musings thread to accomodate the chit chat, but it hasn't always worked. There's just a reluctance to move over to a different thread. Maybe we should re-name it the "after hours bar" thread and it would work better!   ::MonkeyDevil2::

Why does this article say they "tradmarked" Caylee Anthony and Justice for Caylee, when they just applied?  Why doesn't WFTV check it's facts better? 

Casey's parents, George and Cindy Anthony, have trademarked the name Caylee Anthony, in order to stop companies from selling merchandise.

The Anthony’s attorney, Mark Lippman, said they also trademarked the phrase "justice for Caylee" after everything from hats to underwear were being sold with the phrase. A cease and desist letter was also sent to two websites selling the merchandise.

Jurors May Be Sworn In On Day 9 Of Casey Trial

ORANGE COUNTY, Fla. -- It's day nine of Casey Anthony's murder trial and Chief Judge Belvin Perry hopes the jury will finally be sworn in.
He was close to finally having one group of 12 sworn in on Tuesday, when the defense made a last minute objection.

The defense has just one challenge left for the 12 panel jury, but one also for the alternates. The state still has five challenges.

With eleven seated jurors now the magic dozen needed seems elusive to Perry who wants to reach 12 and swear them in.

“The magic number I have is I gotta have this thing complete,” said Perry. “The well runs dry after this,” said Perry.

WFTV legal analyst Bill Sheaffer said the last thing the judge wants is to declare a mistrial and start again somewhere else.

I hope so too. I have to admit to being a little nervous about this jury, but am going to put my faith in the judge. Got my dvr box replaced yesterday so going to get it set right now. Maybe that way I can watch what I missed during the day and keep myself out of trouble here ......

Now, let's get this jury seated and sworn in. Kind of worried about the alternates situation, but am saying some extra prayers that God will intervene for justice for our sweet little angel....I am not in the least bit concerned about Casey not getting the DP, as LWOP is not a bad idea for that biotch. I really do believe she still thinks she is above all rules and laws and cannot wait to see her face when the guilty verdict is read.I hope we don't start seeing shades of OJ....

Just a quick summary of where we stand:

11 PJ's retained so far.

Males= #1340, #1019, #1025, #3308(?), #3185

Females= #1398, #1055, #1319, #1429, #1007, #3015

Challenges/strikes so far:

Defense: #1011, #3119, #1129, #1232, #1119, #1251, #3397, #1159, #3190

That leaves the Defense with one remaining, and the State with four remaining.

Correct, she is attempting to argue that the process that the honorable Chief Justice is implementing within the Florida State guidelines is denying their client due process for a fair trial.   She is arguing the entire method.   When they went to speak to Casey "in conference" yesterday I saw this coming because they totally screwed up strategically with their PC's (strikes).

He said this was known how this would selection would work for months.

Why are they challenging today?

(walked into courtroom before he was recognized as a PJ, heard ~20-30 seconds of the motion's argument.) Said he was misdirected from downstairs, he says he did not hear anything.

They are trying anything underhanded to get this case into appeals....

Someone on WFTV said he works for Bay Care Medical.  I remember vaguely someone doing that kind of work that was questioned earlier.  Said he could get by on $30 a day.

We heard yesterday that one of the juror's didn't show up.  I guess this is the guy.  And...I guess he didn't even call the court house yesterday to tell them he wouldn't be there.

How can you trust this person to have the responsibility to make a good decision as a juror?

Yep.  IMO - He either doesn't like women ... or he doesn't like prosecutors.  I'd lean toward to latter.

You can't...that simple.   If he at least called Id give the benefit of the doubt.   He should be excused for cause on that alone.

Just a thought.  Maybe he has access to a car but doesn't normally drive a car to work.  Maybe he normally uses public transportation or bike or walks. 

Most unfortunately, no. She is a guaranteed juror. State wasn't allowed to backstrike because they'd already used a peremptory challenge on her earlier. The State's PC had been denied after being challenged by the Defense.

Anyone think perhaps he buddied with #1392 the dude that knew nothing, than a little bit than he was facebooking, and finally saw a book deal coming out?  Learned what not to say to get on!

Good morning all you Awesome monkeys!! Long time reader..rare poster..I read every chance I get..Ya'll are just wonderful at keeping me updated and aware of all the days happenings.  I enjoy the opinions of all of you and agree 99.999% of the time. Like alot of you, my dear hubby thinks I am obsessed with this case..I guess I am..I talk about it all the time..people at work know next to nothing about this case..it frustrates me..I guess I am a news junkie after all..lol! But I am a Crusader of Justice for CAYLEE and know that because I talk about it..many people who never knew about Caylee are now asking on a daily basis what is happening..I cannot wait till the GUILTY verdict is read..then I hope the other members of her family meet Brother Justice too!! I took this week off..to watch the first week of trial. How disappointed I am that they STILL have no jury!! I am just flabbergasted about the farmville juror and the BS of the duh-fense team. I hate them!! I sincerely hope that Justice is served and that all who harmed this beautiful child get the penalties they so richly deserve.


By the way, THANKS BRANDI for my adorable little Jamms Monkey on the beach! You do fantastic work!!!!

She's always that way, just a tad less animated today.  For example, when she constantly asks if a person understands & the preachiness of her speal.   She's manipulative but not obvious about it.

This first guy didn't seem to like Jeff Ashton at all and he really seemed to like the defense.  Did other monkeys feel the same way?  How can he not afford gas?  What if he had to go to work?  I wish someone would of asked him, if he called in and explained or he went to work or whatever.  I know personally, I would of FOUND a way to get to jury duty, especially after I had met Judge Perry the first time.  I would of walked, if I had to.  Something seems *off* here.

I believe this juror is gay (not saying anything wrong with this).  I also believe some of his reactions to questions are affected by his feelings about how the prosecution or defense may feel about him.  I could be 100% wrong but this is my gut feeling.

Yes, but they only have 1 left.  The state has 4 left.  The state can strike him but I would rather make the duffense use their last one.  If nobody strikes him the judge is going to swear the jury, with 12 jurors.

Oh, thanks. I hope the State doesn't do much more striking, because the defense has only one strike left. Plus the one strike for alternates.So giving the defense 2 strikes, I think they'll have jurors by end of day if they don't keep delaying with these lectures from the judge. He should not waste time with this kind of thing, because the defense couldn't absolutely care less. As many problems for prosecuting this case, the better they like it.

goodmorning everyone.  i think jp is gonna let them keep questioning people until lunch time tomorrow and then swear in the jurors and alternates, use friday as a travel day and start on monday. i'd rather just let baez have his way with this so it doens't end up an issue on appeal.

It can be done. JP said it has taken 1 hour to question each PJ so that is 15 hours. I say stop taking all these breaks and just do it or bring all the PJ and question them as a group like it is done in most jury trials..

As much as I do like Judge Perry, most of this is his fault due to poor time/juror management by not just making them sit and wait. You cannot be nice to or try to please everyone. He knows Bozo is a doosh head and his antics were expected. Not enough time was planned out for this extensive death jury.. JP should stop making empty promises. The Judge's focus is on preventing appealable issues, as it should be. Let's get moving

I think there's a lot the State has to consider now. Do they backstrike or issue PCs and risk moving the trial again, considering also that the county is running out of money and only has funding for a limited time so far? Or do they let the jury be seated without issuing challenges, unless it's undeniably obvious the pj can't overcome bias, and risk a hung jury?

I thought it was denied and they started questioning jurors. Now JP is saying they can question the other 15.They were only questioning after they used their strikes until they got to 12. Now they can question them all without having to use a PC

I agree that voice is not enough to go on - I was not just working with the voice. Thank you flamom.  I thought he was pleasant to Ms. Drane-Burdick, but there was something about his attitude toward Mr. Aston that verged on antagonism.  It could have been just me, but I got that impression just from hearing them.  Other than that, I thought he was a young black man who dressed well, apparently better than the white folks who have been in court.  Also, he has worked as a personal trainer and is attending college.  I also thought the remarks about shacks, etc. were uncalled for.  But we each must answer to our own sense of fair play.

I think you might be right.  There are a number of examples of Judge Perry backtracking on his orders.  I think that gives Baez the courage to continue to defy the judge because the judge will back down.

I liked this juror from the beginning. Yeah, he was kinda strange in ans. to state, but I liked the fact that his parent had remained married for so long and he was obviously proud of that.

Isn't this where we were at yesterday morning.  11 jurors.  IIRC state has 4 strikes remaining, defense 1, and they each get 1 strike for alternates, total of 7 remaining and only 15 pc's left to question.  Does anyone know how many were excused for cause yesterday?  This is pretty scary, only 1 day remaining and all jurors and alternates must come from the same location.  Big decisions to be made.

You might be right but considering it took 3 weeks to get a DP jury for Couey (sp) and months to get a jury for Scott Peterson a week was not long enough..What happen this news went to commercial. So they have all week now is that right???

Could it be that they are out of PJs for the morning? Maybe they only had 2 scheduled, and one was still sick. I know they were expecting the 11 waiting jurors to come in at 1 with the hope of being sworn in. Hopefully by 1 pm some extra PJs will have beem called in for voir dire.

Definitely. They have today, Friday and Saturday. Even if JP grants Baez his wish about having interviewed all 15 before issuing his last PC and his alternate's PC, there should be plenty of time, even if it's just 5 on two days and six on one (I'm including the guy that was excused today).

I am beginning to think Lippman is as big a BSer as bozo. He can send out all the "cease & desist" letters he wants but if I was selling that merchandise, I would laugh in his face. They may have recently applied for "justice for Caylee" as that is a specific phrase, but until their trademark is granted they don't have any legal standing, not to mention if someone has been using (which many have) that since 2008 they won't approve that trademark for the Anthonys. It only takes one person who has been using it to keep the trademark from being approved. I will look up the applications for recent trademarks to see if that is even true.

Unless I misunderstood him, he was not in school yet, but had that planned. I have to agree there was something wrong with this one,. If he had a criminal background as it appeared then he should have been dismissed by the judge and not make the state take a strike.

I suspect you are right on your feeling about this one. I also wondered if he was an alcohol or drug user the way he answered and the way he had so many jobs and a grandiose attitude when he is nothing.

I am not saying that the last prospective juror should have been seated as a juror.  What I am objecting to has already been stated.  However, if this man were a registered sex offender or had a criminal record, he would have been excused for cause.  The fact that the State had to use one of their preemptive strikes to keep him off the jury indicates to me that neither of the above is true.  He was somewhat antagonistic to Mr. Ashton and I would think that would be worrying to the State. Other than that, I have no further opinion on the matter.

The chief judge of Pinellas and Pasco counties would now allow them to use the Criminal Justice Center up to and including Saturday.

I just realized that as I missed that part. Thanks. When JP was talking about Liberty county, I was thinking how in the heck is he going to the panhandle?  He sounded as if he had checked out all the counties and there was no where but a community center there. If they were going to use a community center, why not one in the area they were already in?

Does anyone remember what happened with Casey's car?  Just wondering if they are still holding it somewhere as evidence.

I didn't hear about Liberty Co, but thought it was funny when he said he isn't holding court in the parking lot.

I checked the Trademark database yesterday as well as today and there is NOTHING in either the pending or granted Trademarks.   The site indicates that once they get the application froms it goes into the database quickly while it is pending approval so that two people do not get the same Trademark and it is there while it is pending approval. I call BS on them.

Also, from the information I posted yesterday, because there were already people selling items with "justice for Caylee", they would get first dibs on the trademark as they were already using it for commerce rather than anticipated commerce.

Good point! We have come this far, it would be best to do whatever it takes to finish up here in Pinellas, rather than start all over again.  CJBP said in the beginning, if a jury could not be seated in the first county he chose, he would go back to Orange.  Then, if it didn't happen there, they would move on.  Too many options for the defense to play with, and they will play with any and all they can.  At this point, I really don't see any reasons to stall. Everything, just about, has been settled. What are they waiting for?  The DT does NOT want a jury panel from the Panhandle!  moo

I don't think this was a Cindy idea as much as the attorney's idea of getting a message across to Casey from Cindy and George.

I know I maybe way off base..but the issue is that Cindy and George are now taking over the trademarking of everything concerning the family..they are coming out swinging at Casey...and Casey got that if her expressions at the end of yesterday had anything to do with this issue.  This is their first step in stepping away from Casey and toward Caylee...Justice for Caylee. 

They know they won't get the trademark..that's not their point.  Their point is they are not standing by Casey's side anylonger and letting the bus roll over them..they are saying they are getting back in the driver's seat...they are going to do what they have to do..and this ain't gonna be pretty.

I could be wrong..but I think the tide just changed.  They are telling her..we know you're going down for this..and we ain't going with you..and we'll do whatever we can to salvage our name and Caylee's..if we make a few bucks great..we got first dibs.  That pizzed Casey off big time yesterday..that is what the DT little meeting was about and why she was looking so angry, red faced about to cry.  Mommy and Daddy are not going to take this lying down any longer.  And their going to trademark your azz to boot.

That is what I was thinking - the very last area of Florida bozo wants a jury from is the panhandle. I wondered if the judge was throwing that out to get him to be more realistic about this jury panel.

I remember hearing early on during this jury selection that a PJ with a criminal record would be permitted to serve so long as the record does not include any felonies.

I would like to see the remaining PJs brought in as a group.
That way JP would only have to talk about Media history and DP one more time.

I'm not as generous in my feelings toward G & C.  I think they want to get the trademark so they can seek licensing fees.  I did hear one attorney say a restraining order would be faster and easier.  If all they wanted to do was stop others from making money off of Caylee they could go that way.  Knowing what I do about these two it is my opinion they are seeking licensing fees.  JMO

PINELLAS COUNTY, Fla. -- It's day 9 of Casey Anthony on trial and on Wednesday, Chief Judge Belvin Perry put the lawyers on notice. He wants opening statements to start on Monday at the Orange County Courthouse, if the 12 jurors are sworn in by then.

There are still only 11 prospective jurors. They've been stuck at 11 for the past few days, so no one has been sworn in. Judge Perry said they will work on Saturday again if necessary to pick a jury.

CLEARWATER -- Judge Belvin Perry threatened attorneys today to throw out the existing jury panel and move jury selection to the Panhandle.

Perry said he would move jury selection to Liberty County, which is west of Tallahassee. He believed the Pinellas County courtroom would no longer be available after Thursday, but he later confirmed the courtroom is available through Saturday.
